Permanent Peoples' Tribunal accuses biotech giants Monsanto, Dow, Bayer, Syngenta, DuPont and BASF of promoting dangerous pesticides including endosulfan, paraquat and neonicotinoids
The world's major agrochemical companies, Monsanto, Dow, Bayer, Syngenta, DuPont and BASF, will face a public tribunal in early December accused of systematic human rights violations.
They are accused of violating more than 20 instruments of international human rights law through promoting reliance on the sale and use of dangerous and unsafe pesticides including endosulfan, paraquat and neonicotinoids.
The Permanent Peoples' Tribunal (PPT), an international opinion tribunal created in 1979, will hear expert testimony from scientists, medical doctors and lawyers to prove the charges. Victims who have been injured by these products - from farmers, farmworkers, mothers and consumers from around the world - will also testify to the causes and nature of their injuries.
The cases will be heard over a four-day trial in Bangalore, India beginning December 3. While the Tribunal has no legal weight, and cannot force sanctions on companies, it aims to expose and raise awareness of large-scale human rights violations.
Pesticides Action Network (PAN) International, a global network comprised of 600 organisations in 90 countries, has spent years collecting information to bring about the indictments and is seeking justice for more than 25 specific cases - such as Silvino Talavera, an 11-year-old from Paraguay who died days after breathing in a cloud of Monsanto's RoundUp herbicide sprayed by a crop duster. The trial will also hear evidence of the link between pesticide use and a decline in bees.
The corporations, known as the 'Big 6' control 74 per cent of the global pesticide market, as well as dominating the global seed market.
Bayer reject the allegations saying they are a 'wholesale distortion of the role of pesticides in our society.' Monsanto, Syngenta and Dow, after being contacted by the Ecologist, were unavailable for comment.
Pesticide poisonings
An estimated 355,000 people are believed to die each year from unintentional toxic chemical poisoning, according the World Health Organization, many of these from use or exposure to pesticides and other agrochemicals. Nick Mole from PAN UK said the trial would give a voice to the otherwise voiceless victims of pesticides.
‘The pesticide industry is massive and incredibly powerful. It is difficult to prove corporate manslaughter even when these products are killing hundreds of people a year,' he said. ‘We've spoken to people who have been abused and we are allowing them to give voice to their individual stories. We will be presenting the outcome of the Tribunal to the corporations and will be inviting their response,' he said.
It is hoped that the verdict, to be delivered on December 6, will lead to greater discussions at UN institutions on holding agrochemical corporations accountable for crimes relating to the impact of their products.

SOCIETY has gone 'properly wrong' in the way it produces and consumes food, according to Hans Herren.
Dr Herren, a renowned scientist and international development expert, is on a mission to promote what he insists is a better alternative to the current global 'industrial' food production system, which he describes as 'bankrupt'.
He is a leading advocate of agroecology, a holistic farming model based on organic principles, where food is produced by small family farms using green methods which nourish soils for future generations.
"We have tried to have more efficient farming, with fewer people, more machines and a greater dependency on pesticides, fertilisers, GM crops and energy, using 10 kilocalories to produce one kilocalorie. But that is only possible if there is cheap oil," said Dr Herren.
"The system basically is bankrupt, which is why we need to change it to a more modern, advanced system, which will create energy, rather than consume it, and is not dependent on fossil energy, but more on people and better science."
Dr Herren, originally from Switzerland, co-chaired the International Assessment of Agricultural Knowledge, Science and Technology, (IAASTD), a three-year project involving more than 400 experts from across the world.
Its 2008 report called for a radical overhaul of the way the world produces food to 'better serve the poor and hungry'. It demanded a shift away from the 'focus on production alone' and a greater emphasis on methods which conserve natural resources, backed up by trade and subsidy reforms and investment in science, education and training.
Report findings
Dr Herren described it as 'the mother of all reports on agriculture on a global and human scale', but admitted being disappointed about how little its findings had been implemented globally.
Dr Herren, who spent 27 years in Africa researching pest management and sustainable production, continues to promote agroecology through the US-based Millennium Institute, of which he has been president since 2005.
