In short, this dude ran a red light after drinking and hit two people, standard DUI homicide case ... but the "accident investigation division" found out through this guy's Myspace profile, that he lives a (wannabe) money, sex, drugs lifestyle ... so ... they are using his profile against him, they have searched his house and seized his computer ...
This guy is guilty, no doubt, for driving while being drunk ... but should they be using his Myspace as proof of this? Or for anything for that matter?

Tenure makes bad teachers hard to fire

MIDDLE ISLAND, N.Y. - Few people know better than school superintendent Allan Gerstenlauer that disciplining a tenured teacher can be a long and expensive process.
An English teacher in his Long Island district remains on the payroll, earning an annual salary of $113,559, even after pleading guilty earlier this month to drunken driving charges — her fifth DWI arrest in seven years.
The teacher will remain on paid leave at least until a disciplinary hearing in August, and it will be up to an impartial arbitrator to decide whether she needs to be fired as she faces a likely prison sentence.
"It is very frustrating that the process takes so long," Gerstenlauer conceded.

New law allows roadside blood and urine testing of Canadian drivers
Note: Here in the US, police are doing these kinds of tests even without laws having been passed.
Drivers who get behind the wheel while high on drugs will face roadside testing and they could be ordered to surrender urine, blood or saliva samples at the police station under a controversial new law that takes effect one week from today.
Drivers who refuse to comply will be subject to a minimum $1,000 fine - the same penalty for refusing the breathalyzer.
Police will be given their new powers to nab drug-impaired drivers after almost five years of intense debate in Parliament.
The law, passed this year after three failed attempts, has been lauded by law enforcement and other groups who say drug-impaired drivers are escaping unpunished at a time when their numbers are climbing.
"Love it," said Gregg Thomson, a father from Kanata, Ont., who predicted yesterday the new testing will deter people from driving under the influence of drugs, just as the breathalyzer test produced a drop in drunk driving.
The new law, however, has sparked warnings about potential court battles from critics who contend demanding bodily fluids is overly intrusive and scientifically unreliable in detecting drug impairment.
"This is going to be challenged left and right," predicted Murray Mollard, executive director of the British Columbia Civil Liberties Association.
Beginning next Wednesday, drivers suspected of being high will be required to perform physical tests at the side of the road, such as walking a straight line. If they fail, they will be sent to the police station for further testing by a trained "drug recognition expert" and then be forced to give blood, urine, or saliva samples if they flunk the second test as well.
Critics say while there is a measurable link between blood alcohol levels and driving ability, research is lacking to equate drug quantity and impairment.
Another potential problem in testing bodily fluids is that they can detect marijuana smoked several days or months earlier and the effect has worn off.
"This kind of testing doesn't test for impairment, it tests for past use of a substance and we know with certain substances they stay for a long time," Mollard said.
Federal privacy commissioner Jennifer Stoddart and the Canadian Bar Association also have raised alarm bells.
Testing is already happening in Quebec, Manitoba and British Columbia, but only when the driver voluntarily participates. However, that hardly ever happens because nobody "is going to consent to pee in a bottle" when they are not legally required, said Andy Murie, chief executive officer of Mothers Against Drunk Driving. School defends drunk driving hoax
On a Monday morning last month, highway patrol officers visited 20 classrooms at El Camino High School to announce some horrible news: Several students had been killed in car wrecks over the weekend. Classmates wept. Some became hysterical.

Driver charged in death of sleeping teen has DUI convictions
DUIBond was raised to $100,000 on Monday for a woman accused of being drunk when she drove a pickup truck through a Powder Springs home early Sunday, killing a sleeping teenager.
Bond was initially set Sunday at $35,000 for Janette L. Eason, but it was nearly tripled Monday morning by Cobb County Chief Magistrate Frank Cox, Cobb sheriff's spokeswoman Nancy Bodiford said.
Someone will have to put up $10,000 for Eason to be released from the county jail, where she was still being held Monday.
Cobb Chief Magistrate Judge Frank Cox took the unusual step Monday morning of raising Eason's bond.
"I felt like the original bond was not sufficiently high," Cox said.
Cox called his administrative assistant at 8 a.m. from his home to issue the bond order, something he's done only a couple of times during his eight years on the bench.
Cox reviewed her criminal history, which was not available to the original judge, Hugh Robinson, on Sunday night.
"He was only relying on what the police officers told him regarding the facts of the case," Cox said.
The chief magistrate judge said he followed the story on the news and reviewed Eason's criminal history.
Eason's convictions include: two DUI convictions; a felony for making terroristic threats; and driving with a suspended license.
Eason was arrested for DUI by the Georgia State Patrol in Cartersvile in September 2002. She was convicted on the charge in January 2003.
She was also convicted for DUI in Cobb County State Court in 1988.
Eason was convicted of driving with a suspended license in Paulding County Probate Court in September 2003.
Eason was also arrested for cruelty to children in Paulding County. The charges were dismissed, but she was convicted in Paulding County Superior Court of making terroristic threats in May 2003.
She was sentenced to probation on all of those cases, Cox said.
"I became concerned just through news reports as to the egregious conduct. For someone to be apparently so heavily intoxicated they didn't realize they were striking multiple objects and then driving into a house, causing the amount of damage they did, I can only assume there must have been a high rate of speed involved," Cox said.

