Child Services takes children from white supremacist mother
Manitoba Child and Family services was in court Monday to argue for permanent guardianship of a girl and boy, after the seven-year-old girl was sent to school sporting a swastika on her arm.
Child services says it's concerned the parent's conduct might endanger the emotional well-being of the children. It's also said the children may be at risk of harm because of the parent's associations.
In an interview, the mother said: "It's OK to be proud to be a native, it's OK to preach black power," she said, before adding, "But when you're white and you're proud, it's wrong." Interestingly, the woman did not want to show her face on camera. That seems like shame to me, not pride.
I think imposing views like that on a child that very clearly does not understand them is exactly what child services is for. There is not more abusive parenting that parenting that creates hate. A 43-year-old Texas man was convicted of 43 child sex abuse counts in Weatherford on Tuesday. He was sentenced Wednesday to 4,060 years in prison, to be served consecutively, and a fine of $430,000.

Supreme Court Rejects Death Penalty for Child Rape

WASHINGTON — The Supreme Court ruled, 5 to 4, on Wednesday that sentencing someone to death for raping a child is unconstitutional, assuming that the victim is not killed.
“The death penalty is not a proportional punishment for the rape of a child,” Justice Anthony M. Kennedy wrote for the court. He was joined by Justices John Paul Stevens, David H. Souter, Ruth Bader Ginsburg and Stephen G. Breyer.
The court overturned a ruling by the Louisiana Supreme Court, which had held that child rape is unique in the harm it inflicts not just upon the victim but on society and that, short of first-degree murder, no crime is more deserving of the death penalty.
Justice Kennedy, while in no way minimizing the heinous nature of child rape, wrote that executing someone for that crime, assuming that the victim was not killed, violates the Eighth Amendment’s ban on cruel and unusual punishment.
Moreover, Justice Kennedy wrote, sentencing someone to death for raping a child could have terrible, unintended consequences, given the years that typically go by between a crime and the execution of the defendant.
“Society’s desire to inflict death for child rape by enlisting the child victim to assist it over the course of years in asking for capital punishment forces a moral choice on the child, who is not of mature age to make that choice,” Justice Kennedy wrote.
The dissenters were Chief Justice John G. Roberts Jr. and Justices Antonin Scalia, Clarence Thomas and Samuel A. Alito Jr., generally regarded as the conservative wing of the tribunal."

