The Supreme Court today invalidated a federal law that had criminalized the sale of certain depictions of animal cruelty, including violent dogfighting videos.
An 8-1 majority on the Court said that the law was "substantially overbroad, and therefore invalid under the First Amendment," affirming the right of free speech in the face of some government-imposed restrictions.
The government had argued that showing animals being mutilated, tortured or killed was so explicit that it should be banned. But today Chief Justice John Roberts, writing for the majority, said "We disagree."
"The First Amendment itself reflects a judgment by the American people that the benefits of its restrictions on the Government outweigh the costs," Roberts said.

Entangled and drowned in a fishing net off the coast of Brazil, these green sea turtles in an undated picture are just a few of the millions of sea turtles that have been unintentionally killed by fishing operations over the past 20 years, according to a study released today by the journal Conservation
"Of all the threats sea turtles face right now, bycatch is the most serious," said Bryan Wallace, a marine biologist with Conservation International and lead author of the study. (Read a commentary by Wallace on how he thinks changing your eating habits can help sea turtles.)
The study pulls together data from around the world on sea turtle deaths from nets, hooks, and trawlsóand questions the estimates of previous reports.
"Because the reports we reviewed typically covered less than one percent of all fleets, with little or no information from small-scale fisheries around the world, we conservatively estimate that the true total is probably not in tens of thousands, but in the millions of turtles taken as bycatch in the past two decades," the authors write.
Six of the seven sea turtle species are listed as vulnerable, endangered, or critically endangered on the International Union for Conservation of Nature's Red List of threatened species.

Wild horses are a legendary symbol of the American West. They mostly roam on vast areas of public land overseen by the U.S. government. To prevent overpopulation, the government periodically removes some of them. But critics say the practice is inhumane and could lead to the extinction of wild horses.
Wild horses, in the thousands, run free in 10 states in the American West. They are protected by law and live in remote areas where people don't normally see them.

PENSACOLA - A Marine flight student at NAS Pensacola is accused of strangling his girlfriend's dog.
Twenty-four-year-old Jaimie Maldonado is out of jail on bond, facing a third-degree felony for the death of a 2-year-old Basset Hound.
The Northwoods Apartment complex is very pet-friendly. They have a path for walking your animal, even trash bags and a trash can for cleaning up after them.
Deputies say one of the animals that lived here was found strangled to death inside a dumpster.
Linda Gray/Lives Near Crime Scene: "They could take them to a shelter or somewhere, where they could be taken care of, not choke the poor things."
Lawrence Gamell Jr./Lives Near Crime Scene: "I'd seen the little dog before, it's a terrible thing. Shouldn't happen here at all."
Marine 2nd Lieutenant Jaimie Maldonado arrived in Pensacola with the Marines in November, waiting to start flight school.
Laura Catterton/Dog Lover: "I was horrified to read that a man had strangled his girlfriend's dog to death."
Junior Humane Society volunteer Laura Catterton was reading arrest reports looking for animal abuse when she heard about Maldonado.
His girlfriend told investigators she was out of town when he called her early one morning, drunk, and saying he strangled her 2-year-old Basset Hound because it got feisty.
Catterton: "My dogs get feisty, and I would never ever strangle them to death."
The girlfriend also said a few weeks prior, Maldonado had thrown the dog against a wall so hard it had to go to the vet for stitches.
Gray: "I'm a firm believer in paying for what you do."
Gamell: "You reap what you sow."
Maldonado faces up to 5 years in prison and up to a $5,000 fine.

This frightening disease causes massive internal hemorrhaging, typically affects elephants under 10 years of age, and has an 85 percent mortality rate. COPAKE, N.Y. - Officials say a New York dairy farmer who methodically slaughtered 51 cows before taking his own life may have been trying to spare his family the burden of caring for the animals.
Dean Pierson was found dead Thursday on the floor of his barn in Copake.
Nearby, half his heard lay in their milking stalls, also dead of gunshot wounds.
Pierson left no explanation for what he’d done, just a note on the barn door warning whoever found it not to come in and to call the police.
But there appeared to be a method to his bloody work. He killed only the cows that required frequent milking.
Pierson’s wife says she wants to figure out how to keep the farm going.
She says she doesn’t want "all that work he put into it to go to nothing."