Man drives head long into bike race.
On the 2nd of June a man collided with the front of a bike race 15 minutes in to the 21 mile race going between Playa Bagdad and Matamoros, across from Brownsville in Texas. Police think he was drunk and asleep at the wheel and ploughed into the front of the race injuring at least thirteen and killing one. Although the injuries sustained from a car impact mangling the bike your riding is a little twisted to think about.
The 28 year old Juan Campos has been charged with killing Alejandro Alvarez on the highway near Matamoros, Campos also claims he is a US citizen living in Brownsville, although the consulate could not immediately confirm this. Drunk Driver Plows Into Bike Race
A car plowed into a Mexican bike race along a highway near the U.S.-Mexico border, killing one and injuring 10 others.
The 28-year-old American driver was apparently drunk and fell asleep when he crashed into the race Sunday, police said.
The photograph above was taken by a city official and shows bicyclists and equipment being hurled high into the air by the collision.

Lindsay Lohan mug shot used in liquor industry ad
A mug shot of the 21-year-old actress, who has been in and out of rehab after two arrests last year on drunken driving and cocaine charges, was prominently featured Friday in an advertisement attacking legislation for devices that measure a driver's blood alcohol level before their vehicle can start.
The full-page black-and-white ad appeared in USA Today on Friday and was paid for by the American Beverage Institute, a trade group that supports the interests of the alcohol industry. The ad reads "Ignition interlocks are a good idea for" above Lohan's mug shot from her July 24, 2007, arrest and "But a bad idea for us" above smaller photos of people drinking.
The ad suggested that ignition interlocks were fine for "hard-core" drunk drivers, but suggested they would bring an end to champagne toasts at weddings, wine at dinner and ballgame beers.

World famous skateboarder Ali Boulala jailed for 2 years
A WORLD-famous skateboarder will spend at least two years in jail for killing champion Australian skater Shane Cross in a motorcycle crash.
Ali Boulala killed Cross when he smashed into the wall of the Tramway Hotel on March 7 last year. A rising superstar, Cross, 20, was a pillion passenger on the bike.
Boulala had a blood alcohol concentration of .162 and Cross, who died in hospital, had a blood alcohol level of .18. Neither of the men were wearing helmets.
Swedish-born Boulala has pioneered skating manoeuvres, featured in skateboarding videos, featured on the front cover of Transworld Skateboarding magazine and designed his own shoes. About 100,000 skateboards have been sold carrying his name since he turned professional in 1997.
The pro-skater suffered a severe brain injury in the accident and has not been able to return to skateboarding or motorbike riding.
Boulala spent more than three months in hospital and suffered post-traumatic amnesia for 65 days. By the time he was discharged from hospital he was able to walk 200m without a walking aid.
He was likely to be permanent affected by the injuries he sustained, Judge Pullen said. There was a question mark over whether he would ever be able to get on a skateboard again, she said.
"Prior to this offence you were a person of good character. You were also a role model, as was Shane Cross."

Responsible drunk driving
A 51 year old Wisconsin woman called 911 and then hung up. When the dispatcher called back the woman explained that her passenger/boyfriend had told her to call because he felt she was too drunk to drive. The woman explained that he was the drunk one and gave the dispatcher a description of her vehicle along with her address. She then explained the dispatcher that she had to go because she doesn’t like talking on her cell phone while driving.
As you can imagine a couple of officers were waiting on her doorstep when she pulled in. After being questioned by the officers she admitted that she had drank “about a six pack”.
