The Supreme Court delivered a blow to the Bush administration's polarizing Guantánamo Bay policies Thursday, giving the roughly 300 foreign terror suspects being held there the right to challenge their detention through the U.S. civilian court system. Cheney’s argument for not releasing innocent detainees: ‘They’ll all get lawyers.’
In his New York Times review of Jane Mayer’s new book, The Dark Side, Alan Brinkley describes how by the end of 2005, torture advocates within the Bush administration were fighting to continue their extreme detainee program “because they feared being prosecuted should the program be halted and exposed.” In one White House meeting described by Mayer, Vice President Dick Cheney argued against releasing innocent detainees because “they’ll all get lawyers“:
"By the end of 2005, those defending the regime of torture were no longer seeking primarily to protect the search for valuable intelligence. They were fighting for its survival, in the face of considerable evidence of the failure of SERE and other programs, because they feared being prosecuted should the program be halted and exposed. Even releasing detainees whom they knew to be entirely innocent was dangerous, since once released they could talk. “People will ask where they’ve been and ‘What have you been doing with them?’” Cheney said in a White House meeting. US Supreme Court says Guantanamo detainees have rights
Finally! The Supreme Court declared that even in times of war, the Constitution of the United States is still the law of the United States. After years of suspending the right of habeas corpus, the United States must allow prisoners at Guantanamo Bay the right to defend themselves against their accusers in front of a judge.
Habeas corpus is one of the most important laws the Founding Fathers wanted to survive. It means that if someone accuses you of a crime, you have the right to face that accuser in court and defend yourself. Instead, prisoners in Guantanamo have been sitting there for years without any recourse. They may be legitimate suspects, but with all the lies and deceptions the Bush administration has perpetrated on us, some of them may be innocent. ACLU Sues Denver For Information On Weapons Use During DNC
The American Civil Liberties Union has filed suit against the city of Denver after an open records request for information about the purchasing of security equipment for the Democratic National Convention was denied. The group wants to know what weapons the city is buying for crowd control during protests.
"Aren't you asking the police to reveal their tactics?" CBS4 asked.
"No, we're not asking the police to reveal tactics, we're asking the police to reveal how they are spending the public's money," said Mark Silverstein of the ACLU.
The city has allocated millions of dollars for security equipment purchases. Officials said they are planning for a peaceful event, but are ready for "contingencies."
The protest group Recreate 68 believes the city is buying high tech weaponry.
"We could save them a whole lot of money by just talking with us and de-escalating the confrontational situation that would cause them to use this weapon technology," said Glenn Spagnuolo of Recreate 68.
Spagnuolo thinks the city is looking at weapons like a stun gun which fires 20 seconds of pain from a shotgun. He also pointed to the LRAD, a long range acoustic device that emits a tone to disable people.
The city responded to CBS4's inquiries by saying it will not discuss tactics and that weapons use is part of that.
"It is important to keep that part of the planning confidential," said David Fine, a city attorney.
A court date is set for June on another lawsuit the ACLU filed against the city. That case concerns the routes protesters will be allowed to march during the convention.

Habeas corpus is a fundamental right in the Constitution that protects against unlawful and indefinite imprisonment. Translated from Latin it means "show me the body." Habeas corpus has historically been an important instrument to safeguard individual freedom against arbitrary executive power
Habeas corpus isn't a fancy legal term. It's the freedom from being thrown in prison illegally, with no help and no end in sight. No president should ever be given the power to call someone an enemy, wave his hand, and lock them away indefinitely. The Founders made the president subject to the rule of law. They rejected dungeons and chose due process.
We all know the difference between fairness and persecution. If we do not act immediately to fix the Military Commissions Act and restore our constitutional rights, basic protections like habeas corpus could be lost forever, and our country would become unrecognizable. On January 11, 2002 the first prisoners from Afghanistan arrived at the prison at Guantánamo Bay.
In the six years since, the prison has been a mark of shame for our country. In fact, three years after the military tribunals were first established there, there has yet to be a single trial completed for any person in custody.
Every day that the prison at Guantánamo stays open is an insult to our values and makes a mockery of our commitment to justice and the rule of law.
