    • Law professor: Don't expect Obama to prosecute crimes of the Bush Administration

      "Presidencies are about looking forward, not backwards, so it was predictable that Barack Obama would signal that, if elected, he would have little interest in prosecuting the criminal acts of the current administration.

      As predictable as Obama’s position is — John Kerry would likely have held the same view under similar circumstances, and certainly John McCain supports it — it is deeply troubling because of the seriousness of the crimes in question, which include lying to Congress about the rationale for war, authorizing torture, betraying a covert CIA agent, criminal negligence in the response to Hurricane Katrina, spying on Americans without warrants, using the Justice Department as the political enforcement arm of the Republican National Committee, election fraud and consorting with corrupt lobbyists, just for starters.

      At the Netroots Nation meeting in Austin last weekend, Chicago Law School professor Cass Sunstein, an informal adviser to Obama, warned liberal activists not to expect Barack Obama, if he is elected, to prosecute Bush crimes unless the crimes are what Sunstein described as “egregious”:

      As quoted by Professor Sunstein:

      "Sunstein urged caution in prosecuting criminal conduct from the current administration, while also noting that egregious crimes should not be ignored. Prosecuting government officials risks a “cycle” of criminalizing public service, he argued, and Democrats should avoid replicating retributive efforts like the impeachment of President Clinton — or even the “slight appearance” of it."

      Note: Cass Sunstein was against the impeachment of Bill Clinton.

      "The fatal flaw in Sunstein’s formulation is that, in fact, there has not been a “cycle of criminalizing public service.” There has been one system of high accountability for Democrats and another system that allows Republican White House officials to escape any sort of accountability whatsoever."

      "Another weakness in Sunstein’s statement, says Jonathan Turley, a George Washington University law professor, who testified for the prosecution in the Clinton impeachment, and who still insists impeaching Clinton was the right thing to do, is that all crimes committed by presidents should be considered to be “egregious” because presidents take an oath to defend and uphold the laws of the United States."

      As a constitutional scholar, Barack Obama knows better than most that the critical issue here is not political retribution, it is justice — primarily because punishing government officials who commit crimes is one instance in which deterrence may actually work.

      In an interview Tuesday night with Katie Couric, Senator John McCain scolded Senator Barack Obama for getting his history wrong. But it appears that Mr. McCain might himself have inaccurately described the timing of a scene-changing development in Iraq.

      Mr. McCain has been critical of Mr. Obama for refusing to acknowledge that the troop buildup had stabilized conditions in Iraq. Rather, Mr. Obama credited the “awakening,” a movement of Sunni Iraqis patrolling their own neighborhoods to root out extremists and members of Al Qaeda in Mesopotamia. The initiative, backed by the United States, began in Ramadi, the capital of Anbar province, and has since spread throughout the country, including Baghdad.

      Decision comes just months after centuries-old monarchy was abolished

      Nepal's governing assembly on Monday elected the new republic's first president since it abolished the centuries-old monarchy in May, state-run television said.

      Nepal Television said Constituent Assembly members elected Ram Baran Yadav, a physician from the Madheshi ethnic community in southern Nepal, which has been campaigning for greater rights and more say in the administration.

      State-run television said an official announcement was expected later in the evening by assembly chairman Kul Bahadur Gurung. Yadav, of the Nepali Congress party, received more than half the votes in the 594-seat assembly that was required to win.

      Yadav had the backing of his party, the Communist Party of Nepal (United Marxist-Leninist) and Madhesi People's Rights Forum — the second, third and fourth largest parties.

      Yadav has served twice as the health ministry and elected twice in parliament elections. He has held senior positions in his Nepali Congress party.

      Yadav had secured the most votes in initial voting for president on Saturday, but voting went to a second round because none of the three candidates were able to secure the required majority.

      His closest opponent, Ramraja Singh, was backed by the Communist Party of Nepal (Maoist), former communist rebels who have emerged as the largest political party in Nepal.

      The Maoists won the most seats in the Constituent Assembly in April elections. Since the dissolution of the monarchy, the assembly has been unable to form a new government because the main parties have bickered over forming a ruling coalition.

    • McCain owns first foreign policy gaffe during Obama's Iraq trip

      As Barack Obama began his trip to the Middle East and Europe, the media was already speculating about the possibility of a gaffe. Obama's travel "carries political risk," the New York Times reported, "particularly if Mr. Obama makes a mistake."

      But the only foreign policy error made in the last few days came this morning on ABC's Good Morning America, when John McCain made ANOTHER geography gaffe while trying to criticize Obama's visit to Iraq. (Just last week, McCain repeatedly referred to Czechoslovakia, a country that hasn't existed since 1993.)

