    • WaMu Placed On Probation As It Ousts CEO Killinger

Washington Mutual Inc. (WM) ousted Chief Executive Kerry Killinger while also announcing it entered a memorandum of understanding with the Office of Thrift Supervision, meaning the bank is now effectively on probation.

WaMu said the regulatory warning concerns aspects of the bank's operations, especially related to risk management and compliance functions.

The bank said it will provide regulators an updated, multi-year business plan and forecast for its earnings, asset quality, capital and business segment performance. In a bid to reassure investors, WaMu said the plan "will not require the company to raise capital, increase liquidity or make changes to the products and services it provides to customers."

    • Monsanto sues farmer over seed patent... court to rule

Monsanto is the owner of the patented herbicide Roundup and the also-patented Roundup Ready herbicide-resistant seed.

At issue in this case is David's right to plant Roundup Ready soybean seeds that he produced from plants grown from Roundup Ready seeds he purchased from Monsanto.

David lost the case, both at trial and at the federal circuit, and was fined $786,989. Last week, David appealed to the Supreme Court.

Presently, farmers must buy Monsanto seed annually to grow a Roundup Ready crop.

Some experts believed that a recent Supreme Court ruling on patent exhaustion indicated that the Supreme Court would grant David's appeal (if patent exhaustion was the issue presented on appeal).

Patent exhaustion means that the first sale of the patent seed exhausts the patent owner's rights.

Under this doctrine, Monsanto could not prevent use of its seed after the first sale.

David did not request the Supreme Court to consider the exhaustion doctrine because he did not believe the earlier ruling to be applicable because Monsanto's license agreement restricts use of the seed distinguishing his client's case from the case at hand.

Some patent experts believe the Supreme Court will therefore deny the appeal. David's lawyer strenuously disagrees.

The result? Monsanto's right to prevent farmers from planting herbicide resistant seeds they grow from Monsanto-patented seeds will remain in place until another suitable case makes its way through the court system. This could take decades.

David's lawyer informs me that $7.25 of the $21 cost of one “unit of Roundup Ready seed is attributable to the Monsanto technology fee.

Monsanto did not respond to my calls for current price structure.

      *************
I find it hard to believe that the Supreme Court in this case will rule in favor of the farmer regarding the patent. But then, it is possible though unlikely now that the patent exhaustion doctrine was not brought up in the appeal, which to me makes no sense. I wonder if they got to him? If they grant the appeal and he wins it will set a precedent for farmers everywhere who have purchased Monsanto's Roundup Ready seeds to not be obligated to purchase them every year, thus being able to save seeds as has been the practice of agriculture for centuries.

I truly find it despicable that Monsanto thinks it has the right to patent life itself and control the planting of seeds, and to then sue farmers who wish to use seeds taken from their own crops. Of course Monsanto has the clout and $$$$$$$$$$ to come down hard in influencing the decision on this appeal, as a ruling for the farmer could mean great loss of income to Monsanto. I will keep my fingers crossed for that. Kudos to this farmer for standing up to them and for farming as it should be.

    • Wisconsin Pod #5 :) "The Vital Obligation of Our Times."

This is Voice of The Revolution. Now one might ask, who are we to interfere with the workings of politics, and just for a moment one might agree. if for that moment we have forgotten what is truly at stake --just the future of this place that we call home. And when we comprehend the vast scale of change that is needed, and the very brief timeframe in which it must occur, and that OUR failure to do it means an endless and irreversible struggle for our descendents, and into this equation comes the realization that government, education, the media and even religion have all chosen to turn AWAY from reforms that can actually address all these bad things that we see overtaking America. Through these factors we are led directly to the comprehension that a reordering of our political society is the vital obligation of our times.

Let me leave you with this final thought; In 1776, the idea of "liberty", that we could govern ourselves was only theoretical. Today the idea that we can save ourselves has also become only theoretical.

To me, in my own heart and my own mind the future of America will be DECIDED by science, and by logic and by patriotism and finally, by LOVE for those American who must inherit what we leave behind. It's time to do what the founding fathers did --not what today's politicians do.

    • Wisconsin Pod #4 :) "The Un-Declared State of Emergency."

This is Voice of The Revolution. Thank you for joining me. We, all of us, Wisconsin, America, the world are facing a global and national upheaval and our media won't talk about it and our politicians have no plan of action. Perhaps this is a contributor to why 30 percent of Americans find themselves unable to sleep through the night. It is now anticipated that 40 percent of you will be under the care of a doctor for depression or anxiety.

The high hopes we placed on the internet as some sort of tool to change the world have gone unrealized. All those hours spent on line have have had NO observable or measurable EFFECT on revitalizing Wisconsin's ABSENT self-rule.

