The Supreme Court has decided plenty of cases concerning cruelty, inhumane treatment and executions, but until now, none was about pigs.
The case of the "nonambulatory pigs" involves a dispute between California and the pork industry over how to handle pigs unwilling or unable to walk when they arrive at a slaughterhouse.
The issue, which the justices will take up next week, has already gotten the Obama administration in trouble with the Humane Society of the United States, which faulted government lawyers for joining the case on the side of the pork producers.
Under a 3-year-old California law, a slaughterhouse operator must immediately remove a "nonambulatory animal" from a herd and "humanely euthanize" it.
Federal law says animals that are lying down must be removed and inspected, but most need not be kept from the slaughterhouse.
"Sometimes the pigs are stressed or fatigued from the trip, or they're just stubborn. Usually, they recover, and if they're fine, they go into the food supply," said Minneapolis lawyer Steven Wells, who represents the National Meat Assn.
"We're not concerned about a pig who is taking a nap," said California Deputy Atty. Gen. Susan K. Smith in Los Angeles. "Our definition of a nonambulatory pig is one who is unable to stand and walk without assistance." She said the state's law, which is on hold pending the legal challenge, would protect the human food supply and prevent animal cruelty.
The lawyers concede there is no happy end for the pigs regardless of which side prevails. The pigs are either euthanized separately or sent into a slaughterhouse.
Wells, of the meat association, said there would be a "severe financial impact" on the pork industry if a typical slaughterhouse were forced to cull 200 to 300 pigs a day because they were lying down.
He is urging the high court to strike down the California law on the grounds that it is preempted, or trumped, by the federal law.
Under California's approach, the sick pigs "will be euthanized, but it ends their suffering," Smith said.
Though the case before the court is all about pigs, it began with shocking scenes of weak and wobbly cows being prodded, dragged and bulldozed into a slaughterhouse in San Bernardino County. A secret surveillance video showing the abuse was released by the Humane Society in January 2008.
The revelations triggered the largest meat recall in American history. They also prompted President Obama to issue an order in 2009 that forbids "downer" cows from being sent to slaughter. Because mad cow disease can be transmitted to humans in rare instances, all sick cattle must be kept from slaughterhouses, federal officials said. However, no such ban was imposed for pigs and other farm animals.
That disparity set the stage for the legal dispute over California's broader ban on downer animals at slaughterhouses.
The National Meat Assn. sued on behalf of the pork producers and argued that California did not have the authority to impose its rules on slaughterhouses. Their lawyers insisted the federal regulation was better because it required inspections of sick animals rather than automatically killing them. These inspections of live pigs are crucial for detecting swine diseases, such as foot-and-mouth disease, that can devastate a herd, they said.
A federal judge in Fresno agreed with the industry and barred the state from enforcing its law, ruling California lawmakers had overstepped their bounds.
"Hogwash," wrote Chief Judge Alex Kozinski of the 9th Circuit Court of Appeals in a 3-0 decision siding with California. He said states have always had the authority to say that certain animals, such as horses, may not be slaughtered for food.
Wayne Pacelle, president of the Humane Society of the United States, said the major pork producers "have a history of mistreating downer pigs, often while USDA inspectors are present." He cited reports of "conscious pigs being dragged from trailers" at a slaughterhouse in Los Angeles County.

They are pretty careful about who gets to put ads up in the Toronto subway system, and animal rights activists usually don't make the cut. But through September and October, subway riders have come face to face with a powerful campaign to convince people that if they like cute kittens and puppies, then they shouldn't be eating chickens and pigs. Kimberly Caroll, an organizer of the campaign says:
Pigs, cows and chickens are remarkable beings," says campaign spokesperson Kimberly Carroll. "Cows will walk for miles to reunite with a calf after being sold at auction. Pigs have intelligence beyond that of a 3 year-old human. Chickens mourn the loss of their loved ones. We hope that in connecting with these animals and the grievous suffering that is behind every burger, omelette, and hot dog, people will be motivated to make more compassionate food choices.
I was surprised that the campaign got approved at all; Kimberly explained:
We ran a similar campaign back in 2009 on the TTC at about a quarter of the size of the current one. At that point the ad had to go through various levels of approval while we waited on pins and needles, but it was approved! This time around, it seems there were no concerns. We've been very impressed with the TTC for this. We believe this is the first animal rights campaign to run on the TTC.
While the puppy and pig comparison is probably not a stretch for most people, the kitten and chicken one is probably a bit more difficult. But they make a case that chickens are "inquisitive, affectionate and personable."
It is not a new message, that animals are animals and it is crazy to treat one kind so differently from another; the British Vegetarian Society did it decades ago. But it is new, seeing it in Toronto plastered all over the subway, where the TTC says it will be seen by 5.7 million people every week. Kimberly says that it is effective; she is getting "several emails, posts, and twitters a day from folks saying they're going veg after seeing the ads."