He said the key to future food security was not to use more inputs to produce more food per hectare, but to rely on techniques backed by 'solid science and agronomy - such as crop rotation with legumes and green manure, a cover crop grown to add nutrients to the soil - 'to enable the land to regenerate'.
But he also claimed it had been shown in experiments and in the field these farming methods can 'double, treble or even quadruple' yields in Africa.
He added: "Agroecology will produce food which is affordable because more people will be working, so they can actually afford it.
"We need to support small-scale and family farms, where more people get employed. We have 1.5 billion people who have no job. We really have to see all this in an inter-linked system."
He refuted the suggestion that, while agroecology may have merits in developing countries, where prevailing yields were relatively low and labour was abundant, it was unrealistic and idealistic to imagine it taking over in developed nations.
Instead, he insisted productivity levels could be maintained in developed countries if agroecology displaced intensive farming.
“It has been shown in the US that organic agriculture actually produces equally good yields as traditional agriculture,” he said. “But when there is drought or a flood, organic produces more as it is more resilient. There is no question we can deliver.”
The catch is that increased crop rotation would require a change in the way food is consumed. “You can’t disassociate consumption from production. In a rotation where you have more legumes someone has to eat those beans.”
He added people in urban-centric nations such as the UK and US would return to the land if agriculture became a ‘better and more rewarding job’ through greater investment, better prices for food and a reappraisal of farmers’ importance. “We need to look up to the farmer and down to the professor,” he said.
Lacking support
Dr Herren blamed the lack of wider support for this model of food security partly on what he claimed was a misconception of what it represented.
“We need to dispel this idea that agroecology is a back-breaking, low-yielding process and that we want to go back to grandfather’s agriculture. One of the experts set to testify at Wednesday’s long-awaited meeting about the county’s policy for genetically modified organisms (GMOs) on open space says scientists are seeing new, alarming patterns in plants and animals due to increased use of the herbicide Roundup.
Michael McNeill is an agronomist who owns Ag Advisory Ltd. in Algona, Iowa. He received his Ph.D. in quantitative genetics and plant pathology from Iowa State University in 1969 and has been a crop consultant since 1983. He was among three experts invited by county officials to testify at the Aug. 10 meeting of the Cropland Policy Advisory Group (CPAG).
CPAG, which has been meeting since February, serves as a sounding board for the county’s parks and open space staff as they develop a new cropland policy on matters like what may be grown on county land. The group has only touched briefly on the hot-button GMO issue in its past meetings; the Aug. 10 meeting was devoted entirely to the subject.
McNeill told Boulder Weekly before the meeting that he and his colleagues in the industry are seeing serious, negative effects produced by the use of glyphosate, which is the primary ingredient in Roundup weed killer. (Monsanto, the company that makes Roundup, has generated controversy by genetically altering crops to make them resistant to the herbicide.)
McNeill says that in the Midwest and other areas of the country, such as Louisiana and Mississippi, weeds like water hemp, giant ragweed, lamb’s quarter and velvet weed have become Roundup resistant through natural selection, due to a particular genetic mutation that survived the poison and therefore reproduced successfully and wildly.
The problem is, farmers’ natural reaction has been to simply apply more Roundup to their crops, which is having deleterious impacts, McNeill says.
“Used judiciously, it can be a useful product, but as with anything, if you abuse it, it can have negative effects,” he says.
McNeill explains that glyphosate is a chelating agent, which means it clamps onto molecules that are valuable to a plant, like iron, calcium, manganese and zinc.
“When you spray glyphosate on a plant, it’s like giving it AIDS,” he says.
The farmers’ increased use of Roundup is actually harming their crops, according to McNeill, because it is killing micronutrients in the soil that they need, a development that has been documented in several scientific papers by the nation’s leading experts in the field. For example, he says, harmful fungi and parasites like fusarium, phytopthora and pythium are on the rise as a result of the poison, while beneficial fungi and other organisms that help plants reduce minerals to a usable state are on the decline.
He explains that the overuse of glyphosate means that oxidizing agents are on the rise, creating oxides that plants can’t use, leading to lower yields and higher susceptibility to disease.
