Child Labor Charges Filed Agains Meat Plant in Iowa
Des Moines, Iowa - The owner and managers of the nation's largest kosher meatpacking plant were charged Tuesday with more than 9,000 misdemeanors alleging they hired minors and had children younger than 16 handle dangerous equipment such as circular saws and meat grinders.
Two employees were also charged in federal court. The state and federal charges are the first against operators of the Agriprocessors plant in Postville, where nearly 400 illegal immigrant workers were arrested in May in one of the largest immigration raids in U.S. history.
The complaint filed by the Iowa attorney general's office said the violations involved 32 illegal-immigrant children under age 18, including seven who were younger than 16. Aside from handling dangerous equipment, the complaint says children were exposed to dangerous chemicals such as chlorine solutions and dry ice.
The attorney general's office said the violations occurred from Sept. 9, 2007, to May 12, 2008, when the plant was raided by immigration agents.
Charged are the company itself, Agriprocessors Inc.; plant owner Abraham Aaron Rubashkin; former plant manager Sholom Rubashkin; human resources manager Elizabeth Billmeyer; and Laura Althouse and Karina Freund, managers in the company's human resources division.
Each defendant faces 9,311 counts - one for each day a particular violation is alleged for each worker.
"All of the named individual defendants possessed shared knowledge that Agriprocessors employed undocumented aliens. It was likewise shared knowledge among the defendants that many of those workers were minors," the affidavit said.
Althouse and Freund also face federal immigration charges related to the raid and appeared in Tuesday in U.S. District Court in Cedar Rapids. Freund was charged with aiding and abetting harboring undocumented aliens, while Althouse was charged with conspiracy to harbor undocumented aliens and other counts.
The state charges are simple misdemeanors, each carrying a penalty of up to 30 days in jail and a $625 fine.
At a news conference Tuesday, Iowa Attorney General Tom Miller said the case is the largest of its type he'd handled in his 26 years as attorney general.
Chaim Abrams, a manager at the plant, said in a statement that Agriprocessors "vehemently denies" the allegations and "acted in good faith on the child labor issue."
"All of the minors at issue lied about their age in order to gain employment at the company," he said. They presented documents stating that they were over 18, he said, and "they knew that, if they told the truth about their age, they would not be hired."
But the attorney general's office said the company encouraged job applicants to submit forged identification documents that contained false information about their resident status, age and identity.
Sonia Parras Konrad, an attorney representing more than 20 of the children, said her clients were as young as 14 when they started working at the plant.
"We don't need to see any papers to see that someone is a child," she said. "This was not one mistake, two mistakes, three mistakes, but many, many mistakes."
Among the child labor violations were employing a child under age 18 in a meatpacking plant and employing a child under age 16 who operated power machinery or worked longer hours than permitted for someone that young.
In addition, the attorney general's office said, the company's records also show that employees were not paid for all overtime worked.
Postville resident Dave Hartley, 50, said it was troubling that the allegations would put the town back in the spotlight.

The REAL American Dream
Illegal Immigration.
What is it?
The term wasn't necessarily heard of before this century, or at least it wasn't very important.
It comes from the term "migration". Migration is a basic law of nature that cannot be changed and occurs when times are tough and beings just basically move.
Immigration is like migration, except the migrant moves to stay.
Now we are all hearing that this is made illegal, people are being deported in the hundreds every day. Normal people like us. People who work, who live on this land, who want to actually make something of themselves. People who quite possibly do not know or remember any other land but ours.
This country was founded by immigrants searching for a better life. These fellow immigrants are now making it impossible for other immigrants to do just that. The American Dream has been lost.
There are people out there who are trying to make a difference. Look at it this way:
remember the migration thing? It being a basic law of nature?
When this country becomes tough, people will go where it is nice or do something about it, that's just how it is. Apparently problems in other lands are larger than anyone can deal with right now. In the U.S. there is still a chance. There is talent here. There are people here who can make a difference.
The only problem is that the government has labeled them "illegal".

