£17,000 damages for victim of fake Facebook profile
A business man won £17,000 in damages against a former schoolfriend who apparently put a fake profile of him on Facebook.
The profile falsely suggested Matthew Firsht was interested in same-sex relationships and was signed up with groups included Gay Jews in London. The profiles were on the site for 16 days until Firsht's brother spotted them and they were taken down by Facebook.
The judge awarded Firsht £15,000 for libel and £2,000 for breach of privacy. A business man won £17,000 in damages against a former schoolfriend who apparently put a fake profile of him on Facebook. ... more -
Kenya: Government Should End All Corporal Punishment
The government should make it a priority to end violence against children whether in the home, school or elsewhere, five human rights organizations said today in joint letters to Kenya’s ministers of education, gender and children affairs, and justice.
Even though officials in 2007 welcomed a UN study on violence against children, little has been done to implement the study’s recommendations.
“Corporal punishment must be abolished in all settings,” said the letter signed by Human Rights Watch, African Network for the Prevention and Protection against Child Abuse and Neglect (ANPPCAN), The Cradle, Kenya Alliance For Advancement of Rights of Children (KAARC), and Children Legal Action Network (CLAN). The organizations said a full ban on corporal punishment could be achieved “through amendments to the Children’s Act and the Education Act, which are currently being prepared for vote in parliament.”
The letter stressed that the new ministers will have a crucial function in protecting the rights of young Kenyans. The ministers were appointed as members of a coalition government in April 2008 following extensive political violence in Kenya.
Corporal punishment in schools continues, though physical abuse was outlawed in 2001, and a legal notice specifically prohibits corporal punishment in schools. In interviews carried out in 2007, pupils described to Human Rights Watch how some teachers cane children, while others resort to different forms of physical punishment; some children have suffered lasting injuries.
The letter also urges the new government ministers to provide training, raise awareness, and institute programs that better monitor teachers and others responsible for or working with children; and to ensure compliance with the ban on corporal punishment. It calls on the government to “take a lead in implementing the recommendations of the UN Study on Violence against Children, and for that purpose, set up a task force to develop and implement a national strategy or plan of action on ending violence against children.”
The UN Secretary-General’s Study on Violence against Children, presented to the UN General Assembly in October 2006, was welcome by the previous Kenyan government, which hosted a regional launch in 2007. However, Kenya has failed to take any meaningful steps to implement the study’s recommendations.

New York fight club earns YouTube fame
A violent street gang have started holding public fights in one of the busiest squares in New York, exchanging fierce blows in the hope of earning small change from tourists.
The “Union Square Spartans”, as they call themselves, are one of a number of real-life fight clubs that have sprung up since Chuck Palahniuk’s novel – about groups of men who fight to relieve the tedium of modern life - became a cult film in 1999.
Unlike the other clubs, who maintain their secrecy, the Spartans have begun uploading videos of their bare-knuckle bouts onto YouTube in the hope of drawing a bigger audience to their nightly fights.
The clips show pairs of combatants repeatedly punching and kicking each other until one is knocked to the floor.
They are urged on by raucous crowds of up to 300, who gather among the coffee houses and organic supermarkets that surround the busy Manhattan square.
The fighters, most of whom are homeless, have names like “Spider”, “Science” and “Legend”. They claim to have learned their trade in the city’s brutal underground fight clubs.
“Those places, they only stop the fight if the crowd stops cheering or begins leaving,” Legend, 23, recently told the New York magazine. “They don’t really care if you live or die.”
But their stylized Union Square bouts, which began last year, owe more to martial arts films than they do to the extreme violence of Palahniuk’s novel.
What started off as informal public sparring sessions are now semi-formalised contests, based on the rules of mixed-martial-arts, an increasingly popular fusion of boxing, wrestling, and various Asian disciplines.
Blows to the head are forbidden – mainly to avoid attracting the attention of police – and the aim is to improve your own fighting skills rather than humiliate or hurt your opponent. They took their name from the Hollywood film 300, about the Spartan warriors who fought to the death against the Persian army at the Battle of Thermopylae
Fights consist of three five-minute rounds, after which the fighters bow and embrace.
“We fight in public because we have nowhere else to fight,” Spider told the magazine.
“If the economy keeps going bad, we could be in a civil war in two years. We’re gonna need to know how to defend ourselves.”
More than 20 Union Square Spartans videos have been posted on the group’s YouTube channel, and they also have their own MySpace page.
They hoped the videos would attract people willing to pay for fighting lessons, but there have so far been no takers.