The openly acknowledged "brain-drain" occurring in Wisconsin should be treated like a state of emergency because what is left behind is NEED-LESS-LY diminished. And this causes a MORAL disaster. Because when your most ambitious, and creative, and inspired individuals move out of your state at the first opportunity the effect is draining. Especially on the children. Because Instead of having the stimulation of unconventional and inspired conjecture all around them, the young people INSTEAD face an ocean of corporate advertisers more than happy to fill the void.

For the first time in our nations history, the media and schools have decided to simply ignore the reality of our times. I am telling this to you to INFORM the NICE people with whom I now live, that there is a time to be nice and a time to be tough. Our history, and our citizenship and our love for our children makes it so. A fresh objective look at the state of the planet and the state of this nation connects us with the reality that we have to get TOUGH with the government that we have allowed to run amok.

This is Voice of The Revolution. This is not about race, and it is not even about immigration believe it or not. America is on the receiving end of a criminal insurgency, and it will soon hit Wisconsin like a sledge hammer. As it has every state from California to Florida and every medium and large city in America. As it did my home town of Los Angeles. Did you know that L.A. has equalized with Calcutta India in "economic disparity"? Did you know that Southern California is now officially categorized as a THIRD WORLD REGION? And REMEMBER my promise to say only what can be proved scientifically. (COMMERCIAL 2)

And that trend or illegal resettlement is expanding at breathtaking speed. And we sit here defenseless. I can tell you from experience, as an eye witness when it hits this city the warmth, and friendliness, and generosity, and courtesy will vanish.

we have CHOSEN to be peasants, and in that choice we leave our children powerless against ANOTHER social catastrophe that is hard to fathom, if you have not lived outside of Wisconsin. There is a new wave of racism in America that is directed against Caucasian peoples and is thriving. It is empowered in your children's classroom, and justified in the media. (COMMERCIAL 3)

If you don't believe these things just go visit L.A. It's a heartbreaking realization and it causes questions to swirl in the mind about how this "disappearance of our citizenship" could even happen in the first place. And that's a fairly simple equation. It's about influence. Who... is influencing our kids? Other than parents and grandparents?

    • Wisconsin Pod #2 :) "The Vital Obligation of Our Times."

This is Voice of The Revolution. The leading minds of our age are unequivocal. America and the world are in the opening stages of a long and uncomfortable "global fade-out". and at the very same moment we have let our politicians, the people who are supposed to be looking out for the wellbeing of our children simply go to work for corporations who are raking in vast fortunes from the very factors that are stealing the future.

As for the rest of us sitting here waiting for someone else to come along and fix it for us, we will be remembered as the worst generation of voters in American history. Why? To allow this state to become a political "dead-zone" as a mass extinction is beginning is indefensible.

And now here we are; Companies can raise prices of food and gas as they wish. The bank waits like a vulture to take your home. Advertisers prey upon your children like so many lab rats. The commercialized media has capitalized on our silence, and now. anyone who wants to reside illegally in your nation has a free pass to do so. Be advised, that the population of people who have done so is now estimated at 100 million and with "the machinery of self-rule" "DISABLED" your children will be powerless to do anything about it as those are joined by 100 million more, in deliberate disrespect of American law, in the next 30 years.

Featuring four notorious TV Commercials "of the revolution!"
(COMMERCIAL 1) Saying to us; "Trying to be a good parent? Looking at your children and thinking about their health, security, education and economic mobility is getting harder and harder as you realize that BOTH political parties have sold them out utterly. The morning, or week, or year after the next election and you realize that you have been conned yet again the Revolution is here for you."
(COMMERCIAL 2) "Why Revolution? We should all pose for a picture --waving through the camera to the people of the future. In the caption we could write: "Greetings from the moment of decision." We were all sitting around enjoying this (patriotic footage), and then we went to the polls and voted --and left you this (dead planet) "
(COMMERCIAL 3) "THE CONSTITUTION was designed to be used TO PRESERVE THE FUTURE OF THE NATION FOR YOU. Instead it has been USED TO TAKE IT FROM YOU. If the founding fathers came to us today... they would call on all Americans to galvanize into a movement to recover our quality of life and prepare for the coming storm. If the founding fathers came to us today... they would go door to door in legal US communities, not to take your guns -- but to make sure you still HAD them. If the founding fathers came to us today...they would immediately identify the crime wave surging into the country. Then without hesitation they would begin organizing militias. If the founding fathers came to us today... they would understand that we must update the constitution or see it shatter in the coming storm. ."