Class-action complaint alleges an industry-wide scheme to raise the price of milk by killing over 500,000 cows

LOS ANGELES, Sep 27, 2011 (BUSINESS WIRE) --
Hagens Berman, on behalf of several dairy consumers, including Compassion Over Killing (COK) members, yesterday filed a class-action lawsuit on behalf of consumers alleging that various dairy companies and trade groups, including the National Milk Producers Federation, Dairy Farmers of America, Land O'Lakes, Inc. and Agri-Mark, Inc. combined to form Cooperatives Working Together (CWT) in order to fix the price of milk in the United States.
CWT is a massive trade group representing dairy producers throughout the country who produce nearly 70 percent of the milk consumed in the United States.
The lawsuit, filed in the United States District Court for the Northern District of California on Sept. 26, 2011, alleges that between 2003 and 2010, more than 500,000 cows were slaughtered under CWT's dairy herd retirement program in a concerted effort to reduce the supply of milk and inflate its price nationally. According to the complaint, the increased price allowed CWT members to earn more than $9 billion in additional revenue.
The plaintiffs in the case are represented by leading class-action law firm Hagens Berman Sobol Shapiro, LLP. The case was initially researched and developed by Compassion Over Killing, a national animal protection organization.
"We believe this case serves two important causes," said Steve Berman, managing partner of Hagens Berman. "A resolution to this case will protect consumers from artificially-inflated milk prices and also will prevent the unnecessary and shameful killing of tens of thousands of cows each year."
"The dairy industry has consistently shown its lack of regard for animal welfare and the environment," said Compassion Over Killing general counsel Cheryl Leahy. "Now it's milking its own consumers by unlawfully jacking up prices. The dairy industry must be held accountable for these illegal profits."
The complaint further alleges that the program, which paid smaller farm owners to kill their entire dairy cow herds, unfairly increased the profits of agribusiness giants.
Dairy herd retirement ended in the summer of 2010, but CWT's tactics may affect the price of milk for years, according to the lawsuit. The end of the program came shortly after Land O'Lakes agreed to pay $25 million to settle a class-action lawsuit filed against the United Egg Producers and its members. That case alleged that egg producers were encouraged to reduce their flock size as part of a program disguised as an animal welfare initiative.

A CALF is coldly shot in the head — at a dairy farm supplying milk to the chocolate industry.
The unwanted young bull had been taken from its mother and led to a trailer where other animals already lay dead.
A man believed to be a licensed slaughterman from a fox-hunting kennels killed it with a pistol.
The footage was secretly recorded by animal welfare activists who infiltrated 15 farms producing milk to be used in choc bars.
Members of campaign group Viva! said their film exposed the "bloody secrets" behind the sweets — while stressing that nothing they uncovered was illegal.
Viva! acted after figures revealed 100,000 male calves a year are deemed a surplus by-product on Britain's dairy farms because they cannot give birth or produce milk.
Some die at birth or go for pet food.

But others are shot like the one filmed at Harwood Gate Farm near Bristol, which displays a sign showing it supplies milk to chocolate giant Cadbury.
Viva! spokesman Justin Kerswell said: "I thought it was shocking. Customers might find it very disturbing."
Cadbury, which produces 250 million bars of its famous Dairy Milk each year, is owned by US food giant Kraft.
A spokesman said calves were normally sent to a dealer.
But the one which was filmed had a deformed leg so it was disposed of "humanely".
Kraft Foods said in a statement: "Consumers can be reassured we take animal welfare standards seriously.
"Creating a market for bull calves is a challenge for the dairy industry.