Mexicans deported from US face shattered lives
The towering black gate opens silently to an alley with walls of corrugated metal. Scrawled in large white letters on one wall is: "The End."
For those deported from the United States, the words are an unnecessary reminder. Nearly every hour of the day, guards unlock this gate that leads back into Mexico, clicking open the padlocks hung on each side, in each nation.
Every time the gate slams shut, it wipes out a dream, divides a family, ends a life lived in the shadows of the law.
On average, 700 Mexicans expelled from the United States walk through this gate daily, according to Mexican government figures. They include farmers, construction workers, prisoners, nannies, children, entire families.
U.S. deportations have jumped by more than 60 percent over the past five years. Mexicans accounted for nearly two-thirds of those deportees, helping to roll back one of the biggest migrations of recent history. All along the border, shelters once full of people trying to cross into the United States are now home to thousands of deportees who sleep on mattresses strewn inches apart on cement floors.
In a week spent at the Tijuana gate, The Associated Press watched busload after busload of deportees arrive, some in a daze, still stunned over their sudden expulsion. Many stumbled over the Mexican official's question, "Where are you from?" after spending decades in the United States.
The faces of those who stream through reflect how tough and far-reaching the U.S. crackdown on illegal immigration has become.
Among them are young people. There were more than 18,000 repatriations of children under 18 to Mexico this year, and in more than 10,000 cases they were alone, according to the Mexican government.
There are also criminals. The U.S. does not break down figures by country, but it has deported about 55,000 prisoners so far this year. One man walked through the gate in slippers with 80 cents in his pocket, after being picked up by police during a violent fight with his wife in their backyard.
And there are women, with more than 40,000 repatriations since January — about 13 percent of all cases, according to the Mexican government. Sometimes the women are dropped off alone, at night. The U.S. Border Patrol in Washington says the safe repatriation of women is a major concern, but acknowledges there is no overall policy along the 2,000-mile border.
Mexico must now deal with a population that it has long ignored. And those returning must deal with Mexico, a land that for many now seems foreign. Unfortunately the economic situacion what the illegal immigrants have from their home countries takes them to cross the U.S. border illegaly,thinking for their "American Dream" and to improve their families situation regardles how are they going to be treat by reaching their goal.
The reasons why the Mexican people cross the border are as the following:
1.- This situation is due to the Mexican government and the police enforcement corruption and the way they handle and steal their taxes, they just care about their personal interests.
2.- Lack of information about the U.S country and their politic with the immigrant people specially for Mexicans.
3.- The EDUCATION from their home countries, Almost all illegal immigrants could not reach the grade 12 of Highschool.
4.- The DISCRIMINATION to get a job in Mexico based on age, sexual orientation, ethnicy and sometimes religion but the main reasons are the age and ethnicy.
Examples: If someone look for an Office Position and he/she belongs from an indigenist group the employer won't hire him/her and they do not even look at him/her face so that's why they ask for his/her picture by filling out the job application.
And if someone is a woman, married and over 30 yrs old the employer won't hire her and if someone is a man the age limit to get a job is 35.
For those 4 main reasons the illegal immigrant think that they do not have any choise to cross the U.S border because they need to survive.
The International Amnesty MUST pay attention and must put pressure on the Mexican government to improve the situation and set up laws to avoid the discrimination mentioned above to avoid the illegal immigration in the U.S.
There is not excuse for the Mexican government, Mexico shouldn't ever live a poor economic situation because that country has everything such as Petroleum, natural resources, nice weather, archeology, beaches etc . . . On the other hand the illegal immigrant should open their eyes and help to put pressure on the Mexican government to stop stealing the taxes (15%) and start improving their life styles.