Federal Study: Manatee Death Rate Is Seven Times Sustainable Level
Boat Strikes Are Preventing Species' Recovery
SAN FRANCISCO— The U.S. Fish and Wildlife Service has finalized new stock assessments for manatees that puts the population of Florida manatees at about 3,800 and a Puerto Rico population at 72. The stock-assessment reports resulted from settlement of a lawsuit brought by the Center for Biological Diversity that sought updated assessments, since the Service had flouted its duty under the Marine Mammal Protection Act to publish yearly reports for more than a decade.
“The Fish and Wildlife Service’s population assessment shows that boats are carelessly killing manatees,” said Miyoko Sakashita, an attorney with the Center for Biological Diversity. “Clearly, far too little is being done to protect these endangered manatees in Florida.”
According to the Service’s stock-assessment report on the Florida manatee population, each year about 87 manatees are killed by humans in the state. This is more than seven times the number of manatees that the Service estimates can be killed without impairing the species’ recovery. Boats are the primary threat to manatees, which are frequently struck and killed, or seriously injured, by speeding vessels. Almost 90 percent of the manatees killed by humans were a result of such boat strikes. Manatees are also threatened by water-diversion structures such as dams and entanglement in marine debris, including derelict fishing gear.
“The one thing everyone should be able to agree on is that manatees in Florida and Puerto Rico need more protection from boat collisions to allow them to survive and recover,” said Sakashita.
Stock assessments are required under the Marine Mammal Protection Act and are meant to be used as the basis for management decisions such as those permitting the killing or harassment of the animals by commercial fisheries, oil and gas exploration, boating and shipping, and military exercises.

SELLING OUT TO SLAUGHTER - AMERICA'S WILDLIFE HERITAGE
A major roundup of an estimated 2,500 wild mustangs in Northern Nevada set for Monday has protesters calling for Congress to step in.
Monday's planned roundup is part of an overall strategy to remove as many as 25,000 mustangs from PUBLIC lands across the West.
Wild horse advocates gathered outside the entrance of Red Rock Canyon, managed by Bureau of Land Management, on the eve of the roundup to make their voices heard.
Their efforts follow a plea from singer Sheryl Crow, who has reached out to President Obama and Senate Majority Leader Harry Reid. Crow is among many horse defenders trying to block Monday's roundup.
Opponents argue that many of the horses could be injured or even die during the commute by helicopter during icy winter conditions.
"They're going to hurt and kill the horses, and then pen them up for no good reason," said Arlene Gawne, who helped organized Sunday's protest.
Gawne says the roundup process is NOT ONLY INHUMANE but is costing the taxpayers of Nevada MILLIONS of dollars.
She believes our state could profit by what many see as an icon of the wild west.
"Why isn't Obama having the BLM see what they can do to create jobs and have wild horse sanctuaries and build a wild horse safari industry," added Gawne.
The estimated 2,500 horses expected to be rounded up from the Calico Mountains Complex in Northern Nevada will be headed to 'long-term holding facilities' in the Midwest. (NOTE: "long term holding facilities" - where they are cruelly imprisoned until AUCTION DAY. Sold to the highest bidder, then shipped to Mexico, Canada... to a slaughterhouse for human consumption.)
Nevada's wildlife agency stands behind their roundup, also saying that much of the horses' food supply is running out and affecting AFFECTING surrounding wildlife.

A cat in the US is lucky to be alive after its paws were found glued to a busy highway.
An unidentified couple rescued the feline, named Timothy, after they passed it in Minnesota and believed it to be injured, television station KSFY reports.
When the pair pulled the cat off the road, its paw pads and some claws were ripped off because of the glue.
Timothy has been placed in foster care.
Animal care group Second Chance Rescue said it was furious about the cruelty.

Parents in Albany, New York are upset with the prominent animal rights group PETA (People for the Ethical Treatment for Animals) for distributing “Unhappy Meals” to children exiting McDonald’s across the country.
The “Unhappy Meal” is a part of PETA’s McCruelty campaign, which is meant to warn children about the cruelty that PETA says is behind every Happy Meal. From animal cruelty to manipulating advertising that targets children, the charges that PETA is accusing McDonald’s of are expressed through this mock meal. According to Slashfood.com, PETA discontinued campaigns like the McCruelty one for the past nine years because it was working with McDonald’s behind the scene.

Lots, according to the RSPCA in New Zealand. The society has shut down a small rural town's yearly rabbit-lobbing competition after they got wind of it.
"Do you throw your dead grandmother around for a joke at her funeral?" asked animal cruelty inspector Charles Cadwallader.
