Democracy Now and Iraq Veterans Against War held a conference called "Winter Soldier" allowing veterans of the Iraq War to publicly tell the stories of their time in Iraq. If you will not believe the news shows, the pundits, the papers, then listen to the words from the soldiers who were actually on the ground.

Is McCain Eligibility to Be President?
The NY Times revived an issue that got buried months ago: John McCain was born in the Panama Canal prior to a 1937 law, making him ineligible for the Presidency. Doh! The Republicans are truly f*cked if this is the case.
Section 1 of Article II of the Constitution contains the clause: “No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.
John McCain was born at the Coco Solo U.S. military base in the Panama Canal Zone to U.S. parents. Although the Panama Canal Zone was not considered to be part of the United States, federal law states that "Any person born in the Canal Zone on or after February 26, 1904, and whether before or after the effective date of this chapter, whose father or mother or both at the time of the birth of such person was or is a citizen of the United States, is declared to be a citizen of the United States". However, it should be noted that the law that conferred this status took effect on August 4, 1937, one year after John McCain was born.
While all this with out a doubt makes John McCain a U.S. citizen, it falls short of making him a natural born citizen. However, John McCain has survived this long, I doubt that this tiny stipulation would keep him down.

There Is No Fourth Amendment
FOURTH AMENDMENT [U.S. Constitution] - 'The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.'
"Skull and Bones member, war criminal and traitor George W. Bush recently signed HR 6304 or the FISA Amendments Act of 2008 into law that effectively makes the Fourth Amendment null and void. The new law disregards the protections guaranteed in the Fourth Amendment and allows the government to spy on people without a warrant so long as the government reasonably believes that they are gathering information on somebody from a foreign country.
The government can reasonably believe whatever they want and not have to provide probable cause supported by an oath or affirmation to obtain a warrant before they engage in spying activities. It gives them a blank check to spy on whoever they please. It also eliminates any sort of oversight in the intelligence gathering process, and this is a dangerous proposition.
The law also gives immunity to telecommunication companies from lawsuits pertaining to their prior cooperation in the unlawful spying programs implemented by the government. As expected, Bush and the supporters of this newly passed law are using the bogus excuse of the war on terror to undermine civil liberties. The terror war as has been documented time and time again is a fraud designed to setup a police state, justify illegal foreign wars and destroy the rule of law. The only reason there has been such a hurry to get this legislation passed into law is so Bush’s buddies in these Fortune 100 companies won’t get sued over their felonious activity." Homeland Security violates 4th Amendment with warrantless laptop searches
Skirting the Fourth Amendment allows the Department of Homeland Security to legally search your laptop with no reasonable or probable cause.
Is a laptop searchable in the same way as a piece of luggage? The Department of Homeland Security believes it is.
For the past 18 months, immigration officials at border entries have been searching and seizing some citizens’ laptops, cellphones, and BlackBerry devices when they return from international trips.
In some cases, the officers go through the files while the traveler is standing there. In others, they take the device for several hours and download the hard drive’s content. After that, it’s unclear what happens to the data.
The Department of Homeland Security contends these searches and seizures of electronic files are vital to detecting terrorists and child pornographers. It also says it has the constitutional authority to do them without a warrant or probable cause.
But many people in the business community disagree, saying DHS is overstepping the Fourth Amendment bounds of permissible routine searches. Some are fighting for Congress to put limits on what can be searched and seized and what happens to the information that’s taken. The civil rights community says the laptop seizures are simply unconstitutional. They want DHS to stop the practice unless there’s at least reasonable suspicion.
Legal scholars say the issue raises the compelling and sometimes clashing interests of privacy rights and the need to protect the US from terrorists and child pornographers. The courts have long held that routine searches at the border are permissible, simply because they take place at the border. Opponents of the current policy say a laptop search is far from “routine.”
“A laptop can hold [the equivalent of] a major university’s library: It can contain your full life,” says Peter Swire, a professor of law at Ohio State University in Columbus. “The government’s never gotten to search your entire life, so this is unprecedented in scale what the government can get.”

ACLU Sues Over Unconstitutional Dragnet Wiretapping Law
The American Civil Liberties Union filed a landmark lawsuit today to stop the government from conducting surveillance under a new wiretapping law that gives the Bush administration virtually unchecked power to intercept Americans' international e-mails and telephone calls. The case was filed on behalf of a broad coalition of attorneys and human rights, labor, legal and media organizations whose ability to perform their work - which relies on confidential communications - will be greatly compromised by the new law.
The FISA Amendments Act of 2008, passed by Congress on Wednesday and signed by President Bush today, not only legalizes the secret warrantless surveillance program the president approved in late 2001, it gives the government new spying powers, including the power to conduct dragnet surveillance of Americans' international communications.
"Spying on Americans without warrants or judicial approval is an abuse of government power - and that's exactly what this law allows. The ACLU will not sit by and let this evisceration of the Fourth Amendment go unchallenged," said ACLU Executive Director Anthony D. Romero. "Electronic surveillance must be conducted in a constitutional manner that affords the greatest possible protection for individual privacy and free speech rights. The new wiretapping law fails to provide fundamental safeguards that the Constitution unambiguously requires."
In today's legal challenge, the ACLU argues that the new spying law violates Americans' rights to free speech and privacy under the First and Fourth Amendments to the Constitution. The new law permits the government to conduct intrusive surveillance without ever telling a court who it intends to spy on, what phone lines and email addresses it intends to monitor, where its surveillance targets are located, why it's conducting the surveillance or whether it suspects any party to the communication of wrongdoing.