Legal, born in the U.S. residents denied citizenship!!
WESLACO, Texas -- In the archives of local institutions, Juan Aranda's life is firmly rooted in this small south Texas town.
His birth certificate says he was delivered unto Weslaco 38 years ago, and church records say he was baptized here soon after. School files list him as a student in the local district from kindergarten through high school, and voter rolls show he votes for president here.
But to the U.S. State Department, all that black and white looks a lot like gray. It recently refused to issue Mr. Aranda a passport; the government isn't sure he's an American.
"I never imagined my U.S. citizenship would be questioned," says the manager at a water company. "I've lived here since the day I was born."
The problem is that Mr. Aranda was delivered by a midwife at a private home. Parteras, Spanish for midwives, have been part of life in Hidalgo and Cameron counties along the border with Mexico from the time of the Texas Republic and before. But in the early 1990s, dozens of midwives were convicted of forging U.S. birth certificates for about 15,000 children born in Mexico as far back as the 1960s.
As a result, the U.S. government no longer trusts that anyone in this region delivered by a midwife is an American citizen. In those cases, the government demands additional proof -- a demand that has applicants scouring school warehouses and church offices to document their pasts.
That has caused a panic in south Texas, where locals need a valid passport more than ever. A new law that goes into effect next year requires Americans to use a passport, rather than just a birth certificate or driver's license, to visit Mexico and Canada. The situation threatens to isolate thousands of people in the Rio Grande Valley who regularly travel back and forth to Mexico for work or family reasons.
"Usually a state-issued birth certificate is sufficient to establish U.S. nationality," says Michael Kirby, a senior official for consular affairs at the State Department. But, given the fraud committed by some south Texas midwives, "we want to be careful that we issue passports to everybody who is eligible and not to anyone who isn't," he says, acknowledging that thousands of passport applicants could be affected. "Please Deport Me Plan"
ICE's latest "solution"
Over the past several months, both DHS (the Department of Homeland Security) and ICE (Immigration, Customs and Enforcement) have come under fire for the dozens upon dozens of unaccounted-for deaths in immigrant detention that have come to light. This was followed by outrage over ratcheted-up enforcement operations that have spawned the largest, and perhaps most unjust, workplace raids in US history.
The response?
Instead of making strides to repair an ailing immigration system, or ensuring humane detention conditions for those in DHS custody, ICE has introduced a plan so absurd, even its die-hard fans are stumped. ICE to immigrants: "Please Deport Yourselves."
In an honor akin to hosting the next Olympics, Chicago was selected to be one of five pilot cities for the "Please Deport Me Plan." "Operation Scheduled Departure," as ICE calls it, targets undocumented immigrants with no criminal record, whom ICE believes might be convinced to deport themselves. Spanish, English, and Polish-language ads will run in ethnic news outlets throughout the city to let undocumented immigrants know about this exciting new option at their fingertips. Inquiry finds under-age workers at meat plant
tate labor investigators have identified 57 under-age workers who were employed at a kosher meatpacking plant in Postville, Iowa, and have asked the attorney general to bring criminal charges against the company for child labor violations, Dave Neil, the Iowa Labor Commissioner, said on Tuesday.
“The investigation brings to light egregious violations of virtually every aspect of Iowa’s child labor laws,” Mr. Neil said in a statement announcing the results of a seven-month investigation at Agriprocessors, the nation’s largest kosher meat plant.
In a raid in May, 389 illegal immigrant workers were detained there in the largest immigration enforcement operation ever at a single workplace.
Mr. Neil said that investigators had found multiple child labor law violations for each under-age worker at the plant. They included employing minors in prohibited occupations, exposing them to hazardous chemicals, and making them work with prohibited tools like knives and saws, he said.

After the raid, many of the young workers said they felt they had nothing to lose in speaking out about their work at the plant. In interviews, they said they were forced to work long hours on night shifts, sometimes up to 17 hours a day, and were not paid all of their overtime. Illegal residents decline
"The number of illegal immigrants in the USA has fallen sharply as state and federal officials intensify a crackdown on undocumented migrants and jobs grow scarce in the faltering economy, according to a report Wednesday by a group that advocates reduced immigration.
Using Census data, the Center for Immigration Studies (CIS) estimates that the illegal immigrant population dropped by 10% to 11.2 million from August 2007 through May.
"Illegal immigrants are responding to changing conditions and leaving the country in significant numbers," says Steven Camarota, director of research at CIS.
His study found that the number of legal immigrants rose from 26.6 million to 27.6 million over the same period.
"It doesn't seem like America is more unpleasant for immigrants," he says. "It seems more unpleasant for illegal immigrants."
Camarota acknowledges that the study has limitations. The Census may undercount immigrants, he says, and his estimate of illegal immigrants calculates that 80% of those people counted by the Census as foreign-born Hispanics ages 18 through 40 with a high school education or less are in the USA illegally.
Jeffrey Passel, a demographer at the Pew Hispanic Center, uses the same Census data in his work. Camarota's analysis "makes a lot of assumptions from what he's actually measuring to what he's concluding," Passel says. "I don't know if it's right or not."
The study says stepped-up enforcement is the primary reason for the exodus.
Pat Reilly, spokeswoman for Immigration and Customs Enforcement, cites her agency's workplace raids, deportations and efforts to track down illegal immigrants with criminal records. Tougher enforcement "has made entering and staying in the United States illegally less attractive as the probability of being arrested and detained is greater than ever before," she says.
Groups that advocate for immigrants dispute the study's findings.
Angela Kelley, director of the Immigration Policy Center in Washington, D.C., says the illegal immigrant population is "nearly impossible" to measure. She faults the study for ignoring non-Hispanics.
She questions whether immigrants are leaving the USA or just moving from one place to another within the country to find work.