NY law to restrict violent video games
ALBANY, N.Y. - Gov. David Paterson signed a law Tuesday that he said will lead to restrictions on video game violence and help families better monitor grisly games.
The law will create an advisory council to study the effects of violent games on the children. It will also require parental controls on game consoles by 2010 and prominent displays of age ratings on game packages.
But critics say the bill is too vague and too watered down to accomplish its goal. And critics including the group Americans for Tax Reform contend that curbing video violence wasn't really the point in New York or nearly a dozen other states that enacted similar laws, only to see them struck down by courts as unconstitutional.
"It's moral preening," said Grover Norquist, president of Americans for Tax Reform. "The bill is unconstitutional and has been found that way in other states. And when the inevitable lawsuit comes, the state pays for everybody's legal expenses."
"The reason it is politically popular," he said, "Is the average citizen will read a headline that says, `State Legislature is against violence in children's video games.' They are unlikely to read a headline that says, `Legislature will waste $70,000 of your tax dollars.'"
"It also unfairly singles out the video game industry over all other forms of media," said Richard Taylor of the Entertainment Software Association. "If New York lawmakers feel it is the role of government to convene a government commission on game content, they could next turn to other content such as books, theater and film."
Violations of new labeling and parental control provisions in New York could result in $100 civil penalties. However, the parental controls and the voluntary ratings are already common in the industry.
Language making a felony of selling video games that are sexually explicit or contain depraved violence was lost during furious lobbying that derailed the bill in May 2007. That provision would have made the law among the strictest in the nation.
Then-Gov. Eliot Spitzer made a high priority of the issue in 2007 and it was the subject of several press conferences. The effort continued in the Legislature after Spitzer resigned in March after being disgraced in a prostitution investigation.
The new law was strongly supported in the Senate and Assembly this legislative election year.
The question was never whether to do something about video games that star automatic weapons and gore — that's been politically attractive for years, resulting in legislation in the other states besides New York. The question has always been how to do it without losing a constitutional challenge in the courts.
A prime sponsor, Republican Sen. Andrew Lanza of Staten Island, said the felony provision wouldn't have held up in court, but the remaining elements should stand and help limit access to the games. When the bill was passed this spring, Lanza said the criminal sanction sought by some is already addressed at least in part under pornography and other laws.
Most of the cities and states that have seen their regulations invalidated by courts tried to equate video violence with pornography and restricted the sale of the games to children. The courts have ruled the restrictions violated the U.S. Constitution's freedom of speech protections.
"New Yorkers do not need the state judging which video games are appropriate and which aren't," said New York Civil Liberties Union Executive Director Donna Lieberman. A woman riding her bike in Daytona Beach Monday night was hit by car driven by a man targeting African Americans, police said. Police believe Nekedia Cato, a 25-year-old African American woman, was hit by Thomas Cosby, of Port Orange. Police said Cosby, 56, slammed into Cato, took out a nearby porch, hit a tree and then rolled three times.
“He just hit me because I was black,” Cato said. Cato was riding her bike home from the store on South Atlantic Avenue. “I actually saw him coming toward me. I tried to move my bike as fast as I [could], but it wasn’t quick enough. He came straight for me,” Cato said.
Police reported that after Cosby crashed, he got out of his car, screaming racist remarks. Cosby repeatedly used the N-word and shouted he wanted to kill black people, authorities said.
“He was screaming out he had to kill all black people because one slept with his wife,” Cato said.
Cato recently moved to the Daytona Beach area with her boyfriend, D.
“If he could target me just because of the color of my skin, he could target anybody else,” Cato said.
Cato suffered several broken bones, a broken leg and other injuries. Her leg injury was so severe doctors inserted a metal rod into her leg. Cato could be hospitalized for weeks.
“I’m kind of scared walking down the street because I don’t know if people hate me,” Cato said.
Cato just started a new job, but could lose it due to prolonged time in the hospital.
“I don’t have hate in my heart, you know, I just don’t have hate in my heart,” Cato said.
Cosby is charged with aggravated battery and simple battery under the state’s hate crime laws. More severe penalties will follow if Cosby is convicted.
Florida’s hate crime laws went into effect in 1989, including crimes committed not only due to race, but due to religion, sexual orientation, mental or physical disability, or age if over 65 years old.

