      Members of Congress were told they could face martial law if they didn’t pass the bailout bill. This will not be the last time.

      Background: the First Brigade of the Third Infantry Division, three to four thousand soldiers, has been deployed in the United States as of October 1. Their stated mission is the form of crowd control they practiced in Iraq, subduing “unruly individuals,” and the management of a national emergency. I am in Seattle and heard from the brother of one of the soldiers that they are engaged in exercises now. Amy Goodman reported that an Army spokesperson confirmed that they will have access to lethal and non lethal crowd control technologies and tanks.

      George Bush struck down Posse Comitatus, thus making it legal for military to patrol the U.S. He has also legally established that in the “War on Terror,” the U.S. is at war around the globe and thus the whole world is a battlefield. Thus the U.S. is also a battlefield.

      He also led change to the 1807 Insurrection Act to give him far broader powers in the event of a loosely defined “insurrection” or many other “conditions” he has the power to identify. The Constitution allows the suspension of habeas corpus — habeas corpus prevents us from being seized by the state and held without trial — in the event of an “insurrection.” With his own army force now, his power to call a group of protesters or angry voters “insurgents” staging an “insurrection” is strengthened.

    • Who is afraid of Naomi Wolf: Sarah 'Evita' Palin to Usher in Rovian Poli...

      It sounds like the rabid rantings of some poor demented shlub posting at the Democratic Underground. Instead, it is Al Gore's former fashion adviser, Naomi Wolf, indulging in sanity-challenged fantasies on her Huffington Post blog. The target of Wolf's derangement is Sarah Palin and it is so over the top that one might suspect Wolf is an agent provocateur working for conservatives in order to discredit the left. Think I'm kidding? Check out this sampling of Wolf's plunge off the political deep end (emphasis mine):

      Please understand what you are looking at when you look at Sarah "Evita" Palin. You are looking at the designated muse of the coming American police state.

      You have to understand how things work in a closing society in order to understand "Palin Power." A gang or cabal seizes power, usually with an affable, weak figurehead at the fore. Then they will hold elections -- but they will make sure that the election will be corrupted and that the next affable, weak figurehead is entirely in their control.

      Um, thanks for letting us "understand" how things work, Naomi. And from here, she regales us with a strong dose of melodrama:

      I realized early on with horror what I was seeing in Governor Palin: the continuation of the Rove-Cheney cabal, but this time without restraints. I heard her echo Bush 2000 soundbites ("the heart of America is on display") and realized Bush's speechwriters were writing her -- not McCain's -- speeches. I heard her tell George Bush's lies -- not McCain's -- to the American people, linking 9/11 to Iraq. I heard her make fun of Barack Obama for wanting to prevent the torture of prisoners -- this is Rove-Cheney's enthusiastic S and M, not McCain's, who, though he shamefully colluded in the 2006 Military Tribunals Act, is also a former prisoner of war and wrote an eloquent Newsweek piece in 2005 opposing torture. I saw that she was even styled by the same skillful stylist (neutral lipstick, matte makeup, dark colors) who turned Katharine Harris from a mall rat into a stateswoman and who styles all the women in the Bush orbit --but who does not bother to style Cindy McCain.


      Wolf continues to wave her magic butterfly net with yet more inadvertently comedic gems:

      ...She uses mafia tactics against critics, like the police commissioner who was railroaded for opposing handguns in Alaskan battered women's shelters -- Rove's style, not McCain's...

      ...Reports confirmed my suspicions: Palin, not McCain, is the FrankenBarbie of the Rove-Cheney cabal...

      ...I believe the Rove-Cheney cabal is using Sarah Palin as a stalking horse, an Evita figure, to put a popular, populist face on the coming police state and be the talk show hostess for the end of elections as we know them. If McCain-Palin get in, this will be the last true American election. She will be working for Halliburton, KBR, Rove and Cheney into the foreseeable future...