McNeill acknowledges that Monsanto could simply find a new chemical that kills the newly resistant weeds, but the weeds will simply find a way around it again.
“It’s mother nature’s plant breeding program,” he says. “It’s very widespread, and it’s a serious problem.”
McNeill says the situation is causing “sudden death syndrome” in soybeans, which means they are dying at increased rates when they go into their reproductive phase. He adds that corn is showing a higher incidence of Goss’s wilt, which has been a problem in Colorado since the early 1970s, and studies show that glyphosate causes a rise in both diseases.
And the problems are not limited to plants, it’s extending to the animals that eat them, according to McNeill.
He says he and his colleagues are seeing a higher incidence of infertility and early-term abortion in cattle and hogs that are fed on GMO crops. He adds that poultry fed on the suspect crops have been exhibiting reduced fertility rates.
McNeill, who works with universities, the federal government and private companies, says his advice to his farmer clients is to rotate chemicals — or don’t use them at all. While it is more labor-intensive, organic farmers usually cut their weeds as an alternative to herbicides. He says he consults for about 160,000 acres of conventional farmland and 5,000 to 6,000 acres of organically farmed land.
“My clients are my farmers, and I want what’s best for them,” he says. “And my clients are the consumers who consume the farmers products, and I want what’s best for them.”
McNeill compares the Roundup situation to the way science eventually caught up to another poison: Just as DDT was initially hailed as a miracle pesticide and later banned, researchers are beginning to discover serious problems with glyphosate.

As suburbs engulfed the rural landscape in the boom following World War II, many family farmers found themselves with new neighbors who were annoyed by the sound of crowing roosters, the smell of animal manure, or the rumble of farming equipment. In defense of family farming, Massachusetts passed the first "Right to Farm" law in 1979, to protect these farmers against their new suburban neighbors filing illegitimate nuisance lawsuits against them when, in fact, the farms were there first. Since then, every state has passed some kind of protection for family farms, which are pillars of our communities and the backbone of a sensible system of sustainable agriculture.
However, in the past few decades, intensive corporatization of farming has threatened both the future of family farming and the ability of neighbors to regulate the development of industrial agricultural operations that have transmogrified many farms into factories. Small-scale farms that resembled Old MacDonald's farm (with an oink oink here and a moo moo there) have increasingly disappeared or been turned into enormous livestock confinements with literal lagoons of liquified manure and urine, super-concentrated smells that could make a skunk faint, or vast fields of monoculture crops grown with a myriad of chemicals and pesticides and sometimes even sewage sludge. For example, the decade before the first right to farm law was passed, it took one million family farms to raise nearly 60 million pigs but by 2001, less than ten percent (80,000 farms) were growing the same number of pigs.
Capitalizing on the sentiment of protecting traditional farming, giant agribusiness interests have convinced some states to revise their Right to Farm laws to stealthily protect the most egregious of industrial farming practices from legitimate nuisance suits. The Center for Media & Democracy has recently exposed and analyzed a cache of bills voted on by corporations and politicians behind closed doors and then introduced in state legislatures without any notice to the public of the role of the American Legislative Exchange Council (ALEC) bill factory in the production of the legislation and no disclosure of the fact that corporations pre-voted on the bills, let alone disclosures of the names of those companies. In 1996, ALEC suddenly took an interest in expanding right to farm laws. ALEC's corporate backers, unsurprisingly, hale from the factory farm side of the equation.
ALEC's Corporate Backers
ALEC's corporate members and funders have included a number of agriculture interests, including Archer Daniels Midland (ADM), Cargill, and DuPont, as well as industry organizations like the National Pork Producers Council, the Illinois Corn Marketing Board, and the Illinois Soybean Association. Cargill is the nation's second largest beef processor, third largest turkey processor, and fourth largest pork processor. In three other areas, flour milling, soybean crushing, and production of animal feed, ADM joins Cargill as the biggest in the industry. Chemical giant DuPont is one of the world's largest makers of numerous pesticides, and in 1999, it purchased seed giant Pioneer Hi-Bred, the world's top seller of corn seeds, including genetically engineered seeds.