Children fed 'silly pills,' forced to perform sex shows
MINEOLA, Texas (AP) -- In the windowless front rooms of a former day care center in a tiny Texas community, children as young as 5 were fed powerful painkillers they knew as "silly pills" and forced to perform sex shows for a crowd of adults.
Two people have already been convicted in the case. Now a third person with ties to the club, previously known in town only as a swingers group, is set to go on trial Monday not far from Mineola, population 5,100.
"This really shook this town," said Shirley Chadwick, a longtime resident of Mineola. "This was horrible."
Patrick Kelly, 41, is charged with aggravated sexual assault of a child, tampering with physical evidence and engaging in organized criminal activity.
In all, six adults have been charged in connection with the case, including a parent of the three siblings involved.
Jurors this year deliberated less than five minutes before returning guilty verdicts against the first two defendants, who were accused of grooming the kids for sex shows in "kindergarten" classes and passing off Vicodin as "silly pills" to help the children perform.
Jamie Pittman and Shauntel Mayo were sentenced to life in prison. Kelly also faces a life sentence if convicted, and Smith County prosecutors hope for another swift verdict.
Thad Davidson, Kelly's attorney, said his client passed a lie-detector test proving his innocence and worries about getting a fair trial in Tyler, 25 miles southeast of Mineola, which is in Wood County.
"I think it's impossible to get a fair trial within 80 miles of Smith County," Davidson said.
Mineola, about 80 miles east of Dallas, is a close-knit, conservative bean-processing town of with more than 30 churches. Residents there want to put the scandal behind them as quickly as possible.
The one-story building where prosecutors say four children -- the three siblings, now ages 12, 10 and 7, and their 10-year-old aunt -- were trained to perform in front of an audience of 50 to 100 once a week has been vacant since the landlord ousted the alleged organizers in 2004.
Down a slight hill is a retirement home, and even closer is the office of the local newspaper. Doris Newman, editor of The Mineola Monitor, said rumors of swinger parties spread around town but that no one mentioned children being involved.
Newman, who can see the building from her office window, said she remembers the parking lot filling up with more than a dozen cars at night.
In August 2004, an editorial under the headline "Sex In the City" opined that if the swingers left quietly, "we'll try and forget they've infiltrated our town with their set of moral standards."
"It's not that we're trying to look the other way," Newman said. "But there's a lot more to Mineola than that."
According to a Mineola police report, the department first investigated a complaint in June 2005 in which the siblings' foster mother said one of the girls described dancing toward men and another child saying that "everybody does nasty stuff in there."
In the second trial, Child Protective Services caseworker Kristi Hachtel testified, "I've seen a lot and I never in my wildest dreams imagined this. They were preyed upon in probably one of the most heinous ways possible."
The children are now doing better, the welfare agency said.
"Through counseling and therapy sessions, these children are now finally feeling secure and safe," agency spokeswoman Shari Pulliam wrote in an e-mail.
Permanent custody of the three siblings was given to John and Margie Cantrell. This week, prosecutors in California charged John Cantrell with sexually assaulting a child in the state 18 years ago. Margie Cantrell said her husband is innocent.
Kelly's attorney moved Friday asking to postpone the trial in light of the allegations against Cantrell, a state witness. Texas Child Protective Services said it would be "common" for the agency to investigate.

Teacher threatens to rip student's eyeballs out
A 34-year-old teacher, Travis Heckstall (pictured), in Clayton County, Georgia threatened to rip out a student's eye balls, urinate on him, and kill his family. Students that witnessed the incident reported that two students were "horsing around as usual" in the computer lab when the teacher made the threats. The students recorded the teacher's reaction on their cell phones. The teacher calmed down and apologized to the students. Ohio teacher burns cross on child's arm
A public school teacher preached his Christian beliefs despite complaints by other teachers and administrators and used a device to burn the image of a cross on students' arms, according to a report by independent investigators.
Mount Vernon Middle School teacher John Freshwater also taught creationism in his science class and was insubordinate in failing to remove a Bible and other religious materials from his classroom, the report said.
School board members were scheduled to meet Friday afternoon to discuss the findings by consulting firm H.R. On Call Inc., hired by the district to investigate. The report was released Thursday.
School Superintendent Stephen Short wouldn't comment on the report before Friday's meeting, his office said. A message seeking comment was left for Freshwater's attorney, Roger Weaver.
The report comes one week after a family filed a federal lawsuit in Columbus against Freshwater and the school district, saying Freshwater burned a cross on their child's arm that remained for three or four weeks.
Freshwater's friend Dave Daubenmire defended him.
"With the exception of the cross-burning episode ... I believe John Freshwater is teaching the values of the parents in the Mount Vernon school district," he told The Columbus Dispatch in a story published Friday.

5-year-old boy tortured by mother in California - Child Protective Services Fails ...
The little boy's body was a study in pain. He was covered in cigarette burns, including to his genitals. He couldn't fully open his hand because it had been burned on a stove. His tooth was broken with a nerve exposed. And he had been made to sit in his own urine and feces, authorities say.
As the 5-year-old remains hospitalized by kidney failure brought on from malnutrition, two county supervisors are blaming welfare and law enforcement agencies for missing earlier chances to rescue the child from what police say were months of "unbearable psychological and physical abuse."

