Hospitals nearing a deal with White House

Three major hospital associations are nearing a deal with the White House and Senate Finance Chairman Max Baucus (D-Mont.) to provide more than $150 billion in savings to pay for a health care overhaul, three sources close to the process said Thursday.

There are still details to be resolved, but the negotiations have moved far enough along that the parties have discussed a Tuesday announcement. Yet some of the industry players involved are reluctant to announce a deal without President Barack Obama, who will be traveling abroad next week, according to one health industry source who spoke on the condition of anonymity to discuss private negotiations.

“It is not done, but they are close,” the source said.

An agreement with the hospital groups would boost Baucus’ effort to hold together an unwieldy coalition of industry, union and consumer groups working to pass a health care reform bill — rather than having some of the groups pouring money into campaigns against it.

Baucus and the White House reached a deal two weeks ago with the Pharmaceutical Research and Manufacturers Association to put $50 billion toward a reform bill and $30 billion to defray drug costs for senior citizens.

The Senate chairman has been pressuring hospitals and insurers to follow the lead of the pharmaceutical industry and step up with savings to help pay for the $1 trillion health care package. He has reminded the six major health groups, including the American Hospital Association, of their May pledge to find $2 trillion in savings over the next 10 years.

In a radio address last month, Obama proposed more than $200 billion in hospital payment cuts to help pay for his bill.

The groups involved in the talks include the American Hospital Association, Catholic Health Association, and the Federation of American Hospitals, which is led by Chip Kahn, who helped bury health care reform in 1993-94 with his “Harry and Louise” ads.

As part of the deal, the hospitals want to phase in Obama’s proposed payment cuts to hospitals that care for the uninsured and underinsured, and make them track closely with the ability to expand access to insurance.

The hospitals are also hoping to nix a proposal endorsed by Obama of taking the power to set Medicare rates away from lawmakers and giving it to a newly independent Medicare Payment Advisory Commission, which is now a legislative advisory board with no real powers.Three major hospital associations are nearing a deal with the White House and Senate Finance Chairman Max Baucus (D-Mont.) to... more

Are Airport Searches Going Too Far?

The Transportation Security Administration has moved beyond just checking for weapons and explosives. It’s now training airport screeners to spot anything suspicious, and then honoring them when searches lead to arrests for crimes like drug possession and credit-card fraud.

But two court cases in the past month question whether TSA searches—which the agency says have broadened to allow screeners to use more judgment—have been going too far.

A federal judge in June threw out seizure of three fake passports from a traveler, saying that TSA screeners violated his Fourth Amendment rights against unreasonable search and seizure. Congress authorizes TSA to search travelers for weapons and explosives; beyond that, the agency is overstepping its bounds, U.S. District Court Judge Algenon L. Marbley said.

“The extent of the search went beyond the permissible purpose of detecting weapons and explosives and was instead motivated by a desire to uncover contraband evidencing ordinary criminal wrongdoing,” Judge Marbley wrote.

In the second case, Steven Bierfeldt, treasurer for the Campaign for Liberty, a political organization launched from Ron Paul’s presidential run, was detained at the St. Louis airport because he was carrying $4,700 in a lock box from the sale of tickets, T-shirts, bumper stickers and campaign paraphernalia. TSA screeners quizzed him about the cash, his employment and the purpose of his trip to St. Louis, then summoned local police and threatened him with arrest because he responded to their questions with a question of his own: What were his rights and could TSA legally require him to answer?

Mr. Bierfeldt recorded the encounter on his iPhone and the American Civil Liberties Union filed suit in June against Homeland Security Secretary Janet Napolitano, claiming in part that Mr. Bierfeldt’s experience at the airport was not an anomaly.

“Whether as a matter of formal policy or widespread practice, TSA now operates on the belief that airport security screening provides a convenient opportunity to fish for evidence of criminal conduct far removed from the agency’s mandate of ensuring flight safety,” the ACLU said in its suit.The Transportation Security Administration has moved beyond just checking for weapons and explosives. Zelaya Plotting Return

Deposed Honduran President Manuel Zelaya said he’s plotting his return to the Central American nation and called for “strong” action from the U.S. to help restore him to power.

“Their words are strong,” Zelaya said today during an interview in the lobby of the Sheraton hotel in Panama. “We’re going to see now if their actions are strong.”

The military ousted Zelaya early on June 28 after he ignored a Supreme Court ruling that overturned his firing of the armed forces chief. Interim President Roberto Micheletti said he is open to talks with Zelaya, though the deposed president would still face charges of treason and abuse of power if he returned to the country.

Zelaya, 56, said that some in the military still support him. He declined to give details of his plans to return to Honduras this weekend, saying they must be kept secret from Micheletti and the military. He denied statements by the new government that he signed a resignation letter before he was forced to leave the country.

“If they had held me at gunpoint I wouldn’t have signed. I would have said: Look, shoot!” said Zelaya, who was wearing a brown jacket over a white shirt.

The secretary-general of the Organization of American States, Jose Miguel Insulza, will travel to Honduras tomorrow to meet with the new government and seek to restore Zelaya to office.

Insulza has been holding “intense conversations” with officials in Honduras and elsewhere, the OAS said in a statement.

A U.S. State Department spokesman warned that an early return to Honduras by Zelaya could be an obstacle to resolving the crisis.

The U.S. has suspended some aid to Honduras while it evaluates whether the removal of Zelaya meets the definition of a military coup under American law.

“We’ve taken some actions to hit the pause button on assistance programs which we would be legally required to terminate” if it is found to have been a military coup, State Department spokesman Ian Kelly told reporters today in Washington.