Cigarettes stubbed out on pigs’ faces; one animal punched in the head; another goaded in the face; regular blows and kicks; seriously injured pigs forced to drag themselves to slaughter… All these abuses in one UK slaughterhouse and Defra still won’t prosecute.
Today, Animal Aid has released footage shot secretly at Elmkirk Ltd (Cheale Meats), an Essex-based, family-run slaughterhouse that kills up to 6,000 pigs a week and whose website proclaims: ‘Be proud of higher welfare, buy British pork.’
The film – which was recorded on a number of secretly installed cameras over a period of four days – shows three different workers stubbing their cigarettes out on the faces of pigs, while one of the men landed a violent punch on the face of a pig who was walking by.
In addition, three seriously injured pigs were forced to crawl from the lairage, through the race and into the stun pen. Animal Aid’s cameras followed them as they were pushed, dragged by their ears and kicked along. Such treatment breaches the welfare laws multiple times.*
Animal Aid filmed many examples of incompetence. Pigs are stunned using electrified tongs, which should span their brains and render them immediately insensible. However, three of the four workers filmed stunning pigs showed a callous indifference to the suffering of the animals, many of whom were not stunned correctly. Some were subjected to painful electric shocks from the tongs, and fell to the ground screaming.
It is legal to use electric goads on the muscles of the hindquarters of pigs, but only for brief periods and only when there is space ahead of the animal in which to move. At Cheale Meats, the electric goad was used in the face of one pig and on the anus of another.
An additional worrying episode showed an apparently dead pig being dragged into the stun pen by a pole in her mouth. She was not stunned but she was shackled, hoisted and had her throat cut on the slaughter line. How this animal died, what she had been suffering from and where her meat ended up remain unknown.
Cheale Meats is the ninth UK slaughterhouse to be secretly filmed by Animal Aid in the past two-and-a-half years. The national campaign group has identified legal breaches in seven of the previous eight – some of them so serious that one slaughterhouse was forced to close down. Cases were built for the prosecution of nine men and four slaughterhouse operators before a change of government brought a change of heart, and all the cases were dropped. Defra, under the coalition government, said that, unlike its Labour predecessor, it could not proceed because the evidence was obtained without the permission of the slaughterhouses. Animal Aid believes that this is a politically motivated excuse and cites the recent Panorama programme, which secretly filmed care home workers without the permission of the owners, and whose film is being used to prosecute.
Animal Aid sent the Cheale Meats evidence to the Food Standards Agency (FSA). This is the body that supplies vets to slaughterhouses and investigates breaches of the welfare and hygiene law before passing the cases to Defra, which is the prosecuting body. The FSA replied on 14 June saying: ‘Defra is not prepared to commence prosecution proceedings where the initial allegation is based on CCTV footage gained without the consent of the relevant Food Business Operator.’
Kate Fowler, Head of Campaigns at Animal Aid says:
‘Since we first began investigating English slaughterhouses, we have been pressing everyone involved – regulators, industry bodies and the government – to act decisively to end the cruelty. At first, they appeared contrite and promised action but now their words ring hollow. If Defra won’t prosecute these flagrant breaches of the law; if the vets can’t or won’t act to stop the cruelties; and if the slaughterhouse owners look the other way, who is there to stop animals from being abused at the most vulnerable time of their lives? It seems that all involved are content to keep quiet and to allow these cruelties to continue. So much for the UK having the best welfare standards in the world!’

While the government has so far failed to take action to curb the cruelties, the supermarkets have responded to Animal Aid’s campaign for CCTV to be installed in the slaughterhouses that supply them. Ten major supermarkets Morrisons, Waitrose, the Co-op, Sainsbury’s, Aldi, Tesco, Lidl, Asda, Marks & Spencer and Iceland, along with wholesalers Booker, have now agreed to make CCTV mandatory.