Drunken Spaniard admits to kicking Scottish grandfather to death
A Spaniard yesterday admitted beating and kicking to death a Scottish grandfather on holiday in the Canary Islands.
Hamed Mohamed Hamed, who comes from Melilla, the Spanish enclave on the north coast of Morocco, claimed he had been drunk and under the influence of drugs when he attacked Brian Hobbs, 52, of Cambuslang, South Lanarkshire.
He launched the attack at a bar in Fuerteventura only hours after he had arrived on the island in May 2006. Mr Hobbs had been drinking and was asleep at the time. The court heard Hamed had consumed 12 whiskies and taken cocaine before the attack and had claimed the killing would not have happened if he had not been drinking.
As Hamed admitted the crime, prosecutors accepted a plea deal and agreed to a 12-year jail term instead. Sentence will be passed in two weeks' time.
Mr Hobbs's widow, Barbara, was present in court. Mrs Hobbs had been unwell and her husband had nursed her for many months. He went on a short break without her and because of a fear of flying had been drinking heavily.
A statement read to the court at the beginning of the hearing emphasised that Mr Hobbs in no way provoked his attacker. The victim was asleep at a table when he was attacked "without any justification and without there being any argument or provocation", said the prosecutor's statement.
During the attack Mr Hobbs was punched and knocked to the ground where he was repeatedly kicked and beaten about the head.

Firefighter killed by gun shot on the scene
Ryan Hummert, 22, a firefighter in Maplewood, Missouri (suburb of St. Louis) was responding to a call about a pick up truck that was in flames. He arrived to the scene to help save lives and by a horrible twist of fate his life was taken. Not by the fire but by a gunman hiding in a house across the street. Two other policemen were then shot but only Ryan's shot was fatal. The gunman set the car on fire to lure firemen and cops there to shoot them and then set the house he was in on fire which is to believed to be his own. There is no known motive and it has not yet been determined whether the gunman killed himself in his burning house or ran away. This has been a horrible event for the St. Louis area and all those who knew and loved Ryan. Please keep his family and friends in mind and in prayers. Living in fear: Tanzania's albinos
Twenty-five people with albinism have been murdered in Tanzania since March, a BBC investigation has found. Albinos are targeted for body parts that are used in witchcraft, and killings continue despite government efforts to stamp out the grisly practice, the BBC's Karen Allen says. Once, albinos used to seek shelter from the sun. Now they have gone into hiding simply to survive, after a series of killings linked to witchcraft. In Tanzania, 25 albinos have been killed in the past year. The latest victim was a seven-month-old baby. He was mutilated on the orders of a witchdoctor peddling the belief that potions made from an albino's legs, hair, hands, and blood can make a person rich.
Sorcery and the occult maintain a strong foothold in this part of the world, especially in the remote rural areas around the fishing and mining regions of Mwanza, on the shores of Lake Victoria. Nobody seems to know why the killings are happening now, but Tanzanian President Jakaya Kikwete is now putting pressure on the police to identify where albinos live and offer them protection. This is not an easy task when BBC investigations suggest that some police are being "bought off" in order to look away when such appalling crimes are committed.

Missouri Man Ambushes Authorities; Kills Paramedic
Ryan Hummert, 22, was shot as he got out of a fire truck on Zephyr near Big Bend Blvd. According to officials, Hummert and his fellow firefighters were responding to a vehicle fire. When they arrived on scene, someone began firing shots at them. Hummert was hit.
Firefighters were pinned behind their fire truck for several hours. The gunman also shot two police officers who responded to the scene. One of those officers was treated and released. Hummert was pronounced dead at an area hospital.

SECOND GUANTANAMO
KABUL:: The US plans to build a vast 'second Guantanamo' were condemned yesterday. Human rights lawyers said they will attack America's use of its main Afghan base in Bagram as a legal black hole, as a place "where no laws apply".
Rights lawyers also accused Washington of targeting journalists to cover up its practices in Afghanistan and Iraq. "I think it is very clear that the reason the US chose to build it inside the base is that they did not like the independent decisions that would have come out of the Afghan judiciary," said lawyer Barbara J Olshansky.
The Pentagon has announced plans for a 40-acre, $60 million (BD22.6m) detention centre at the base.
The new center is intended to accommodate up to 1,100 prisoners.
The Bagram base, where 625 people are held without charges in wire mesh cages, has a notorious reputation of torture of humiliation of detainees.
Last month, the Afghan Human Rights Organisation said 10 children, aged 9-13, were being held there.
Hundreds of prisoners have also passed through Bagram on their way to Guantanamo Bay since the 2001 US invasion of Afghanistan.

Young people fear 'street life'
According to a new research study, which was conducted by Media Research, 20% of men under 24 have been threatened with some type of weapon and 47% of those questioned know someone who has been threatened.
11% had apparently been asked to become part of a gang with 15% feeling pressure to carry a weapon with almost double that knowing someone who carried a weapon.
"More than half felt the UK was less safe than a year ago and 78% said they did not feel safe walking the streets."

