U.S. Government Accidentally Abuses Internet "Kill Switch", Shuts off 84,000 Sites

Government believed the sites contained child pornography, but they did not


In evidence of the dangers of the U.S. government's increasing "kill switch" powers regarding web servers inside the U.S., the Department of Justice and Homeland Security’s ICE last week essentially shut down 84,000 sites in a case of mistaken identity.

The shutdowns targeted mooo.com, the most popular shared domain at free web service provider FreeDNS. FreeDNS is a free domain service that is immensely popular among file sharers, blogs, small businesses, and other independent operators. Its homepage is afraid.org.

With the mooo.com shutdown last Friday, the ICE accidentally shut down 84,000 subdomain pages. The pages were all redirected to a banner that stated "Advertisement, distribution, transportation, receipt, and possession of child pornography constitute federal crimes that carry penalties for first time offenders of up to 30 years in federal prison, a $250,000 fine, forfeiture and restitution."

The court order to shut down and redirect the sites was granted via a seizure warrant from a District Court. The warrant was executed as part of the DHS ICE team's "Operation Save Our Children".

The key problem is that none of the sites thus identified under the mooo.com superdomain had child porn on them. They appear to have been the victim of an overzealous government police force with a bit too much power on its hands.

FreeDNS has expressed outrage. In a statement, they comment, "Freedns.afraid.org has never allowed this type of abuse of its DNS service. We are working to get the issue sorted as quickly as possible."

Over the weekend they managed to begin restoring some of the pages. Meanwhile small business owners were left to try to reassure customers that they were note engaging in illegal activity [source example].

The DHS is actually bragging about the takedowns citing 10 child porn sites that were taken offline, but conveniently forgetting to mention the 84,000 legitimate sites it also killed. Secretary of Homeland Security Janet Napolitano states [press release]:

Each year, far too many children fall prey to sexual predators and all too often, these heinous acts are recorded in photos and on video and released on the Internet...DHS is committed to working with our law enforcement partners to shut down websites that promote child pornography to protect these children from further victimization.

The DHS has not yet released an official statement on the abuse of power. It also has yet to comment on whether it plans to compensate webpage owners for lost business or damage to their websites.

Website owners can still replicate the redirect by adding "74.81.170.110 mooo.com" to their hosts file.

    • This is starting to look a lot like The War on Drugs. a single court order that allows for the shut down of 80 thousand websites (that are not even involved with child pron) sounds like a huge abuse of power in the first place. Worst still they're going after the wrong people. Instead of focusing on the "perceived" end user why are they not going after the producers and the large scale deep web sites that hold the most child porn.

    • So, this has a very simple fix...

      When you shut down a website, provide an error message to say "Webpage not available" instead of "XXX Crime is punishable by YYYYY".

      Yeah, businesses still lose a little money, but at least nobody's good reputation is tarnished in the process.

      They should not shut down websites, period, unless they have done an investigation and proven it in court, with the website's owner/manager having the right to defend themselves.

      I cannot believe how many posters think it is okay to allow Obama the same rights that the Iranian government has in controlling, without due process or reason, the expression of free speech.

      There is no way Obama can win in 2012. The GOP voters would rather stick needles in their eyes than vote for him, I don't care how much he tries to tart himself up as a Born-Again Republican. Obama's alienated a large portion of his 2008 voters, and, judging by the 2010 turnout, created a lot of apathetic Democratic voters, as well.

      So, Obama--so desperate to be accepted by the Republicans one of them--is going to do the ultimate GOP thuggery...win an election using whatever means is necessary.

      How convenient for him he has kept open Gitmo.

    • Wouldn't you like your website "accidentally" shut down and the website's viewers/customers redirected to a government site that says it was shut down because of child pornography?

      WTF? I think, by the time Obama leaves office, we will look back on the days of GWBush/Cheney as the carefree days of freedom and liberty across the land (and internet).

      I bitched about GWBush for 10 years, and his administration starting in 2001 to present. Obama in his 2008 campaign promised us change, and listed a number of promises of the change he would bring. I voted for him, and contributed to the campaign.

      Well, the only change we've seen is Obama flipping on his promises, and actually doing WORSE in many areas than GWBush did.

    • How is this a fuck up? If a site that has child pornography also hosts DNS, then that is the consequence. This is the risk one takes if they register their domain on a free site. I register one of my domains on a free site and I fully accept the risk that it could all vanish overnight.

      This is not an example of the "Internet Kill Switch". This is the government cutting off child porn at the root which is fully acceptable and legal.

      Bullshit. We are talking about censorship of free speech by the government, that "accidentally" shut down 85,000 websites and fraudulently accused them of having child pornography.

