Federal court upholds ban on Monsanto's genetically engineered alfalfa

We know you're just dying to taste that delectable genetically modified alfalfa, but you'll have to wait: an appeals court today ruled that the feds must review the potential environmental effects of the biotech seeds before farmers can plant them.

The decision by a three-judge panel of the U.S. 9th Circuit Court of Appeals forces the U.S. Department of Agriculture to issue an environmental impact statement on Roundup Ready alfalfa seeds, which are made by ag giant Monsanto and would be planted exclusively by Forage Genetics International.

"It’s a historic moment of a court requiring an environmental review, and until it's done Monsanto can't plant or sell its seed," said Kevin Golden, a staff attorney for the Center for Food Safety (CFS), which along with eight other parties sued the government green-lighting the seeds. "It puts on notice the government and creators of this technology -- Monsanto in particular -- that if it wants to bring GE (genetically engineered) crops into the American agricultural system, it must do its work to show that farmers and consumers will be protected and non-GE crops won't be affected."

The decision upholds an injunction issued by a district court judge last year. CFS and other critics worry that tiny genetically modified alfalfa seeds will contaminate organic and conventional crops through cross-pollination.

"The concern is there will one day not be organic alfalfa, which is the primary food for cattle in this country," Golden said. "If you lose organic alfalfa, you lose organic cheese."

Representatives from USDA, Monsanto and Forage Genetics International didn't immediately respond for comment.

Wow, first the passing of the bill in California protecting farmers from Monsanto's frivolous greed driven lawsuits regarding transgenic pollination, and now this. Is the tide turning? I sure hope so. And as this article mentions, since alfalfa is a main source of food for cows, their round about attempt to poison our cheese and milk as well by hoping this fake alfalfa cross pollinates in the wind to ruin organic crops cows eat needs to be banned. This is truly an evil company. I have no doubt they want their seeds to cross pollinate in order to ruin organic crops to mutate them to control the market even of those farmers who do not plant their seeds! And then they sue the farmers! Good to see them being held accountable. It is more than the USDA and FDA have done in the past. These people are relentless! How much is enough?

    • I'm still outraged that I can be sold genetically modified foods at the grocery store and that it doesn't have to be labeled as such. I don't want anything to do with it.

      Organic works just fine, thank-you-very-much.

    • It's always interesting to compare what presidential candidates consider to be most important to rural communities to what people who live here think. For instance, even though the campaigns have been going on for nearly two years, do we know what Obama and McCain think about seed?

      Yep, seed. We seen an increasing number of meetings, articles and protests about who owns seed. Seed prices have shot up $100 a bag this year at the same time the number of seed companies have declined. (There used to be 600 regional seed providers; now there are 150.) As the market consolidated, farmers have less choice. Less choice equals even higher prices.

      The Organization for Competitive Markets is sponsoring a day-long meeting on the seed industry at the 4H building at the Clay County, Iowa, fairgrounds in Spencer on September 11. There will be speakers and a complimentary dinner provided by Oak Tree Bar-B-Q. Go to the OCM site for more information.

      Even though there are some progress in the fight against Monsanto, there is still lots of troubles ahead for the farmers in dealing with this Corporation.

    • I don't think this is happening because there will be a change in government... the names change, that's about it, and both sides seem pretty well in the Monsanto camp. Has any candidate for president besides Cynthia McKinney even mentioned Monsanto? Dennis Kucinich has three bills out here but I have not seen anyone else move to support him on it publicly.

      And this is why Democrats don't come out in the numbers they would to vote... or at least, they don't come out in numbers they do to actually vote FOR the nominee: the Democratic Party in its zeal to always satisfy the DLC instead of the base, pick warmongers to run with them and people who actually vote for bills that support corporations like Monsanto. They play to the base of the other party instead of their own! We needed Dennis Kucinich as the VP candidate then if we were to expect any real work on this. The fact that Obama couldn't even consider Kucinich to energize the base of this party which would certainly have given me more hope, tells me that they would rather play it safe and risk losing than take a chance and win. Regarding Monsanto, we need more Deninis Kucinich's on our side, but I don't even know if any of his bills on GMOS will ever see the light of day... it can't even make TV here because people constantly try to stop it.

