    • Homophobic republican Sally Kern caught with loaded gun at Capitol

Sally Kern, the Oklahoma lawmaker who gained national notoriety with an antigay rant was stopped from entering the state capitol on Wednesday when she was found to have a loaded handgun in her handbag.

Guns and knives are prohibited in the capitol and it is a misdemeanor to bring a weapon inside. However, Kern was not charged because there did not seem to be any "malicious intent' behind her actions according to Chris West, a patrol spokeswoman. Kern said she forgot to take the .380 caliber semiautomatic handgun out of her purse after she stopped to talk to a colleague.

West also confirmed that there had been a second incident when Kern made it into the building with a gun in June. The first time, the weapon got through the security checkpoint, she said. ''I got all the way up to my office before I realized I had it, so I reported it,'' Kern said.

Kern complained earlier this year of receiving death threats after an audio clip was posted on YouTube in which she calls homosexuality a bigger threat to the U.S. than terrorism.

    • 3 shot at Phoenix community college; 2 critical

Officials say three people were shot Thursday afternoon at South Mountain Community College in Phoenix, and two of them were critically injured.

A witness said the shooter had been fighting with another man in a computer building. The gunman seemed to be directing his shots and not firing randomly, said student Yessenia Lara, 18.

"I saw someone get punched and then I heard three shots after that. Everybody basically ducked, and the shooter got away," Lara said, adding that the victims were yelling in pain.

A 25-year-old man and a 22-year-old woman were in critical condition, while a 17-year-old boy was in stable condition, said Mark Faulkner, a division chief for the Phoenix Fire Department. No other information on their injuries was available.

The victims were taken by firefighters to a county hospital, Faulkner said.

There was no information on the person responsible for the shooting, which happened around 4 p.m. MST.

An electronic sign outside the school said all classes were canceled Thursday and students could be seen leaving the campus calmly.

Television footage showed police clustered outside a building.

Situated at the base of Phoenix's South Mountain, the college has more than 8,000 students. Most students are seeking associate degrees and certificates of completion.

Officials reached at the college didn't immediately have any information on the shootings.

    • If I could rule the world, everyone would have a gun

BOB LEVY, the attorney and Cato Institute legal scholar who spearheaded the fight against the District of Columbia's handgun ban, is leading a roundtable at Cato Unbound on the implications of the Supreme Court's ruling in D.C v. Heller. While the decision has rightly been called historic, Mr Levy observes that it leaves many important questions unsettled: Will the courts "incorporate" the Second Amendment and apply it against state governments (as opposed to federal protectorates)? What degree of regulation short of an absolute ban is now permissible? And how will legislators adapt gun rules in the face of that uncertainty?

Dennis Henigan of the Brady Center chimes in with a condemnation of the majority's "judicial activism". And David Kopel dives into a textual analysis, drawing out the logical implications of the word "the" with an intensity not seen since Bertrand Russell's theory of definite descriptions. Merriment ensues.

    • Firefighter killed by gun shot on the scene

Ryan Hummert, 22, a firefighter in Maplewood, Missouri (suburb of St. Louis) was responding to a call about a pick up truck that was in flames. He arrived to the scene to help save lives and by a horrible twist of fate his life was taken. Not by the fire but by a gunman hiding in a house across the street. Two other policemen were then shot but only Ryan's shot was fatal. The gunman set the car on fire to lure firemen and cops there to shoot them and then set the house he was in on fire which is to believed to be his own. There is no known motive and it has not yet been determined whether the gunman killed himself in his burning house or ran away. This has been a horrible event for the St. Louis area and all those who knew and loved Ryan. Please keep his family and friends in mind and in prayers. • Only One Person Shows Up on First Day To Register a Gun in DC

In the first hours of the first day that it was legally possible to register handguns in the nation's capital, only one person showed up to do so--and he was turned away because he didn't bring his weapon with him.

Capitol Hill resident Dick A. Heller, whose lawsuit prompted the landmark Supreme Court ruling that scuttled the city's strict firearms control laws, arrived at D.C. police headquarters at 6:30 a.m., 30 minutes before the new gun registration process was scheduled to begin.

Heller, accompanied by his attorney, was met on the steps of the building by a cluster of camera crews and Lt. Jon Shelton, head of the firearms registration unit. In an animated discussion, police explained to Heller that he needed to show officials the guns he wanted to register -- and allow them to be test-fired -- as part of the registration process.

Heller's attorney, Dane von Breichenruchardt, said Heller owns at least two handguns -- a .45-caliber semiautomatic pistol and a 9-shot, .22-caliber revolver -- and has stored them for years with a friend in Maryland. Although officials said that gun owners in Heller's situation can bring legally owned firearms from other jurisdictions into the District in order to register them, the attorney said he had told Heller not to do so without written assurance that it was permissible.