5 Smart[ass] Answers to 5 Dumb[ass] Questions About Veganism

PART ONE...
This is the first installment of ’5 Smart[ass] Answers to 5 Dumb[ass] Questions About Veganism’, a Q&A written by me and my partner Joseph (vegan for 22 years!) in the hopes of offering some catharsis to vegans everywhere, as well as practical answers to those often loaded questions that can come out of nowhere and leave you unsure of what to say. And because the people asking them tend to either be genuinely curious or openly antagonistic, we’ve created separate responses for each. The ‘Smart’ answers are designed for the well-intentioned omnivore, while the ‘Smart-Ass‘ answers are reserved for the pseudo-curious interrogator who really only wants to get under your skin.
This will be a regular feature on my blog, and here’s the exciting part– YOU can send in any question/comment you want addressed. Got an uncle who likes hunting and insists on rubbing it in your face? How about a coworker who stares at your quinoa salad like you’re from a different planet? Question One: Where do you get your protein?
The Smart Answer: Lots of places! Whole grains, legumes, nuts, tofu, soy milk, hummus, falafels, veggie burgers, bean burritos, pad thai – just to name a few. It shouldn’t be that surprising to learn that plants offer up lots of protein; if they’re good enough for big, strong herbivores like gorillas, elephants and rhinos, why wouldn’t they be good enough for us?
The Smart-Ass Answer: Where do you get your nutritional propaganda? Kwashiorkor, also known as protein deficiency, is all but non-existent in the developed world; it’s unlikely you’ll ever meet anyone who has suffered from it, vegetarians and vegans included. The real issue at hand is where YOU get YOUR protein, as it’s most likely from the body of a sick, suffering animal raised for the sole purpose of selling cheap, unhealthy food.

Question Two: But I’ve been to family farms and seen animals that have a pretty good life. What’s wrong with that?
The Smart Answer: I don’t blame you for thinking that the farms you’ve seen are fair to the animals while reflecting an industry norm. After all, the animal foods industry spends tens of millions of dollars a year trying to convince you that modern animal farms are happy-go-lucky places where kind, old farmers attend to their animals’ every need. The sad reality is that 99% of the animals raised for food in this country are raised in factory farms, most confined their entire lives to tiny cages or stalls where the vast majority of their most basic needs (comfort, freedom of movement, foraging, socialization, access to fresh air and sunlight, and so on) are never met.
People want cheap animal products from healthy, happy animals, but few realize that the two are mutually exclusive. Over 10 billion animals are killed and eaten each year in North America; numbers like that simply cannot be sustained without treating animals like machines. That is why at the end of the day, it’s not really the meat or milk or eggs that need to be marketed, but the myth about how they were produced. This is why it is relatively common to be offered a free tour of a ‘friendly’ farm showcasing a handful of ‘happy’ animals, but completely impossible to get a tour of a factory farm. The industry doesn’t want you to know the truth, because the truth would bankrupt them.
The Smart-Ass Answer: People said the same thing about human slavery. That didn’t make it right, and the fact that some farmers are ‘nice’ enough to give their animals food and room to walk around doesn’t make their exploitation right, either. The bottom line is that in 99% of all cases, farmed animals are raised for the sole purpose of marketing their flesh, milk, eggs, skin or hair at a profit, and if anything gets in the way of that (vet bills, high quality food, spacious housing), it will always be the animals who suffer. That is why even on the most ‘humane’ farms, practices like castration, dehorning and tail-docking are performed without anaesthetic; unwanted baby males are discarded or butchered; unproductive (read: not productive enough) animals are sent to slaughter; and so on.
If it was really about the animals’ comfort and wellbeing, the animals we’ve selectively bred to maximize productivity (at the expense of their physical and emotional health) would cease to be bred (read: artificially inseminated), and those that remained would be allowed to live out the rest of their lives in peace at places like Farm Sanctuary. Anything less than this is exploitation and abuse in the name of profit, pure and simple.

Undercover Video of Abuse on Texas Cattle Ranch
On the heels of recently proposed legislation in Florida and Iowa that would make the filming or photographing of factory farm operations a crime, comes an undercover video made by Mercy for Animals (MFA) at a Texas cattle ranch.

Okay, I’ll admit it. I’m excited about the attention that Oprah’s Tuesday show is bringing to veganism, a lifestyle to which I’m passionately committed. And I’m equally excited to do my part to support anyone eager to consider making this life-affirming, health-affirming, planet-saving change! So here, in no particular order, are six things you need to know about veganism.