    • I know so little about GM foods that I feel a little silly posting about it. But anything with the name Monsanto on it (who I'm very familiar with because of their criminal activity) gives me bias.

    • This needs to become a rising swell of awareness to SAY NO TO GMO AND IRRADIATED FOODS. The organizations who sued need our fullest support and awareness. I would like info about sites ans petitions to support.

      Thanks for your interest, there are so many sites on the internet which cover this topic so well. I put an article http://www.westonaprice.org/federalupdate/aa2008/28jul08.html on Current site a month ago, it talks about how OCM (a farmers organization) is holding town hall meetings of sorts to "take back their farms". They truly need our support. There is so much mis-information out there.

      Hopefully we can support our farmers, and help educate our consumers that this new Frankenfood is not the way to go.

    • The tide is beginning to turn because of the possibility of a regime change in the US government.
      Of course, as more people write their congressmen and senators, that too will have an effect.
      When you buy produce at a store, ask the management if they have irradiated food, and also start asking where the produce comes from.
      I have surely recieved some blank looks when I have asked.
      It can be pretty comical!

    • Yes darkhorsejim, labeling our food so we can know what is GMO and what is GMO Free is imperative. Busy consumers don't have time to research each food item, nor should they have to do something so tedious. Not only that, in a perfect world we could actually trust our food supply and not have to be so scrupulous, but that is just too much to ask....sighing~

As they go global with this strategy, they are truly one of the most dangerous companies in the world as they attempt to monopolize the very essence of survival - legal ownership of patented single use seeds to grow our food, and unbelievably, must be purchased from Monsanto every year in order to plant your next crop. BOYCOTT ALL MONSANTO PRODUCTS AT ALL COSTS!

      If you haven’t seen the documentary “The Future of Food” (or even "The Corporation") yet, I strongly urge you to do so. If I didn’t know that Monsanto’s goal of global food manipulation, distribution & ultimately complete crop control is perfectly legal, I would have thought this reaching the level of science fiction. However, this is one powerful & evil company that has Washington D.C.’s politicians, regulatory agencies & lobbyists in all their pockets.

      Don’t be fooled or misled, Monsanto is one of the biggest scum-sucking parasites ingratiating its way further into everyone’s daily life whether you are aware of it or not. Their logo should be the CEO with horns, a pointy tail & carrying a pitchfork in order to prod you into becoming a consumer of their products. Do not underestimate or do business with this company-you will only empower them to overpower us.

      Try to shop with as much awareness as possible, thinking about who ultimately gets your money, because it’s truly the only immediate defense we have until the right people are in the right positions to stop this evil empire. They will stop at nothing to keep any competitive products-usually organic & safe-off of store shelves in order to push their own toxic products on a society too busy to notice, in most cases, without the publicity of well meaning organizations & CURRENT’s contributors relentless search for the truth. Labeling is now becoming the next hurdle to conquer so that consumers will more easily be able to decide which products to purchase based on the ingredients & whether or not they’re organic.

    • I believe that this is one of many upcoming examples of folks in positions to make significant differences getting to that magic point of "enough is enough" that we, the people, have been demanding.
      I've been seeing examples of this fighting back taking hold all over the US.
      The tide is turning.
      Monsanto is just one more monster organization that's getting it's butt seriously kicked by state judiciaries who can no longer stand what their federal counterparts have let GWB's administration and it's greedy lobby get away with for eight agonizing years.

      I will be very interested to watch this play out. I am in hope that with all of the information that has been churning in the last decade about Monsanto and the combined dirty deeds of FDA and USDA; that Monsanto will not be able to pull off their shady deals. I don't see how Monsanto can prove that their crops don't impact non-GE.

      Perhaps they saw this coming which was really why they divested from Posilac. ;-) I sure hope it is a trend that catches on. I wonder who they will pay off for the environmental report though? The EPA? Seems they already have the FDA and USDA in their pocket.

      I am wondering the same thing, environmental impact studies can get pretty messy, which we know always carries with it the danger of being hijacked by political interests

      I think that there seem to be lots of folks keeping an eye out on this today, many more watch groups, so maybe we can hope to see this information in the public eye, and that seems to be very important.

      Kind of like turning the lights on and seeing the roaches running for cover.
