What Is a Trust Deed ?
A deed of trust is the document used in Nevada to record the notice of the existence of the promissory note. The deed of trust is recorded with the county recorder as security to the lender for repayment of the loan. The borrower is the trustor, the lender is the beneficiary and the title insurance company is the trustee that oversees the transaction.
Who Is the Lender (the Beneficiary)?
A lender is usually a bank or other financial institution. However, an individual may also be a lender whose loan is secured by a trust deed. In a sense, the individual investor becomes the “banker” and is named as the beneficiary on the recorded trust deed.
What Is a Fractionalized Deed of Trust?
An individual may pair with one or more other investors to loan money on real property secured by a deed of trust. In that event each of the investors would be named according to their investment interest on the recorded document which would be called a fractionalized trust deed.
