Stand your ground defense may be used, crazy old coot claimed to be "afraid" before he murdered this dude without so much as a "get outta my yard"

man selling frozen lobster tails and steaks door to door Wednesday afternoon in Cape Coral was fatally shot by a homeowner before the gunman was ordered to the ground by an off-duty Collier County corrections deputy, according to Cape police and witnesses.
Officers arrested Kenneth Bailey Roop, 52, and charged him with second-degree murder in the death of Nicholas Rainey, 30, a meat salesman for Blue Ribbon Steak and Seafood. Cape police said the shooting occurred in front of Roop’s home at 1815 SW 30th Terrace.
Gene Snyder, a former volunteer firefighter who lives across a canal from the shooting scene, said he witnessed part of the incident. He said his wife heard two gunshots, so he rushed to the house to help.
What happened next, he said, was horrifying.
“I went to bend over to help the guy on the ground, the victim, and out of the garage I heard something: ‘I’ll kill everybody or shoot everybody,’ Snyder said. "And he cocked his gun and thank God for the Collier County sheriff’s (deputy), she probably saved my life and everybody else’s life that was in the area,” Snyder said.
He said the deputy pulled her service weapon on Roop and ordered him twice to place his gun on the ground before he complied.
Snyder said Roop appeared dirty and disheveled.
“When he came out of the garage, he looked totally deranged to me,” he said. “He looked like he was off the deep end.”
He said Roop told the off-duty deputy, as well as the Cape officer who arrested him, the shooting was justified.
“He was telling the officer, ‘he stepped on my property, he trespassed, I’ll kill anybody that steps on my property,’ somewhere along them lines. It was just unbelievable,” Snyder said.Stand your ground defense may be used, crazy old coot claimed to be "afraid"... more

In addition to the racial disparities imparted by the “stand your ground” laws, the law seems to be a form of legalized murder, which can be invoked for the smallest of reasons.
In Texas in 2010, Raul Rodriguez had an altercation with a neighbor who was purportedly playing loud music. By the end of that altercation, the neighbor was shot dead – over a noise complaint – and Rodriguez cowered behind that state’s version of “stand your ground.”

‘They got the goods on him. They need to prosecute whoever shot the kid,’ former GOP state lawmaker says
The Florida lawmakers who crafted the state's controversial "Stand Your Ground" law said neighborhood watch volunteer George Zimmerman should be arrested for shooting and killing unarmed teen Trayvon Martin.
Former state Sen. Durell Peaden and current state Rep. Dennis Baxley said the law they wrote in 2005, which allows someone who feels threatened to "meet force with force" without backing down first, was being misapplied in the shooting death of the 17-year-old, the Miami Herald reported.
"They got the goods on him. They need to prosecute whoever shot the kid," Peaden, a Republican, told the Herald. "He has no protection under my law."