There are countless others. Do your own google search. Rather watch a film? Try: Death on a Factory Farm, Glass Walls, or Earthlings. Want to bypass the suffering and instead see cows, pigs, and chickens (and a host of other critters) for who they truly are? 2. You CAN treat your tastebuds! At least once a month for the last dozen years, my dad calls and asks, “Whatcha havin’ for dinner tonight? Sticks and leaves?” Folks: let’s dispel the myth that veggie cuisine is bland!! For general info and advice about nutrition, try the Vegetarian Resource Group, Savvy Vegetarian, VegSource, or The North American Vegetarian Society. To bypass the BS and get right down to cookin’, try these recipe databases: VegWeb, International Vegetarian Union, and VegFamily. Finally, check the Catskill Animal Sanctuary website, for regular updates from Chef Kevin Archer, director of Compassionate Cuisine. Far as we know, Catskill Animal Sanctuary is the only sanctuary in the world to offer a vegan cooking program. Join us, either onsite or via podcast, coming in February!
3. You can date without committing! Not sure you’re ready to strip the fridge bare? There’s nothing wrong with dating before you commit. Try choosing vegetarian restaurants to discover how varied and delicious veggie diets can be! Happy Cow is a database of vegan, vegetarian, and veg-friendly restaurants around the world. Just plug in your city or zip code and the distance radius you wish to search. If you’re a New Yorker, you’ll love SuperVegan’s “The Amazing Instant New York City Vegan Restaurant Finder“.
My advice? Choose the vegetarian and vegan restaurants rather those that have “vegan options.” You’ll find that restaurants truly committed to the lifestyle offer far more inventive, satisfying meals. Go ahead: tantalize your tastebuds!! Check out the menus from my favorite local restaurants: Garden Café in Woodstock, Luna 61 in Tivoli, and Karma Road in New Paltz.
4. A word of caution: Vegan does not equal healthy. There’s a lot of processed vegan CRAP out there filled with ingredients I can’t pronounce (and I ain’t stupid!). If you want to use this opportunity to take charge of your health, focus on simple, whole foods. Want some great advice? 5. A new, better you awaits! I may not know you, but I know this about you: you’re a good person who values kindness, and who likely works hard to ensure that your actions embody this highly-cherished value. Just for a moment, let in the uncomfortable notion that every time you eat an animal, you’re subjecting an innocent sentient being–an animal who, when you get right down to it, is very much like us in ways that count–to a level of suffering you wouldn’t wish upon a child molester or rapist. Acknowledge your role in the suffering, and when you choose to go vegan, celebrate your choice to honor not only the animals, but also, and most importantly, yourself, for in embracing veganism, you’ll be aligning your lifestyle with the values you prize most deeply. And that feels good.
6. It’s okay to stumble. Let’s face it: change is challenging! Even vegan poster girl Alicia Silverstone has stumbled a few times – and that ‘s OK!! As someone who took several years to go vegan, I know what the resistance is about: habit, convenience, concern about family members’ reactions, lack of knowledge about what else to cook. If you decide to take the plunge, or even just to dip your toe in the water, be prepared to encounter resistance, even if it’s just from, well, your own noggin. Be kind to yourself in your heroic effort to be kind to all beings and to the fragile planet we inhabit..

