I would not be surprised if the Koch brothers filed this suit and then paid this judge to dismiss it, just to give the impression that they don't always get their way.
Maybe I'm being a little synical, but this wasn't really a victory for Activism or a defeat for the Koch bros.
I'd save the high fives for a time when the Court Ruling or Legislation actually either helps the environment or hurts the Koch bottom line.
