Kids who photograph themselves naked are child pornographers and sex offenders

A fifteen year old girl in Newark, OH faces being labelled a "sex offender" for sending naked cellphone photos of herself (a minor) to other minors. If convicted, she'll spend the next ten years on public registries, classed as a producer of child pornography. No word on what compensation she (as the victim of the crime) will be able to get from herself (as the perp).

According to Ohio law, 2907.323(A)(3) states anyone possessing material that shows a minor in a state of nudity is guilty of a fifth-degree felony. The violation also might qualify the juvenile as a Tier I sexual offender, which requires annual registration for a decade.

The section of the law the girl, who is a foster child, was charged with allows parents or guardians to take photos of their unclothed children for a list of acceptable purposes but does not provide an exemption for the child themselves.

    • I don't see what everyone's problem is. She's a teenage girl for god sakes. Give all your heads a shake and look back to when you were all 15. Look what you have done. I had sex when i was 15 and I've been with that girl for 20 years now and we are happily married. It was completely common for girls 13, 14, 15, 16 to be married and having kids no more than 40 years ago. like my grandmother was 15 when she got married and she 7 children. So I guess she's a sex offender right? pfft. I don't think that a girl that young should have a conviction like that!, her life will be ruined. and for what being a human F**KING BEING! All you people that think that it's right for her or her parents lives to be ruined because she was doing what's in our nature. You need a reality check!. Who cares if she sent her bf a picture or 2. who hasn't!?. As long as their safe about it then WHO CARES!!! it's her life, she should be able to do what ever he wants. If it was to a 40 year old pedophile then this would be different. Just remember we were all born naked!     • I agree with powerhungry, now should have nude kids. I think parents who have babies should abort them if they aren't born fully clothed, because naked kids and babies are evil, vile and nasty. Of course you know teens only get naked to corrupt the moral fabric which tightly binds America. Its evil the way these nude lil buggers are are attacking the morally righteous and superior finger pointers. Why cant they focus on constructive things like stealing and murder and maybe war-mongering? Stupid kids, can't we just jail them all before they break the law?

      In regard to amdz541: Dude I'm 40 and when I was in school little girls were taking nude pics of themselves at school and sharing them with their friends and boys and that was before digital cameras an phones.

      My appologies for the sarcasm, but some need to get a grip.

    • We should thank the prosecutor for showing us the logical folly of a strict interpretation of our laws.

      Our laws that are forged out of a strict interpretation of the morals of the many. (Well, if not the many, then the loudest of our population)

      We hope that the judge will actually use his common sense in this case, because our laws are supposed to protect us (and this little girl) from abuse -- especially abuse BY the law.

      The prosecutor's position is political. Personally, I hope he takes his phoney morals and goes back to selling used cars.

      people act like the human body is something so vile and disgusting and yet everyone has one and is born OMG NAKED. this case is just further proof we need to reform sex education. also more evidence of the general failure of parents in guiding their children to make wise decisions. lets face it parents cant completely force their children to do everything right but cant you at least teach them the difference between right and wrong... thinking and taking pictures of yourself and sending them to everyone.

      she shouldnt be charged... she needs help in differentiating between good actions and stupid decisions.

    • i am a mother of a daughter i was also a teenage girl once and i like my daughter i have made mistakes that is part of growing up, this is up to the parents to deal with, i like the idea of grounding and no phone privileges also discuss repercussions of ones actions, i am not condoning what she has done but it wasn't a crime

    • Our children are constantly bombarded with nude and semi-nude images on Television and in the media so it's no wonder they are fascinated by their own bodies and those of the opposite sex. It's healthy. We were all born naked after all.

      Images of nude children have been depicted in art since before the camera and I'm pretty sure most parent have pictures of their kids running around a sprinkler or playing in the bath. Is this porn? I think not. It is innocence personified. It is only the sick mind that seeks sexual gratification in images of nudity. The human form in all stages of development is art in motion.

      The state has no right to destroy this young girls life over a picture of herself. If people don't like it - Don't look.

      The real sex offender here is the state.

    • WOW lets just twist this whole thing up why dont we. Ok she was trying to show off her body big deal. We pay money to go to the movie and watch people show off their bodies infront of millions. Get at me. She was trying to be a "grown up" tell her not to do it again take her phone for a week and drop the issue. I have an 11 year old sister and i would be very very upset if she were to pull something like this but lets take it as it is. MAKING A MISTAKE. What no one here has made one of those?

      And on the issue itself, I took amdz541's advice and searched "Self shot pics" sure enough, you have to go 12 pages down to find a a non-pornographic picture.

      When I was 15 the girls in my school sure as hell weren't taking nude photos of themselves and sharing them with boys.

      Social networking sites and an increasingly digital social world has lead to this. In just over 10 years with access to quick/dirty technology and a lack of education from parents it seems kids aren't being made aware of the dangers and ramifications involved in using this technology.

      I'm not here to comment on the legal system or what's right/wrong, I'm just saying I can't believe how many teens do this without thinking twice these days.

      A quick search for "self-shot pics" with reveal just how bad this issue really is. Sure all the sites claim they're 18 and legal, but come on.

    • I think that underage teens should be able to take naked pictures of themselves and even share them with underage teens if they want. It should only be a crime if that underage teen sends her/his naked pics to an adult or an adult has those pictures.

      I know that for some reason when people become parents they lose their fucking ability to reason about children, but how about thinking past the controversy for a moment and realize what's really going on here.

      This girl has been labeled a SEX OFFENDER for giving people pictures of HER OWN BODY.

      What business does the state have in this at all!? This should be the parents' jurisdiction, not the law's.

      Look at how fucked up this situation is, how is this girl going to get a job when she grows up?

      I mean, how bad to things have to get before you realize that pedophilia is a wedge issue the media and faux-Christians use to demonize sexuality? Don't forget where the real pedophiles come from.

      There's nothing wrong with a 15 year old expressing her sexuality.

      If you don't want your kids doing it, don't let 'em do it!

      But don't let the state call this girl a pedophile! This is getting fucking ridiculous!

      Freedom for a 15 year old girl to be sending around naked pictures of herself? Now...don't get me wrong I don't think she's a sex offender or a pornographer, that's just ridiculous. But I also don't think this is OK.

      At 15, she is a child, whether she's having sex or not. Research shows that her brain is still maturing at this age. That judgement and reasoning haven't fully developed. Impairing her ability to act responsibly.

    • A girl at my school took naked pictures of herself and sent it around. If people were caught with it on their phones they were arrested. But the Sheriff made an announcement that morning so that everyone deleted it. But in this case, its just being blown out of proportion a bit...