Bob Barker is perhaps best known as the host of the popular TV game show The Price is Right, which he turned into a forum for encouraging millions of Americans to help control the pet population by having their companion animals spayed or neutered. This many-time Emmy-award-winning television personality and much-beloved animal rights advocate has since been named an Honorary Fellow by the Oxford Centre for Animal Ethics for his groundbreaking contribution to the establishment of animal studies within academia.
By generously endowing America's top law schools, including Harvard, Stanford, UCLA, Northwestern, Duke, Georgetown, Columbia and the University of Virginia, and by endowing a chair in animal rights at Drury University (his own alma mater), Barker has pioneered the teaching of animal law in the United States. These endowments have enabled, for the first time, hundreds of university students to study animal law and ethics.
"We cannot change the world for animals without also changing people's ideas about animals. Almost single-handedly in little more than a decade, Bob's sagacity and generosity have propelled animal ethics from a marginal issue into the academic mainstream. This is a colossal achievement," says Professor Andrew Linzey of the Oxford Centre for Animal Ethics.
Earlier this year, Barker helped expose the routine abuses that calves raised for veal are forced to endure by narrating hidden-camera video footage secretly shot by an MFA investigator at one of the nation's top veal producers. Pleading for baby calves who are chained inside 2-feet wide wooden stalls - so narrow they cannot turn around, walk, run, play, socialize with other animals, or engage in other basic natural behaviors, Barker encouraged consumers to withdraw their support for this needless cruelty by boycotting both dairy and veal.
From the work that he has done to bring animal studies programs into universities across the country to consistently speaking up for the most defenseless among us, Bob Barker is a true hero for animals. While non-human animal sanctuaries play a very important role in providing homes for rescued nonhumans, it is unfortunate that very few, if any, hold a much needed strong abolitionist stance.
Most sanctuaries like Rikki’s Refuge in Orange, Virginia may open its doors to any species of non-human animals, but fail to recognize how critical vegan education is to preventing many of the animals from ending up at their door in the first place. Having met representatives of the organization at the Charlottesville Vegetarian Festival, I was encouraged to attend an open-house with promises of free food. I asked if the food was vegan. It was not. It’s quite curious how a sanctuary maintains goals of rescuing non-human animals while continuing to promote the consumption of those same non-humans.
More importantly, however, those sanctuaries which do attempt to adopt a vegan message often confuse the message terribly. United Poultry Concerns in Machipongo, Virginia and Woodstock Animal Sanctuary and Farm Sanctuary in New York are three influential sanctuaries falling short of a hardline abolitionist stance so necessary to promoting equal consideration of other species and abolishing non-human animal use.
These self-proclaimed vegan-based sanctuaries and others like them support single-issue campaigns which single out specific practices or industries which gives the illusion that these issues are more important than others. Most of these campaigns simply focus on issues which are already agreed upon by most to be unacceptable and fail to make any substantial challenge to public thinking. Furthermore, campaigns can sometimes contribute to preexisting racism, sexism, or xenophobia which is problematic for humans as well as non-humans. For example, the United Poultry Concerns runs a campaign against the use of chickens in the Jewish ritual of Kaporos. Why focus on an obscure Jewish practice when the vast majority of suffering is on the dinner menu of the average American?
These sanctuaries support legislation which generally does very little to advance non-human animals. For example, Woodstock Animal Sanctuary takes issue with tail-docking. Certainly, ending this practice means a tiny improvement for cows, but does little to challenge their use. Instead, a focus on ending a small percentage of the cruelty done to non-humans might have the effect of making the public feel better about the use by giving the impression that the important cruelties are being addressed by non-human animal groups and that use is itself not the issue.
Finally, these groups may claim to take a strict vegan approach, but they continue to promote vegetarianism. Vegetarianism, of course, addresses only a fraction of the non-human animal use we wish to abolish. On my visit to Farm Sanctuary, I was quite discouraged to see them selling vegetarian books, stickers, etc. in their store. They also operate a Veg for Life campaign which promotes vegetarianism alongside veganism. The rescued battery cage hens and dairy cows on their farm are a testament to the inadequacy of vegetarianism.
Finally, some, though not all, sanctuaries fail to seriously address the inadequacies of "humane," "free-range," or "organic" non-human animal production. Farm Sanctuary, with its heavy focus on combating factory-farming is an important contributor to the public confusion over "happy" exploitation.
The reality is that, as a movement, we have extremely limited resources. Every minute, every dollar spent on a confusing or counterproductive messages or methods is a minute and dollar taken away from important, clear vegan outreach. Gary Francione has written extensively on the practices of animal sanctuaries and other animal welfare organizations (See also Rain Without Thunder 1996). Terming the phenomenon “new welfarism,” he argues that these groups may promote veganism and state an aim of ending animal use, but their message and methods speak otherwise and are often counterproductive.
It’s a tricky thing to criticize a sanctuary which is often very underfunded and does in fact work diligently to provide homes to animals immediately in need. Adoption is a very important direct action. However, given the limited resources available to the animal movement at large, we should always be open to the possibility that what little we have is being squandered on mixed messages and counterproductive actions. What's more, many of these organizations fail to engage in the discourse. No movement is perfect and every movement sorely needs to be open to self-criticism if it ever hopes to improve and grow. Sanctuaries are at a unique advantage to promote a clear abolitionist vegan message. The Friendly Face of Torture, Death, and Animal Exploitation