2008 FISA Amendment vs the US Constitution
(My 2 Cents)
The Constitution forbids the US government (Congress) from passing laws that violate the Bill of Rights (as in the 4th Amendment in this case).
The President, the Congress, the Federal Judicial System, the Military, and basically all Federal Services take an oath to defend the US Constitution.
Only in times of actual war where We the People have been physically attacked on our own soil, meaning the 50 states can a president temporarily suspend basic freedoms.
In addition, all acts of government have procedures. If we do not follow procedure, we do not have law.
Ex1: The congress did not declare war on Iraq, but authorized military action to wage war, which is not the same as declaring war nor is it constitutional. To physically attack another country, the President must ask Congress to declare war on that country. Pre-emptive war and pre-emptive strikes are not constitutional. We have other constitutional ways of handling violent groups outside the US.
Ex2: The 2008 FISA Amendment Act allows wire tapping for up to 7 days without a warrant on US citizens which is not constitutional.
4th Amendment:
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
The Constitution clearly states that the Executive Branch needs probable cause and a warrant. If any law violates probable cause and does not use a warrant, it is unconstitutional, period. Due to the corruption in the Executive Branch and the Judicial Branch of government, we can expect no challenge to the validity of the 2008 FISA Amendment and no stopping of the Executive Branch from committing illegal searches and seizures.

Aggressive, grassroots political activism kills 'thought-crime' bill in Senate
The Violent Radicalization and Homegrown Terrorism Prevention Act (H.R. 1955) passed by an overwhelming 404-6 in the House last October. However, the Senate Homeland Security and Governmental Affairs Committee does not plan to consider the Senate version of this bill (S. 1959) this year. Grassroots activists' calls seem to have moved the bill to a very slow track for the time being.
The Violent Radicalization and Homegrown Terrorism Act passed the House of Representatives 400 to 6 . The act proposes the establishment of a commission composed of members of the House and Senate, Homeland Security and others, to “examine and report upon the facts and causes of violent radicalization, homegrown terrorism, and ideologically based violence in the United States” and specifically the role of the internet in fostering and disseminating extremism.

Who are these Libertarians, and why should we care?
[U]nderstanding libertarianism is vital if the United States is ever to reverse the current 100-year trend away from freedom. What most Americans don’t know is that libertarianism is simply the modern political label given to the philosophy that the United States was founded upon. It is the philosophy of individual liberty. Without rediscovering what that means, the United States may soon be a glorious experiment with self governance by a free people that ultimately devolved into just one more socialist mediocrity or authoritarian nightmare...
... While most Americans still consider the United States the “land of the free,” few probably understand that “free” means individual liberty. Most Americans in 2008 have either never heard of individual liberty, or haven’t heard about it in so long that they have forgotten what it means. After decades of immersion in collectivist ideology, most Americans have been led to believe that freedom is “democracy.” Most Americans are content to be told that they are free, so long as the evening news explains why the most recent decisions made about their lives are really in their best interests. They are content to derive their “freedom” from government.
Imagine the presidential campaign of 1796 with today’s political frontrunners and today’s American psyche. John McCain is promising a generous helping of warfare, without neglecting essential welfare. Barack Obama is promising a generous helping of welfare, without neglecting essential warfare (at least on behalf of Israel). As these two titans battle for the prize, Thomas Jefferson, the Libertarian candidate, and John Adams, the Constitution Party candidate, answer the occasional question from the debate moderator in those states where they are able to get onto the ballot and into the debates at all. What might our country have become if this had been reality in 1796? What is it becoming now?
Certainly there will not be a Libertarian Party candidate elected president in 2008, nor likely in 2012 or 2016. The most successful LP candidate for president was Ed Clark in the 1980 election, with a whopping 1% of the vote. While it would be wonderful to see the Libertarian political party gain prominence and power, this is not the essential priority. What is much more important is that the American people start rediscovering libertarianism, the philosophy of individual liberty, and once again start demanding to be free. Libertarianism must again dominate the platforms of all political parties, as it once did, if the present trends toward socialism and authoritarianism are to reverse. Only when a libertarian Republican runs against a libertarian Democrat, with perhaps even a libertarian third party candidate in contention, will we have a chance to restore the freedom that fueled America’s mercurial rise to greatness. Only by restoring individual liberty will America return to prosperity, and once again become the land of the free.

The Constitution dies tomorrow