      Asked by Diane Sawyer whether the "the situation in Afghanistan in precarious and urgent," McCain responded: "I think it's serious. . . . It's a serious situation, but there's a lot of things we need to do. We have a lot of work to do and I'm afraid it's a very hard struggle, particularly given the situation on the Iraq/Pakistan border."

      But as ABC's Rick Klein noted: "Iraq and Pakistan do not share a border. Afghanistan and Pakistan do."

    • Chavez Goes Weapons Shopping in Russia Amid Arms Race (Update2)

      July 21 (Bloomberg) -- Venezuelan President Hugo Chavez heads to Moscow today to shop for air defense systems, submarines and other weaponry as Latin America's arms race quickens amid signs that his regional influence is waning.

      Past Venezuelan arms purchases from Russia have strengthened ties with Moscow as its rivalry with the U.S. intensifies over President George W. Bush's plans for an Eastern Europe missile defense system and other issues. Chavez, 53, also plans to visit Belarus, a Russian ally that the U.S. considers a dictatorship.

      Chavez ``regularly refers to us as an `empire,' opposes our initiatives in the Americas and seeks out our adversaries as friends and allies,'' Assistant U.S. Secretary for Western Hemisphere Affairs Thomas Shannon said July 17 in testimony to a congressional committee.

      Chavez will order $2 billion worth of weapons, including Project 636 diesel subs, Mi-28 combat helicopters and airplanes made by Ilyushin Co., the Russian newspaper Kommersant reported May 12, without saying how it obtained the information. The Russian Interfax news service, citing an unnamed defense ministry official, said today Chavez may order $1 billion of weapons, including three Varshavyanka subs and up to 20 Tor-M1 air-defense systems.

      `Some Shock'

      ``What Chavez likes to do is to shock, and this will create some shock in Washington,'' said Riordan Roett, a professor of Latin American studies at Johns Hopkins University.

      Chavez, who plans to meet Russian President Dmitry Medvedev tomorrow, has bought more than $4.4 billion of Russian arms since 2003. He says the hardware, including jets and submarines, is needed to counter a military threat from the U.S. and its main regional ally, Colombia.

      Russia last year announced plans to build two factories to make Kalashnikov assault rifles in Venezuela.

      Russia has used Venezuela to diversify its arms-selling business beyond China and India, said Dmitry Vasiliev, an analyst at the Center for the Analysis of Strategies & Technologies, a Moscow-based defense research center. Venezuela was Russia's third-biggest arms customer last year, he said.

      Trade between the two countries surged to $1.13 billion in 2007 from $517 million the previous year, according to a statement published on the Venezuelan Information Ministry's Web site.

      `Ideal Partner'

      ``Russia is trying to be good friends with Chavez because he is an ideal partner in arms trade,'' said Fyodor Lukyanov, an analyst at the Council on Foreign and Defense Policy in Moscow.

      The Venezuelan president said this month he'll also discuss the creation of a joint development bank and an investment fund with Russia.

      Latin American countries have gone on a military spending spree in recent years as their governments collect record income from commodities, including Venezuela's oil windfall.       The AP reports that Barack Obama reversed a two-month downward trend by raising more and spending less. He took in $52 million in June, more than twice the nearly $21.5 million raised by John McCain. Obama had $72 million cash on hand to McCain's $27 million.

      The Politico points out that Obama raised $25 million on the last day of June alone:

      His one-day haul represents nearly half of his monthly total and more than Republican rival John McCain generated for the entire month. During the month, McCain did not have a single day in which he raised a million dollars.

      "South African President Thabo Mbeki announced plans Friday to work closely with the United Nations and the African Union as he attempts to mediate a settlement in Zimbabwe.

      The plan was applauded by Zimbabwe's opposition, which has criticized Mbeki as biased in favor of Zimbabwean President Robert Mugabe, and called for him to be replaced or work with a second mediator.

      Mbeki proposed that a special group of representatives from the U.N., AU and the Southern African Development Community be formed with which he would talk "on an ongoing basis."

      Mbeki would remain the main mediator trying to find a solution to Zimbabwe's deadly political crisis.

      In a statement released late Friday, opposition leader Morgan Tsvangirai welcomed the effort "to find a peaceful negotiated solution to the Zimbabwean crisis."

      Former Republican Sen. Phil Gramm said Friday that he is stepping down as co-chairman of Sen. John McCain's presidential campaign amid criticism for saying last week that "we have sort of become a nation of whiners."

      Democrats blasted Gramm for the comments, made in a Washington Times interview published July 10, and McCain forcefully repudiated the remarks.

      In a written statement released Friday, Gramm said his comments had become a distraction for McCain.