Unlike the corporations, the National Pork Producers Council (NPPC) is actually led by farmers ... and lobbyists for multinational pork processors, like Don Butler, past president of NPPC and lobbyist for Smithfield Foods, the largest pork processor in the world. The farmers who lead NPPC tend to own farms similar to that of NPPC president Doug Wolf. Wolf's farm produces 24,000 hogs per year - and it also has a beef feedlot and 1,200 acres of corn, soy, and alfalfa.
Perhaps the most surprising "agribusiness" donor to ALEC is the most powerful of all: Koch Industries. It turns out that an early part of the Koch empire was the Matador Cattle Company, founded in 1952. To this day, Koch Agriculture Company retains Matador Cattle Company, which has about 15,000 cattle. However, in the 1990's, Koch Beef Company was the nation's 10th largest cattle feeder, with feedlots that held up to 165,000 cattle. Koch bought a new feedlot in 1996 and, among other things, decided to expand its capacity by adding 20,000 more cows. The neighbors did not think that was a good idea:
Some businesses and farm owners expressed concerns over the health of their employees, some of whom would be housed within 300 feet of Koch's cattle pens. Other neighbors cited concerns over the potential for groundwater pollution, the amount of dirt, insects, and odors added to the area contributing to health problems, a decrease in the quality of life for nearby residents, and the possible devaluation of land.
Koch overcame their objections with the ruling of a friendly regulator in Texas, winning the right to expand. With all these corporate interests in limiting regulation of factory farming, thank goodness their pals at ALEC approved a model version of a Right to Farm bill in 1996!
Why Corporations Care About Laws For Farmers
While nearly all farms in the United States are technically "family farms" (a tiny fraction are owned directly by corporations), multinational agribusiness corporations have a major stake in how these farms are operated. Often family farms take the form of Wolf L & G Farms LLC, the farm owned by the family of Doug Wolf (mentioned above). Particularly for chickens and hogs, individual farmers often contract with meatpackers like Cargill, Smithfield, or Tyson. In contract farming arrangements, the corporations provide the animals, medications, and feed to the farmers; the farmer is responsible for the animals' housing, manure, and the bodies of animals that die prematurely. When the animals are fully grown, they are picked up by the corporation, which slaughters, processes, and markets the animal and plays the farmer for the weight the animal gained in his or her care. The farmers have most of the debt and risk and the corporation has most of the power and profit.

A new paper shows that consuming genetically modified (GM) corn or soybeans leads to significant organ disruptions in rats and mice, particularly in livers and kidneys. By reviewing data from 19 animal studies, Professor Gilles-Eric Séralini and others reveal that 9% of the measured parameters, including blood and urine biochemistry, organ weights, and microscopic analyses (histopathology), were significantly disrupted in the GM-fed animals. The kidneys of males fared the worst, with 43.5% of all the changes. The liver of females followed, with 30.8%. The report, published in Environmental Sciences Europe on March 1, 2011, confirms that “several convergent data appear to indicate liver and kidney problems as end points of GMO diet effects.” The authors point out that livers and kidneys “are the major reactive organs” in cases of chronic food toxicity.
“Other organs may be affected too, such as the heart and spleen, or blood cells,” stated the paper. In fact some of the animals fed genetically modified organisms had altered body weights in at least one gender, which is “a very good predictor of side effects in various organs.”
The GM soybean and corn varieties used in the feeding trials “constitute 83% of the commercialized GMOs” that are currently consumed by billions of people. While the findings may have serious ramifications for the human population, the authors demonstrate how a multitude of GMO-related health problems could easily pass undetected through the superficial and largely incompetent safety assessments that are used around the world.
Feed’em longer!
One of the most glaring faults in the current regulatory regime is the short duration of animals feeding studies. The industry limits trials to 90 days at most, with some less than a month. Only two studies reviewed in this new publication were over 90 days—both were non-industry research.
Short studies could easily miss many serious effects of GMOs. It is well established that some pesticides and drugs, for example, can create effects that are passed on through generations, only showing up decades later. IN the case of the drug DES (diethylstilbestrol), “induced female genital cancers among other problems in the second generation.” The authors urge regulators to require long-term multi-generational studies, to “provide evidence of carcinogenic, developmental, hormonal, neural, and reproductive potential dysfunctions, as it does for pesticides or drugs.”