If you question whether animal welfare reform is in the interests of industry, look no further than the October 21, 2010 article in the New York Times about controlled-atmosphere stunning of poultry, which, as I discussed in an essay here in 2008, is promoted by PETA and PETA award-winning slaughterhouse designer, Temple Grandin.
From the New York Times article:
“When you grab a chicken, turn it upside down and put it on the line, it’s stress, stress, stress,” said Scott Sechler, the owner of Bell & Evans. “Our system is designed so that we put them to sleep without stress and we kill them without stress.”
Anglia Autoflow, the company that is building the knock-out systems for the two processors, calls the process “controlled atmosphere stunning,” but Mr. Pitman [owner of Mary's Chickens] said his company was considering the phrase “sedation stunning” for use on its packages. Also on the short-list: “humanely slaughtered,” “humanely processed” or “humanely handled.”
The trick, he said, is to communicate the goal of the new system, which is to ensure that the birds “not have any extra pain or discomfort in the last few minutes of their lives.”
Mr. Sechler said the system was designed to put birds to sleep gently, in the same way that a person undergoes anesthesia before surgery.
To evoke that image, he wants to put the words “slow induction anesthesia” on his packages and advertising, which already tell customers that the birds are raised in roomy conditions with natural light and given feed free of antibiotics or animal byproducts. Customers who want to know more will be able to go to the company’s Web site.
Mr. Sechler said the system he chose, after years of research, was better than similar gas-stunning systems used in Europe. Those systems, he says, often deprive birds of oxygen too quickly, which may cause them to suffer. They are also designed to kill the birds rather than simply knock them out, something that Mr. Sechler is not comfortable with.
“I don’t want the public to say we gas our chickens,” he said.
And, of course, better treatment means better meat:
Mr. Sechler and others promoting the new system said that they expected the meat to be of higher quality because the birds faced less stress and also there would be less bruising and broken wings when they died.
PETA, which promotes the gassing of chickens, also maintains that gassing is in the economic interests of producers. In its Analysis of Controlled-Atmosphere Killing vs. Electric Immobilization from an Economic Standpoint, PETA argues for the gassing of poultry, claiming that the electric stunning method of slaughter “lowers product quality and yield” because birds suffer broken bones and the process results in contamination dangerous to human health. The electric stunning method also “increases labor costs” in various ways. PETA argues that gassing “increases product quality and yield” because broken bones, bruising, and hemorrhaging are supposedly eliminated, contamination is reduced, “shelf-life of meat” is increased, and “‘more tender breast meat’” is produced. PETA also claims that gassing “lowers labor costs” by reducing the need for certain inspections, reducing accidents, and lowering employee turnover. Gassing provides “other economic benefits” to the poultry industry by allowing producers to save money on energy costs, and by reducing by-product waste and the need to use water.
This sort of campaign is doing nothing but making the public feel better about animal exploitation. Indeed, the large animal welfare groups have become active partners in animal exploitation by helping industry to put a little smiling happy face on death, torture, and exploitation while, at the same time, helping industry to make animal exploitation more economically efficient and profitable. If you are questioning whether “happy” meat is, and is intended to, make the public feel better about animal exploitation, you are not paying attention.
This “happy” exploitation nonsense represents a very big step backward. People are never going to go vegan if they believe that they can exploit morally. And that is exactly the message that the “happy” exploitation movement is trying to convey: we can continue to exploit animals and treat ourselves to animal products as long as animals are treated “humanely.” As Peter Singer has stated:
[T]o avoid inflicting suffering on animals—not to mention the environmental costs of intensive animal production—we need to cut down drastically on the animal products we consume. But does that mean a vegan world? That’s one solution, but not necessarily the only one. If it is the infliction of suffering that we are concerned about, rather than killing, then I can also imagine a world in which people mostly eat plant foods, but occasionally treat themselves to the luxury of free range eggs, or possibly even meat from animals who live good lives under conditions natural for their species, and are then humanely killed on the farm. (The Vegan, Autumn 2006.)
The “happy” exploitation movement represents the promise of “compassionate” exploitation so that we may indulge in the “luxury” of animal exploitation.
That’s a “luxury” that animals cannot afford.
There is no such thing as “humane” exploitation and even if there were, it would still involve the unjustifiable killing of sentient nonhumans. Singer and his “happy” exploitation movement are not bothered by killing because they do not believe that animals have an interest in continuing to live, as I have discussed in other essays, including these: 1, 2, as well as in my new book, The Animal Rights Debate: Abolition or Regulation?, in which I debate the “happy” exploitation movement with Professor Robert Garner.
If you are opposed to animal exploitation; if you regard animals as members of the moral community; if you reject the notions that nonhumans are just things that exist as resources for humans, you have one choice: go vegan. It is easy, better for your health and the planet, and, most important, it is the right and just thing to do. It’s what we owe other animals. If you are not vegan, then you are participating directly in animal exploitation. You don’t get off the moral hook by eating gassed chicken.
If you are vegan, then educate others about veganism in creative, non-violent ways.