    • The broken promise of America: betrayal by America's rich

Who's paying the price for America's growing income gap? In the United States it is the richest among us who are most assuredly and solely benefiting, while the U.S. economy consistently fails over 30-million hard-working Americans primarily with substandard wages.

The U.S. government rigs the tax codes and contorts the laws specifically to over-burden the working classes while making the wealthiest in the United States more and more wealthy. The top one percent garners about 80% of all income gains. It is an extremely "lop-sided" system designed by the rich of this nation to benefit primarily the wealthiest top one-percent of our nation--particularly the top one-tenth of those wealthiest "one-percenters."

The working classes are simply and efficiently over-taxed to sure economic death working as much as 6 months out the year to pay "their" taxes, while the rich pay (as a percentage) MUCH less than their fair share. Is it fair that the wage earners are held to report literally ALL their income while the rich are exempted? Is it fair that American "corporations" (which the rich control with iron-clad fists) are shipping jobs, assets and intellectual property off-shore just as fast as they can?

The insolence and audacity of the rich to frame their own ideas exclusively in terms of purely "raw commercial value," serves as the primary excuse avoiding very real and generations-neglected social obligations and responsibilities to this nation--namely "to make society a more valuable place, to create involved participants...to form a more perfect union, to promote justice, to provide the common defense, to provide domestic tranquility, to provide for the COMMON wealth (the general welfare)--those are the reasons we created this country, and those should be the focus of our policies...but if our policies are merely pecuniary...then we're going to go down the wrong path." [quoting David K. Johnston, New York Times]

A devastating cast-like system is materializing in the United States at the behest of the rich who would have us remain ignorant or intentionally misled and deluded from the startling reality that is befalling hard-working Americans today...

    • The luxury of taxing the poor

Are taxes being levied fairly when it comes to the rich and the poor?

PBS NOW correspondent David Brancaccio investigates and finds that, for the rich and those doing their bidding in government, their obstinance is their bliss. Many states are providing corporate welfare on massive scales to big business interests in the context of "providing jobs" that do very little to alleviate crippling poverty in the communities they exploit with staggeringly inadequate wages and benefits--and this even after decades within those very communities their presence was expected to improve.

While most of the rich carefully concern themselves about which set of new clubs may best improve their golf game, working class families are irresponsibly left to teeter on the edge of complete destruction for the privilege of footing the bills for so many of those very luxuries the rich enjoin for themselves.

It is a fact that growing numbers ***within the United States*** are barely subsisting, often in poor conditions, and often going hungry without food, and without so many of just the basic "necessities" most of us take for granted every day. (Perhaps you should read that again.)

Watch and learn about reality in the land in of the "free", because if it's true you may not be rich, you certainly are paying for it.

Genetically modified soy was not tested properly by Monsanto as to allergic affects and other health risks. Nevertheless, the FDA approved it and it is now on the tables of America while the EU and other European countries have denounced it. To see any corporation with such a far reaching influence over the agencies of the US government that are supposed to be there to protect the citizens is criminal and flies in the face of Democratic principles. This is information people need to know about.

    • Monsanto patent fight ensnares Missouri farm town

Soybean farmer David Brumback calls himself a loyal customer of Monsanto Co. His product of choice: genetically engineered seeds resistant to pesticides and weed killers.

So when the biotech giant named Brumback and more than 100 other local farmers in a subpoena seeking five years of sales records, his first reaction was befuddlement. Then anger.

"With Monsanto, you're guilty until you're proven innocent," he said.

Across rural America, Monsanto is known for aggressive legal efforts to protect its patent. Farmers who save and replant the patented seeds in subsequent growing seasons quickly hear from the company's lawyers — and almost always lose, or settle out of court before trial.

Now Monsanto is raising the stakes against this so-called seed piracy with an unprecedented lawsuit against a farm co-op it accuses of aiding the illegal practice by cleaning seeds for use in future crops. That practice violates the contract between Monsanto and farmers which prohibits farmers from stockpiling seeds or selling second-generation seeds.

The St. Louis-based company says it's merely protecting an investment that exceeds $2 million a day in overall research and development costs.

Lawyers for the Pilot Grove Cooperative Elevator Inc. in the central Missouri town, population 750, offer a more nefarious explanation: Monsanto wants to make an example of the co-op through tactics that reek of bullying and intimidation.

"Monsanto is doing its best to make this case so expensive to defend that the co-op will have no choice but to relent," attorney Steven Schwartz wrote in a court motion filed earlier this year. The company sought purchase records and depositions from 114 Pilot Grove customers.

"Its true motive is to gather information for future lawsuits against the co-op, its customers and other farm businesses around Pilot Grove."
      ~~~~~~~~~~~~~~~~~