      ...Look at the RNC. This is supposed to be McCain's America. But you see the unmistakable theatre of Rove's S and M imagery -- and you see stages eight, nine and ten of the steps to a dictatorship as I outlined them in The End of America. Preemptive arrest? Abusive arrest? "Newly released footage, which was buried to avoid confiscation, shows riot cops arresting and abusing a giant group of people for nothing."

      ...The riot police wore the black S&M gear of the Rovian fantasy life and carried the four foot batons cops carry in North Korea. All this is not John McCain's imagery or strategy: it is Karl Rove's...

      ...In McCain-Palin's America, citizens who are protesting are being charged as terrorists. This means that a violent war had been declared on American citizens. A well known reporter leaked to me on background that St Paul police had dressed as protesters and, dressed in Black -- shades of the Blackshirts of 1920 -- infiltrated protest groups...

    • A Call to Arms: Practical and Necessary Actions in Support of Democracy

      Now if I've never I talked politics with you personally before, it's important that you understand that I am not talking about partisanship, but merely our obligation as a free citizenry to hold our leaders accountable. It does not matter if a D or an R follows their name, the whole point of the Bill of Rights and our system of checks and balances was to ensure that power was dispersed. The United States was formed in order to throw off the bonds of a tyrannical and repressive system which allowed no means of criticizing its leaders. It was not formed to spread that democracy elsewhere, it was not formed to promote the will of God, it was merely a system by which ordinary people could decide if their leader was doing a good job or a bad job. The end is the means, and it in no way can come at the end of a spear.

      Before I let you watch the video, I just wanna be sure that to remind everyone that Bush can declare martial law at any time under the Defense Authorization Act of 2007.

      This was an actual amendment to the Insurrection Act which gives the power of the president to federalize the national guard. Here's a fun key change in what can trigger this authority. Originally, the president could only enact martial law under these conditions:

      "insurrection, domestic violence, unlawful combination, or conspiracy"

      Now, it's been expanded to include:
      "natural disaster, epidemic, or other serious public health emergency, terrorist attack or incident, or OTHER CONDITION [emphasis mine. Yeah, that's not vague at all]"

      ...but don't worry, because this can only happen if:

      "domestic violence has occurred to such an extent that the constituted authorities of the State or possession are incapable of maintaining public order." [hmmm, so like if all of the National Guard was stuck in Iraq this could happen, but then who would actually deal with this crisis? If only we had a privatized army run by a hardcore partisan Republican that was accountable to no one... Oh yeah, Blackwater! Whew!]

      And here's the key passage for me:

      "opposes or obstructs the EXECUTION OF THE LAWS of the United States or IMPEDES THE COURSE OF JUSTICE under those laws."

      Just when I think I will give up and let things take their course, no one is listening, along comes Naomi Wolf. Naomi will go down in history as a voice lighting the way out of the dark years of George W. Bush and the neocons.

      Naomi Wolf wrote: So let me get this straight. The Democrats in Congress cannot even get their own members together to defend the Constitution against a supremely unpopular executive who has essentially spit in their faces, eaten their lunch and the nation's, and publicly called them out as powerless. Not to mention the fact that they are setting a precedent for the future that any executive can emasculate any Congress and defy any subpoena after having committed possibly any crime. Still they are trembling under the barstools -- summoning up, perhaps, the courage to crawl out fully prone and toss their untouched guns humbly at the feet of the posse.

      Remember this: each and every member of Congress took an oath -- and the oath was not to some abstract government, it was an oath TO YOU -- to "support and defend the Constitution of the United States." Unlike many good people across the political spectrum who are appalled at this dismantling of the three-part system the founders put in place and the besmirching of the rule of law, Congressional Republicans have clearly decided to place their allegiance to the president and their party over their allegiance to the Constitution. This is bad enough; this is, in fact, treason. But the Democrats do not even have that party allegiance as an excuse for their treachery. They would be standing up for their party, the institution of Congress, and the Constitution by passing the contempt resolutions. What more will it take to get them to act?