* Have a well-known vegan author or athlete come speak in your community. Host an event where a famous vegan offers an inspiring presentation. Have vegan treats for folks to try. IDA can help you contact the person.
* Send a friend or family member who lives far away a gift certificate to a restaurant in their own town. Visit Happy Cow for reviews of vegetarian restaurants around the country.
* Write a letter to the editor about the benefits of a vegan diet or the cruelties of factory farming, or ask your local newspaper to write a story on the subject.
* If you are religious, or participate in spiritual services or gatherings, look for opportunities to incorporate the vegan message into the discussions. If you participate in study groups, suggest discussion fo the vegan message.
* Visit a farmed animal sanctuary and take a friend who still eats meat. There are a number of farmed animal sanctuaries where you can visit rescued cows, pigs, turkeys, chickens, ducks, goats, sheep and rabbits live naturally in peace and harmony without fear of abuse or slaughter. Check out Animal Acres, Animal Place, Farm Sanctuary, Poplar Springs Animal Sanctuary, or IDA's Project Hope.
* Encourage a Compassionate Thanksgiving. Since Thanksgiving is coming up in a few weeks, talk to your community food banks about providing vegan options such as Tofurkys. Consider buying a few Tofurkys, preparing them, and bringing them to your food bank or other similar community dinner. Be sure to check out Gentle Thanksgiving which offers a lot of information and guidance on this special observance.

As Long as There are "Veal Calves," There Is No Such Thing as "Humane Treatment"
Costco Responds to Animal Cruelty Charge
The mega-popular chain store pledges humane treatment of veal calves

Following the release of video purportedly showing animal cruelty at a supplier's farm, Costco Wholesale vowed Wednesday to make sure the calves that produce the veal on its shelves are treated humanely.
``We're very disappointed not only in our vendor but ourselves,'' Jeff Lyons, Costco's senior vice president of fresh foods, said. ``We didn't know this was taking place.''
The video taken by the animal rights group, Mercy For Animals, at Ohio-based Buckeye Veal farm in April showed rows of narrow wooden stalls, each of which housed a calf chained by its neck to a low bar.
The calves were unable to turn around or even lie down comfortably. Some could be seen trying to pull free. Several were covered in feces.
Mercy for Animals' Nathan Runkle said today, ``Costco has, literally, taken a step forward on this important issue.''
``However, consumers should know that crate-free doesn't mean cruelty-free,'' he added. ``Ditching veal is the most compassionate choice shoppers can make to prevent animal abuse.''
Lyons said Costco has ordered its supplier -- Atlantic Veal and Lamb Inc. -- to trace all the veal that became part of Costco's inventory.
``(Atlantic Veal is) right now on notice to provide the lot identification so that we can identify the farms that have the proper handling
procedures,'' Lyons said.
``We will then audit those farms and make sure that is a true statement, and once that's done, we will continue to do business with them. But if they cannot provide that information, then we will delete the program.
``We're going by the obligations that we've made, the commitments we've made to that vendor, and we're doing our research.''
Gaylord Barkman of Buckeye Veal, said on Tuesday that the company has been in the process of switching from individual stalls to group housing, where the calves can roam and interact with other calves.
Buckeye Veal has 480 calves in individual shelves, 850 in group housing and 150 that will be moved to group housing in four weeks.
When asked whether Costco would accept calves from Buckeye Veal's group housing facility, Lyons said, ``If that manufacturer is doing something that we don't agree with but is acceptable by the Veal Association and the American Veterinary Association, that's not our business -- that's their business.
``If they were doing something illegal, that'd be different. But if everything is approved by other entities, then they can do whatever they like. We're not going to participate in that.''

1 million pounds of ground beef recalled
Consumers are being warned to check their freezers for recalled beef that may be contaminated with E. coli. The Modesto California-based meat processor Valley Meat Company is voluntarily recalling approximately one million pounds of ground beef. The beef may contain a rare strain of the bacterium E. coli O157:H7.
The Valley Meat Company says the ground beef patties and bulk products were produced between October 2nd, 2009 through January 12th, 2010 and were distributed to retail outlets and institutional foodservice providers in California, Texas, Oregon, Arizona and overseas. A list of retailers has not yet been released, but a complete list of products has been published on the company's website.
So far seven people are believed to have been sickened between February and June according to a USDA press release. Consumers are urged to throw away any of this beef, if they still have it in their freezers.
