California legislature passes bill protecting farmers against Monsanto lawsuits

First State Bill Regarding Genetically Engineered Crops Awaits Governor's Signature

August 31 2008 - A landmark piece of legislation protecting California's farmers from crippling lawsuits was passed through both legislative houses this week in an end-of-session flurry. The Senate voted 23 - 14 to support it, and the Assembly was unanimous in their support. The bill, AB 541 (Huffman, D-Marin/Sonoma), is now headed to the Governor's desk for his signature. Sponsored by diverse organizations, some of whom are traditionally opposed on farm issues, AB 541 is the first bill passed by the California legislature that brings much-needed regulation to genetically engineered (GE) crops.

"I am very pleased that my office, working with the stakeholders on both sides of this historically divisive issue, was able to find common ground and pass California's first legislation on genetic engineered crops," stated Assemblymember Huffman. "While there is still work to be done on other aspects of genetic engineering, AB 541 is an important step in establishing basic protections for California's farmers."

AB 541 enacts protections against lawsuits brought against California farmers who have not been able to prevent the inevitable - the drift of GE pollen or seed onto their land and the subsequent contamination of their non-GE crops. Currently, farmers with crops that become contaminated by patented seeds or pollen have been the target of harassing lawsuits brought by biotech patent holders, particularly Monsanto. The bill also establishes a mandatory crop sampling protocol to prevent biotech companies that are investigating alleged violations from sampling crops without the explicit permission of farmers.

AB 541 has the support of organizations traditionally on opposite sides of the GE issue, and its sponsors are confident that the Governor will sign it. The bill was sponsored by a thirteen-member coalition including Community Alliance with Family Farmers, Earthbound Farm, California Certified Organic Farmers, United Natural Foods Inc., as well as California Farmers Union and the California Farm Bureau, and several others.

"AB 541 is a move in the right direction," stated Renata Brillinger, director of the Genetic Engineering Policy Project, the coalition of organic and conventional farmers, food industry, environmental, and faith organizations sponsoring AB 541. "It provides much needed protection for farmers who typically lack the resources to fight lawsuits brought by biotech conglomerates."

This is GOOD news! I hope other states use California as a model and work on bills that also give protection to farmers sued by Monsanto out of greed. Transgenic pollution and pollination is not the fault of the farmer, and Monsanto should not be allowed to indiscriminately sue farmers trying to make a living simply because they don't plant their frankenfood.

    • Commercialization of the farmlands has been a major downfall in our society. Sure the food may have been a little more expensive but at least it had quality. Just think of how many ecoli outbreaks we wouldnt have had if we had individually run farms with their own processing plants.

    • I waited a bit to type this but think I can now: over 200 views, over thirty responses, a very positive rating, and still this sits while everything that has come up the pike made it to tv for more to see... while this I suppose will be allowed to sit on the frontpage for a little longer to appease, and then fall as every other story about Monsanto does regardless of the fact of its importance. Granted many will see it here and for that I am appreciative, but again, cheeseburgers and political gossip are more important than this?

      And this is a good news story about groundbreaking legislation pertaining directly to our health and environment and our rights that you definitely won't see on MSM. I sometimes just don't get it here... but then, maybe I do. Monsanto is just not a subject to be allowed on Tv on Current due to corporate influence or the fact that it is an election year. Is that it? It certainly isn't "sockpuppets" now. Is it legal matters? Just what exactly? Just how good does the "algorhythm" on this article have to be? Just curious.

They are the world leaders in Genetically Engineered & Genetically Modified food sources upon which all humans subsist. As they go global with this strategy, they are truly one of the most dangerous companies in the world as they attempt to monopolize the very essence of survival - legal ownership of patented single use seeds to grow our food, and unbelievably, must be purchased from Monsanto every year in order to plant your next crop. BOYCOTT ALL MONSANTO PRODUCTS AT ALL COSTS!

      If you haven’t seen the documentary “The Future of Food” (or even "The Corporation") yet, I strongly urge you to do so. If I didn’t know that Monsanto’s goal of global food manipulation, distribution & ultimately complete crop control is perfectly legal, I would have thought this reaching the level of science fiction. However, this is one powerful & evil company that has Washington D.C.’s politicians, regulatory agencies & lobbyists in all their pockets.

      Don’t be fooled or misled, Monsanto is one of the biggest scum-sucking parasites ingratiating its way further into everyone’s daily life whether you are aware of it or not. Their logo should be the CEO with horns, a pointy tail & carrying a pitchfork in order to prod you into becoming a consumer of their products. Do not underestimate or do business with this company-you will only empower them to overpower us.

      Try to shop with as much awareness as possible, thinking about who ultimately gets your money, because it’s truly the only immediate defense we have until the right people are in the right positions to stop this evil empire. They will stop at nothing to keep any competitive products-usually organic & safe-off of store shelves in order to push their own toxic products on a society too busy to notice, in most cases, without the publicity of well meaning organizations & CURRENT’s contributors relentless search for the truth. Labeling is now becoming the next hurdle to conquer so that consumers will more easily be able to decide which products to purchase based on the ingredients & whether or not they’re organic.

    • This is so spun around. Monsanto have everyone brainwashed. Think about it. I mean really the organic non-GM farmers should be suing Monsanto for crop contamination. They don't need Frankenstein pollen knocking-up their pure and organic seed.

    • This is a step in the right direction. Since California does rely on producing agriculture, it makes sense to fight Monsanto, and protect our crops. What they try and pull off in regards to independent farmers is ridiculous.
      I was at the Slow Food Nation event this weekend in front of City Hall in SF,(09/31) and believe me a lot of us care about sustainability and smaller family farms throughout the state. We want to know from where and who we are getting our food from, and all that information was available and clearly written for each vendor. The whole event was refreshing and gives me great hope, it was a beautiful day, and I hope this awareness spreads and continues.
      I believe that best way to fight companies like Monsanto, is to spend your money supporting local organic practicing farmers, and urging friends and families to do the same. We need to cut into this evil corporations profits, maybe then they will listen and give the people what they really want, real natural food.
      I feel so blessed to be born and raised in this great state.

    • khromadjo: Yes, what they can't do here they will definitely do there. They are working hard in Africa to take over food markets, and unfortunately there are those in government there who are all too eager to believe their spiel due to the conditions they live in thinking their fake food will feed their people, when all it has wound up doing as we saw in India regarding BT cotton, is put farmers more in debt with no guarantee of higher yields.

    • What about protecting the loss of Heirloom seed stocks due to those pollens? Thousands of species are now forever changed due to these pollen drifts. Monsanto should be sued for destroing those strains grown by farmers and seedsmen for generations. It's a clear case of reckless contamination.

    • Thankyou, California legislature. And we can all write our own states if we are concerned about this and ask them if there is such a bill pending in our legislatures as well. We have to fight these companies that are taking over our food supply and using patents to only boost their profits over quality and health.This is such an important issue for our economy, our environment, our health, and our future. Hopefully, the next bill we see passed will be for a nationwide mandatory labelling of GM food sources on all food labels.