Study finds genetic link to violence, delinquency
Genes may play an important role in determining why some young men raised in rough neighborhoods or deprived families become violent criminals while others do not, accordidng to the August issue of the American Sociological Review as quoted by media Tuesday.
One gene called MAOA that plays an especially strong role has been shown in other studies to affect antisocial behavior -- and it is disturbingly common, according to the team at the University of North Carolina.
People with a particular variation of the MAOA gene called 2R were very prone to criminal and delinquent behavior, said sociology professor Guang Guo, who led the study.
"I don't want to say it is a crime gene, but 1 percent of people have it and scored very high in violence and delinquency," Guo said in a telephone interview with media.
Guo's team found specific variations in three genes -- the monoamine oxidase A (MAOA) gene, the dopamine transporter 1(DAT1) gene and the dopamine D2 receptor (DRD2) gene -- were associated with bad behavior.
Guo's team, which studied only boys, used data from the National Longitudinal Study of Adolescent Health, a nationally representative sample of about 20,000 adolescents in grades 7 to 12. The young men in the study were interviewed in person regularly, and some gave blood samples.
His team constructed a "serious delinquency scale" based on some of the questions the youngsters answered.
"Nonviolent delinquency includes stealing amounts larger or smaller than 50 U.S. dollars, breaking and entering, and selling drugs," it wrote in the Review.
"Violent delinquency includes serious physical fighting that resulted in injuries needing medical treatment, use of weapons to get something from someone, involvement in physical fighting between groups, shooting or stabbing someone,deliberately damaging property, and pulling a knife or gun on someone." Spain rocked by bomb blasts
Three bombs have exploded in Spain, with at least two believed to have been planted by Basque separatist group ETA. No injuries were reported following the blasts in the north of the country. One bomb exploded outside a bank in Getxo, damaging a cash dispenser and breaking windows. Officials said the homemade device packed into a gasoline tin went off without warning at about 5am. Five hours later, an anonymous caller said ETA had planted four bombs on beaches in Laredo, Ris and Noja as well as at a golf course close to Noja. Police cordoned off the towns and a device exploded near Laredo's beach at around 12:15 pm. It went off on the seafront promenade in the Cantabrian resort. Later in the day a second bomb exploded in Lardeo. The most recent attack by the armed Basque separatist group happened on July 4. The organisation, which is fighting for independence in the Basque region, carried out a bomb attack against a telecommunications centre. Police taser naked man 3 times
Officers were dispatched to the area of 28th Street and Iris Avenue at about 10:30 p.m. Wednesday on a report of a nude man who was rolling around in the street. When they arrived, they found Christopher Dornfield crawling on a nearby patch of grass, police said.
When Dornfield refused to comply with officers’ orders to hold still, he was shot with a Taser. He was shocked twice more after he tried to get back on his feet and advanced toward officers, police said.
The incident began Wednesday when Dornfield split a hit of acid with one of his friends, 22-year-old Boulder resident Brian Skutch, and went “out of control,” another one of his friends told police.
According to the report, Dornfield’s friends tried to calm him down by taking him for a drive after he became agitated. When Dornfield jumped out of the car and took off his shoes and pants, his friends wrestled him back inside.
A short while later, according to police, Dornfield hit Jacob Ottenstein, his roommate, in the face. At that point, the group decided to call police and kick Dornfield back out of the car, leaving him alone at about 28th Street and Iris Avenue.
They must have good acid in Colorado.

Mob Attacks Police Over Litter
I wish the citizens of the world would take notes from this girl. You can fight back. She just chose to fight over trash instead of say, impending removal of all human liberty.
One officer was dragged to the ground and kicked while the other was bitten by a girl who jumped on his back.
Up to 30 people took part in the attack, which happened in North End, Croydon, on Wednesday afternoon.
Trouble flared when the 15-year-old threw her food wrapper back on to the ground and became aggressive. The two officers are currently on sick leave.
One eyewitness said he saw two police officers struggling with a girl before a group of youths joined in and began pushing and shoving the officers.
"The police - there were only two of them - they were really outnumbered and all these yobs were just pushing them out of the way.
"I didn't see any punch being thrown but it was disgusting the way they treated the police."

Homophobes strike again near Fort Lauderdale
The beleaguered gay community of greater Fort Lauderdale has been put through another homophobic incident.
After numerous physical attacks against LGBT people -- including the murder of teenager Simmie Williams Jr. in February -- and verbal attacks from Fort Lauderdale's antigay mayor Jim Naugle, three south Florida homes were vandalized by homophobes early Friday, the Miami Herald reports. The attack occurred in Wilton Manors, a suburb of Fort Lauderdale with a large gay population.
Graffiti was scrawled on cars and homes, though one of the homes hit was not owned by anyone gay.
Victim Ron Helfrich seemed to take the attack in stride, telling the Herald, "Maybe I'll just write an 'I love' on top of the word gay and add an 's' to the end."