      Shutting down ONE website under such circumstances is abhorrent and suspicious. Shutting down 85,000...it's either pure incompetence or pure fascism at the hands of the Obama administration.

      The article title is misleading. This is not the "kill switch" that is being discussed. Instead it is a misapplication of existing search and seizure laws. I feel that it is likely that the prosecutors that gained this court authorization did not fully understand what they were doing. I don't feel that excuses their actions, but it makes a lot more sense than sweeping conspiracy theories.

      It seems like there should be no ability of government to censor the internet, except by proving, site by site, following a public investigation and the ability of the accused to defend themselves, that there is something illegal going on.

      I agree with you. However, I think a reasonable definition for conspiracy includes an intent for wrongdoing. This story sounds a lot more like a bunch of morons not knowing what they're doing. I don't think that's a conspiracy.

      I also feel that a warrant issued by a court based on probable cause should be the only tool available for anyone to gain access or control of any information or website without the owner's consent. That's not the current state of affairs, and we should demand that our legislators enact laws to protect us from this kind of over reaching action.

      If only temporarily, though, because the resilience of a people grows in proportion of the perceived injustices exerted on them. See: Egypt.

      Who knows? it's just a theory. A conspiracy theory, you may add.

      But, as in the words of Ari Fleisher, who declared not long ago that "nowadays you have to be careful what you say and do" perhaps we should thread carefully in these times of ours, not with docile obedience, but perhaps with infallible research, intelligent dissent and righteous determination?

      And as for fucking pedophiles and anyone else who deals with child pornography in any way, shape or form, I say lock them up and throw away the key.

      Before the government shuts down any web site, they should be required to prove, in a public hearing, where the accused can defend themselves, that something illegal is going on.

      Obama is already clasping dearly the Bush/Cheney ability to lock up people, or send them to foreign prisons for torture, anybody he wants just by calling them a "terrorist."

      Who is the arbiter of what is "intelligent dissent"?

      Either we have freedom of speech, or we don't. When you allow our government to act like the Iranian government and censor what it wants based on made-up, nebulous reasons, we have taken another big step towards dictatorship.

      No. I said let’s combat social inequalities, however minimal, with intelligent argumentation, one that can stand any challenge and come out victorious because of its moral validity and its idealistic purpose.

      Did I say “Let’s demonstrate our indignation à la Tea Party style, with xenophobic rhetoric, insulting banners and crazed requests”?

      No. I said let’s raise our voices impulsed by moral indignation and determination, not fueled by deranged nationalism and dreams of dictatorial governance.

      We are a Nation that preaches solemnly -and even forces through bloodshed– democratic ideals on others, if only to protect its Economic Interests Abroad, but I say, let us stop preaching to others what we ourselves don’t practice in our own home ground, and let us instead demand from ourselves and from our government a strict adherence to the noble precepts as inscribed for posterity in our Constitution.

      Afraid provides dynamic DNS and Backup DNS services. You can Assign a domain you own or one of their free sub domains to a home server for instance.

      In australia we got the secret black list. You can't tell what's on it, cause it's secret! Lucky someone leak it. Many sites got put on it by accident. Whoops.

      Instead of wasting money on such measures the resources should go to the department that actually does track down child porn distributors.

      That does make more sense, which is probably way it's not such a high priority.
      Finding illegal porn on the internet is a real pain in the ass because everything digital can be translated into 0's and 1's then broken up into little pieces and hidden in seemingly innocuous pages. Even if you happen to find a piece there's really no way to find all the others and get enough for a conviction, or even to get an idea of what you've found.

      What I am doing is informing people on how the internet has helped criminals sell child pornography and snuff films. Most people think the only thing the internet did for porn is make it cheaper and more available. Even Vanguard left out that aspect of the porn/internet relationship, and they're some of the best investigative reporters I've ever seen (pure opinion of course).

      The article said it was a case of "mistaken identity" and an "accident". Who they are looking for, they had a seizure warrant for, which the article also said. Courts can not grant warrants without "probable cause". They found 10 pedophiles and their outlets, or kids taking pictures of themselves and posting, proving "probable cause" was, get this, warranted. The rest will be back online shortly.

      Whoever was working this case didnt know that. ? (I didn't) But someone could totally get himself a job if he proved his worth and were able to execute faster and cleaner than the 80,000 expendables like this time. They'll need all the help they can get, or start a business doing it, a nonprofit maybe. There's obviously a hole in ability, not direction, so there's work to be done = money.

      It goes deeper than that. If the agents and judges do not know these basics they should not be assigned to these cases. In fact they may have just given a free pass to the people who had the child porn.

      I could explain to a non computer person what happened because it's not complicated at all.