    • Man Tries to Float Murder Weapon Away with Balloons

It looked like something out of "CSI: Crime Scene Investigation." And sure enough, it was.

State police said Wednesday that they solved a mysterious eastern New Mexico shooting death that was similar to a shooting depicted in a 2003 "CSI" episode. In both cases a revolver was found tied to balloons in an apparent effort to make the weapon float away.

Authorities determined that Thomas Hickman committed suicide after an investigation that included a detective renting a copy of the episode.

"We're not saying it's a copycat of the TV show," state police Lt. Rick Anglada said. "We have no way to know he actually saw the episode. However, the lead agent kept hearing from people that there was a similar case from 'CSI.'"

At first, investigators suspected homicide when Hickman, 55, of North Richland Hills, Texas, was found dead March 15 along U.S. 84 southeast of Santa Rosa, his mouth covered by duct tape.

Evidence soon directed them elsewhere. The clue that linked the case to the TV series: six or seven white balloons found entangled in a cholla cactus, some 30 feet from the body.

So the detective rented the show and took notes.

"There were similarities in the episode, where a character did tie helium balloons to a gun and hoped it would float away," Anglada said.

Medical investigators ruled the death a suicide, Anglada said, and additional evidence led detectives to conclude the scene had been intended to look like a homicide.

The handgun's grips had been removed and the trigger guard was sawed off, an apparent attempt to lighten the weapon. Anglada said investigators searched the garage of Hickman's home in Texas and found matching metal shavings.

Only a single spent shell casing remained in the chamber, Anglada said, and there was no evidence the 6-foot-6, 260-pound Hickman, a regional manager for Red Lobster restaurants, had resisted his death.

"There were no signs of a struggle, and he was a large man, not bound in any way," Anglada said.

Hickman was last seen two days before his body was found. Investigators believe he filled the balloons with helium, tied the balloon bouquet to the weapon, then duct-taped his own mouth and shot himself in the back of the head.

They also found he held a life insurance policy that would pay his wife $388,000 or double that amount if his death was accidental.

"Everything just pointed back to Thomas Hickman killing himself," Anglada said.

    • Pistol Cam: When Cops Draw This Point-and-Shoot, Say Cheese

If a cop points a gun at you, remember to smile. No, not to keep the officer from pulling the trigger (though it couldn't hurt), but because you might be on camera. In an effort to address public concerns about police accountability, the sheriff's department SWAT team in Orange County, New York, recently started packing the PistolCam, a cigarette-pack-sized combination videocam, flashlight, and laser targeter that attaches to the gun barrel's underside. "A lot of people in urban settings believe police officers are recklessly gunning people down," says Terry Gordon, a former prison guard whose New York firm, Legend Technologies, developed the $695 device. "This will be a cost-effective tool for liability protection." The gadget starts recording whenever the gun is drawn. It can store an hour of video with audio, which is encrypted to prevent tampering by cops under investigation. The whole system couldn't be simpler — just point and shoot. • Church cancels teen gun giveaway

An Oklahoma church canceled a controversial gun giveaway for teenagers at a weekend youth conference. Windsor Hills Baptist had planned to give away a semiautomatic assault rifle until one of the event's organizers was unable to attend. The church’s youth pastor, Bob Ross, said it’s a way of trying to encourage young people to attend the event. The church expected hundreds of teenagers from as far away as Canada.

“We have 21 hours of preaching and teaching throughout the week,” Ross said.

A video on the church Web site shows the shooting competition from last year’s conference. A gun giveaway was part of the event last year. This year, organizers included it in their marketing.

“I don’t want people thinking ‘My goodness, we’re putting a weapon in the hand of somebody that doesn’t respect it who are then going to go out and kill,'” said Ross. “That’s not at all what we’re trying to do.”

Ross said the conference isn’t all about guns, but rather about teens finding faith.

“You make a lot of new friends down here,” said Vikki Goncharenko, who attended the conference. “You get to meet new people. There's a bunch of things that are going on. It's just, you have a wonderful time.”

Friday evening, Ross said the gun giveaway had been canceled. Pastor emeritus Jim Vineyard, who ran the event, injured his foot and wouldn’t be able to attend. The gun giveaway was also removed from the church Web site.

Ross said the church would give the gun away next year instead. He said the church spent $800 buying the guns for the promotion.

Lou Dobbs reports on the story of a National Guard Drill Instructor who was convicted of illegally transferring a machine gun, a felony, when his perfectly legal AR-15 misfired. He had loaned the rifle to a student and the gun misfired while the student was shooting it at the gun range.

Earlier this year, the government tried and convicted David Olofson on the charge of transferring a machine gun. The Army veteran, Army reservist, husband and father of three contended that his gun was not a machine gun but simply a more than 20-year-old rifle that misfired. But instead of ordering him to repair the rifle, the government took Olofson to court.