Immigration sanctions: US companies rebel
"Arizona steel fabricator Sheridan Bailey was frustrated by a state law that punished employers who hire illegal immigrants so he joined local employers and business owners to change it.
After behind-the-scenes lobbying from employers, the Arizona law was amended by Gov. Janet Napolitano in May to provide clarification and relief for businesses facing new restrictions and penalties.
"We want a balanced and reasonable approach to immigration reform," said Bailey, the president of Ironco Enterprises. "We don't want knee-jerk reactions to complex issues ... that affect the health of our economy."
The fight-back by businesses was triggered by federal government inaction and by a deepening crackdown by federal police who have nabbed hundreds of illegal workers across the United States in work site raids in recent months -- and they claim several successes."

Teens charged in killing of immigrant
Three white teens were charged Friday in what officials said was an epithet-filled fatal beating of an illegal Mexican immigrant in a small northeast Pennsylvania coal town. Brandon J. Piekarsky, 16, and Colin J. Walsh, 17, were charged as adults with homicide and ethnic intimidation in the July 12 attack on Luis Ramirez.
A third teen, Derrick M. Donchak, 18, was charged with aggravated assault, ethnic intimidation and other offenses. All are from Shenandoah, where the attack occurred.
The youths goaded Ramirez and the girl, saying, "You should get out of this neighborhood" and "Get your Mexican boyfriend out of here," documents said. After Ramirez and the girl began walking away, someone yelled an ethnic slur at him, court documents said. He responded, "What's your problem?"
A fight ensued, during which, police said, Walsh punched Ramirez in the face. The victim fell and hit his head on the street, leaving him unconscious, after which Piekarsky kicked him in the head, police said.
Additional charges are expected in the case that has roiled Shenandoah, a small, economically depressed town where police have reported friction between whites and a growing Hispanic population. Insight into Israeli-Palestinian conflict over land
The conflict between Arabs and Jews over grazing land and water wells in the ancient, arid hills south of Hebron in the West Bank has a distinctly biblical feel, like the flimsy tent encampments and dank caves in which some local Palestinian farming families dwell.
Had it not been for the camera — one of about 100 handed out in the West Bank by the Israeli human rights group Btselem for the purpose of documenting violent attacks — the June 8 assault may have ended up like many others that have occurred in these parts: unresolved.
But the graphic images and ensuing attention by the news media seem to have spurred the Israeli police. By Friday, the Judea and Samaria branch had arrested three suspects from the nearby modern Jewish settlement of Susiya after what a police spokesman described as “an intensive investigation.” Two of the three were under 18.
“The only weapon we have is the media,” said Khalil Nawajaa, 61, a patriarch of the clan that raises livestock and teases wheat, grapes and zucchini out of the thistle-spiked earth.
This is a follow up to a story WPTV posted last week that received a couple of critics that the attackers were actually Palestinian. Since the Israeli police followed up with an investigation, they were able to find the perpetrators and arrest them.
Finally, with the Internet and easy availability and use of cameras, governments and police are being questioned as to their authority and of how they handle situations. It all started with the police unmercifully beating a man in Los Angeles...Rodney King.

Court rejects case on border fence , Gives DHS and Bush authority to break environ...

The Supreme Court has turned down a plea by environmental groups to rein in the Bush administration's power to waive laws and regulations to speed construction of a fence along the U.S.-Mexican border.
Homeland Security Security Secretary Michael Chertoff (pronounced "Shirt_Off") has used authority given to him by Bush Congress in 2005 to ignore (break) environmental and other laws(???) and regulations to move forward with hundreds of miles of fencing in Arizona, California, New Mexico and Texas.