Man Shot and Killed While Beating 2 Year Old Boy
"Aguilar was spotted by a Stanislaus County sheriff's helicopter crew beating a baby boy in the middle of an intersection in rural Stanislaus County, Modesto police said. The helicopter responded to 911 calls around 10:15 p.m. Saturday from residents near the intersection of Bradbury and Blaker roads reporting a man was assaulting an infant.
"(He) was beating an infant in the middle of the road -- beating it for no apparent reason," said Singh. The crew decided to make an emergency landing in a cow pasture near the roadway but were blocked from reaching the man by an electrified, barbed-wire fence. A Modesto police officer serving as a tactical flight officer aboard the helicopter then shot the attacker.

For two years, authorities said, a mother subjected her son to what veteran detectives described as shocking, ritualistic abuse.
The 5-year-old was hung by his hands and wrists from a door jamb and beaten with some sort of leash or chain, police said. He was routinely denied food and water, burned with cigarettes on his body and genitals, and left to sit in his own urine and feces.

In the past few weeks, his hands were held to a hot stove, according to Capt. Fabian Lizarraga, causing injuries that may leave them permanently disfigured.
Starkeisha Brown, the boy's 24-year-old mother, allegedly committed the acts for about two years without detection -- until a bizarre series of events last week.
"It causes you to question the humanity of some people," Assistant Police Chief Earl Paysinger said about the abuse. "Whether they have a heart or a soul."
It started with an anonymous tip to the Los Angeles County Department of Children and Family Services saying there was a problem at the South Los Angeles apartment near 110th and Figueroa streets.
On Monday, June 9, Brown and her live-in girlfriend, Krystal Matthews, 19, were ordered to a children services office along with the boy to discuss the allegation of abuse.
Instead, the pair left the abused boy with a complete stranger and attended the meeting with a healthy-looking 4-year-old they said was Brown's son, along with a girl of about 6, authorities said. Police said they are trying to determine those children's identities.
They told the stranger, " 'Watch him for us.' They said 'We'll be right back,' " Lizarraga said.
While the women were being interviewed, the stranger who had been asked to watch the boy started asking people in the neighborhood what he should do with the 5-year-old, who looked sickly and injured. Eventually someone called authorities.
Officials got word of the boy's condition as they were interviewing Brown and Matthews and began asking more pointed questions and challenging the pair's story, Lizarraga said.
Halfway through the interview the two women sprinted from the office, abandoning the 4-year-old and his sister at the office, police said.
"They realize that no one is buying their ruse," said Lt. Vincent Neglia of the LAPD's Abused Child Unit, and "they bug out."

Police killed a 27-year-old man as he kicked, punched and stomped a toddler to death despite other people's attempts to stop him on a dark, country road, authorities said.
Investigators on Sunday were trying to establish the relationship between the suspect and the child they say he killed Saturday night. The Stanislaus County coroner said the boy appeared to be between 1 and 2 years old based on his size, according to county sheriff's deputy Royjindar Singh.

The suspect had a child's car seat in the back of his four-door pickup truck. The truck caught the attention of an elderly couple at 10:13 p.m. Saturday because it was stopped in the two-lane road facing the wrong direction, Singh said.
As they got closer, the couple saw the man brutally beating the toddler behind his truck and throwing the child on the ground, according to Singh. Two or three other cars stopped, an unusual number to be passing through the remote area surrounded by a dairy, a cow pasture, a cornfield and a farmhouse, he said.
"What we got from witnesses is he was punching, slapping, kicking, stomping, shaking," Singh said. "They tried to intervene and get involved, but their efforts really didn't have an effect. The suspect was engaged in what he was doing. He just pushed them off and went back to it."
A sheriff's helicopter responding to emergency calls from the area landed in a cow pasture at 10:19 p.m. carrying a Modesto police officer who shot the man to death after he refused an order to stop beating the child, Singh said.
Paramedics tried to resuscitate the toddler, who was not breathing when they arrived. The boy was taken to a local hospital, where he was pronounced dead.