“Pesticide Plants”
Nearly all GM crops are described as “pesticide plants.” They either tolerate doses of weed killer, such as Roundup, or produce an insecticide called Bt-toxin. In both cases, the added toxin—weedkiller or bug killer—is found inside the corn or soybeans we consume.
When regulators evaluate the toxic effects of pesticides, they typically require studies using three types of animals, with at least one feeding trial lasting 2 years or more. One third or more of the side effects produced by these toxins will show up only in the longer study—not the shorter ones. But for no good reason, regulators ignore the lessons learned from pesticides and waive the GM crops-containing-pesticides onto the market with a single species tested for just 90 days. The authors affirm that “it is impossible, within only 13 weeks, to conclude about the kind of pathology that could be induced by pesticide GMOs and whether it is a major pathology or a minor one. It is therefore necessary to prolong the tests.”
GMO approvals also ignore the new understanding that toxins don’t always follow a linear dose-response. Sometimes a smaller amount of toxins have greater impact than larger doses. Approvals also overlook the fact that mixtures can be far more dangerous than single chemicals acting alone. Roundup residues, for example, have been “shown to be toxic for human placental, embryonic, and umbilical cord cells,” whereas Roundup’s active ingredient glyphosate does not on its own provoke the same degree of damage. One reason for this is that the chemicals in Roundup “stabilize glyphosate and allow its penetration into cells.”
Furthermore, toxins may generate new substances (metabolites) “either in the GM plant or in the animals fed with it.” Current assessments completely ignore the potential danger from these new components in our diets, such as the “new metabolites” in GMOs engineered to withstand Roundup. The authors warn, “We consider this as a major oversight in the present regulations.”

As of today truly global action is being taken against patents on seed, plants, farm animals, parts thereof including gene sequences and food. Over 100 organisations from all parts of the world are alerting the public and warning of the dangers of increasing monopoly rights on basic resources of farm and food production. Seed, plants and farm animals as well as food production chains are becoming progressively subject to monopoly rights imposed by worldwide patents. More and more patents have been filed and now include claims covering the conventional breeding of plants and animals. They are actually being claimed by industry as their inventions!
If this trend is not stopped these developments will impact on farmers, smaller-scale breeders, food producers and consumers. Leaving the control over seeds to multinational corporations means leaving decisions on choice in the food market and the way food is produced to those whose first aim is to make a profit, not provide food security. Farmers in particular are increasingly dependent on agrochemical and seed corporations. Breeding is becoming more difficult as access to genetic resources is hampered by the restrictions that patents impose. This situation will result in fewer innovations urgently needed for food safety.
The US company Monsanto recently filed patent application WO2008021413, which – in more than 1000 pages - makes 175 claims to misappropriate various gene sequences and genetic variations, especially in soy and maize. Monsanto even goes as far as to explicitly claim all relevant maize and soy plants inheriting those genetic elements and its uses in food, feed and biomass. In a further patent application, WO 2009011847, Monsanto makes broad claims covering methods for cattle breeding, for the animals themselves as well as “milk, cheese, butter and meat”. These patents and many others filed by various companies such as Dupont and Syngenta are the reason why Navdanya is calling upon politicians and patent offices around the world to ensure that such patents cannot and will not be granted:
“A radical change both in patent legislation and the practice of patent offices is needed to eliminate patents on plants and farm animals. Corporations should not be allowed to continue misappropriation and monopolisation of seeds, plants and farm animals via patent law. Otherwise these patents will become a major threat to global food security and regional food sovereignty.”
Navdanya is calling upon organisations and individuals to sign the joint global alert posted on the website of the ‘no patents on seeds' coalition. Global days of action against patents on farm and food production are planned from the end of April until July 2010. They will end in a public hearing on 20 July at the European Patent Office in Munich, Germany. This hearing will be on e on a patent filed for the conventional breeding of broccoli which hat will lead to a precedent decision being made in Europe.
